Introduction
Th1s report requests the Clty Councll hold a Public Hearlng for
the assessment of costs to repa1r damaged s1dewalks, driveways and
curbs at various areas with1n the City. It i s recommended that
Councll adopt the attached Resolution con firm i n g the assessment of
costs.
Background
On Apri 1 12. 1983, the C1ty Counc11 set a publlC hearing for May
10. 1983, on the assessment of costs to repalr damaged sldewalks,
dn veways and curbs wlthin the Clty of Santa Monica. Letters were
mal led to each property owner 1 n accordance wlth the legal
requlrements of Chapter 22 of the Improvement Act of 1911
1nforming them of the publ1C hear1ng on Apr11 29, 1983.
Recommendatlon
It 1 S recommended the C; ty Coun ci 1 :
1. Open the Public Hearlng;
2. Close the Public Hearing and acknowledge any protests; and
3. Adopt the Resolution conflrming the assessments.

REPAIR OF DAMAGED SIDEWALKS, DR I VE\~A YS, CURBS,
AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALI FORN IA
(SR-83-45)
Pu r sua n t to the provisions of Dlvis10n 7 , Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
St a te of California, the follow1ng work was caused to be done by
the Street Superlntendent:
The removal and replacement of 60 square foot
of PC concrete on sldewalks at $3 per square
foot;
The removal and replacement of 745 square feet
of PC concrete on sidewalks at $4 per square
foot;
The removal and replacement of 118 square feet
of drlveway at $5 per square foot; and
The removal and replacement of 5 11neal feet
of PC curb at $10 per 11neal foot.
The total cost of the above work was $3,970.00.
The total proposed assessment for the above sidewalk and
curb damage 1 s $1,985.00 or 50 percent of the total cost. The
other 50 percent of the cost i s being pald by the Clty as the
above repa1rs were caused by tree root da~age.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-45)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sidewalks, drlveways and curbs in the City of Santa Monica
at 1916 18th St., 1913 18th St., 1834 mth St., 1828 18th St., 1952
18th St., 1727 Delaware, 1814 19th St., 1908 19th St., 1924 19th
St. , 1928 19th St., 1938 19th St., 1944 19th St., 1948 19th St.,
1956 19th St., 1964 St., 2004 19th St., 2012 19th St., 2018 19th
St., 1801 19th St. and 1833 19th St.; and
WHEREAS, sixty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected pro pert i e s , and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets d1d f11e with the
City Counel1 of the City of Santa Monica his report of repairs and
cost as required by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour fixed for hearing by
Resolution Number 6662 (CCS), the City Council of the City of

Santa Monica heard and passed upon the report of the
Superintendent of Streets together with all objections and
protests as required by Section 5618 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1 . That the report of the Superintendent of
.
Streets heretofore filed and above-described be and the same is
hereby confirmed.
SECTION 2. That-all protests and objections of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repa i rs, as set forth
in the report of the Superintendent of Streets~ shall be assessed
against the properties therein described~ which properties front
upon the sidewalk upon which the repairs were made.
SECTION 4. That if such assessment is not paid within
the time pe rmi t ted by law, the same shall constitute a special
assessment against and lien on the properties therein described,
in the amount set fo rt h in the report of the Super1ntendent of
Streets, which lien shall cont1nue until the assessment and all
interest thereon is paid or until it is discharged of record.

SECTION 5. That if the asssessment is not paid within
the time permitted by law, the Superintendent of Streets, in
accordance with Section 5628 of the Streets and Highways Code,
shall deliver a Notice of Lien, prepared in the manner required by
Section 5626 of the St reet s and Highways Code, to the County
Auditor who shall collect the assessment together with all ot he r
taxes against the property.
SECTION 6. That the City Clerk shall certify to the
adopt1on of thls resolution and thenceforth and thereafter the
same shall be in full force and effect.
