Introductlon
ThlS report requests the City Councl1 to hold a public hearing on
the constructlon of concrete sidewalks on the east side of Neilsen
Way between P1CO Boulevard and Bay Street and Blckne1l Avenue and
Strand Street.
Background
On Ma rc h 22, 1983, the Clty Councll adopted Resolution No. 6647
(CCS) settlng a pub11C hearlng for April 26, 1983, to hear any
protests concernlng the construction of concrete sldewalks on
Neilsen Way between P1CO Boulevard and Bay Street and Bicknell
Avenue and Strand Street.
Notlces of the publlC hearing were mal led to property owners on
Ap r i 1 1 5 , 1983; the notlces were posted on April 18, 1983, all in
accordance wlth State law.
Presently, there are no sldewalks on the east side of Neilsen Way
between P1CO Boulevard and Bay St reet and Bicknell Avenue and
Strand Street. Foot trafflC in many instances must walk in the
street to proceed down Nellsen Way. To alleviate this dangerous
safety hazard, staff suggests that concrete sidewalks be
lnstalled. Presently, an apartment house and a few businesses

Consistent wlth pa st policy for assessing commerclal propertles,

per lineal foot based on past contracts. For a commercial
property owner with a 50 foot lot, the total estimated assessment
would be $250.00. Residential prope rt i es located within the
dlstrlct will not be assessed for sidewalk construction.
Flnancial Analysis
ThlS project W 1 1 1 be a pa rt of the 1983-84 Street Resurfaclng
ProJect. The assessments for sldewalk constructlon wlll ralse
approxlmately $1,500 1n revenues, which 1 s 33 percent of the total
cost. The remalning property 1 s City owned.
Recommendation
It 1 S recommended that City Counci 1 :
1. Open the public heari ng;
2. Close the publlC heanng and acknowledge any protests;
and
3. Adopt the attached resolution establlshing a sidewalk
construction dlstr1ct on the east slde of Neilsen Way
between Pica Boulevard and Bay Street and Bicknell Avenue
and Strand Street.

NOTICE TO IMPROVE
At a regular meeting held on March 22, 1983. the City Council
adopted Resolution No. 6647 {ces} which instructs the Street
Superintendent to order property owners to construct concrete
sidewalks along the property frontlng* the east side of Neilsen
Way between Pico Boulevard and Bay Street and Bicknell Avenue and
Strand Street. The materlals and work shall be in accordance
with the standards of the City of Santa Monica. I f cons truct1 on
is not begun within 60 days from the date of this notice and
d1l1gently and wlthout interruption prosecuted to completion,
the Street Superlntendent shall cause the constructlon to be done
and the cost shall be assessed against and a lien on the property.
The Clty Council will hear and pass upon Ob]ect1ons or protests to
the order to construct sldewalks, if any, by any property owner
or other 1nterested party at the following date, time and place:

OF SANTA MONICA ORDERING THE CONSTRUCTION OF

WAY BETWEEN PICO BOULEVARD AND BAY STREET AND
BICKNELL AVENUE AND STRAND STREET, ALL WI~HIN
THE CITY OF SANTA MONICA
WHEREAS, the City Council of the City of Santa Monica,
on the 22nd day of March, 1983, adopted Resolution No. 6647 (CCS)
setting a public hearing;
WHEREAS, written notices of said improvement have been
given in the manner required by law; and .
WHEREAS, any and all written objections and protests to
the work or extent of the district to be assessed were heard and
conSld~ed by the City Council; ..
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOllOWS:
SECTION 1. That the public convenience and necessity
