Introductlon
ThlS report requests the Clty Council hold a public hearing for
the assessment of costs to repalr damaged sldewalks, drlveways and
curbs at various areas with1n the City. It 1S recommended that
Counc11 adopt the attached Resolut1on conf1rming the assessment of
costs.
Background
On April 26, 1983, the City Councll set a publ1C hearing for May
24, 1983, on the assessment of costs to repair damaged s1dewalks,
drlveways and curbs w1thin the City of Santa Monlca. Letters were
malled to each property owner 1n accordance with the legal
requirements of Chapter 22 of the Improvement Act of 1911
lnforming them of the publ1C hearing on May 13, 1983.
Recommendation
It 1 S recommended the Cl ty Counci 1 :
1. Open the publlC hearing;
2. Close the public hearlng and acknowledge any protests; and
3. Adopt the Resolution conflrm1ng the assessments.

STREET SUPERINTENDENT'S REPORT
REPAIR OF DAMAGED SIDEWALKS. DRIVEWAYS, CURBS.
AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7 , CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-83-46)
Pursuant to the provlsions of Dlvlslon 7 , Chapter 22,
Sectlons 5600 to 5630, of the Streets and Highways Code of the
State of Callfornla, the followlng work was caused to be done by
the Street Superlntendent:
The removal and replacement of 337.5 square
foot of PC concrete on sldewalks at $3 per
square foot;
The removal and replacement of 615 square feet
of PC c one rete on sldewalks at $4 per square
foot ; and
The removal and replacement of 25 square feet
of driveway at $4 per square foot.
The total cost of the above work was $3,572.50.
The total proposed assessment for the above sldewalk and
curb damage 1 s $1,786.25 or 50 pe rcent of the total cost. The
at he r 50 pe rce nt of the cost i s belng pald by the Clty as the
above repalfS were caused by tree root damage.
The removal and replacement of 104 square feet
of PC concrete on sldewalks at $5 per square
foot; and
The removal and replacement of 28 lineal feet
of cu rb at $10 per lineal foot.
The total proposed assessment for sldewalks and curbs i s
$800.00 or 100 percent of the total cost as the damage was not
related to tree roots.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGEO SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-46)
WHEREAS, the Street Superlntendent of the City of Santa
Monlca, pursuant to Sect 1 on 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
.
damaged sldewalks, driveways and curbs ln the Clty of Santa Monica
at 1937 to 1841 1 9t h St., 1901 19th St., 1907 19th St., 1023 19th
St. , 1925 19th St., 1927 19th St., 1943 19th St., 1957 19th St.,
1963 19th St., 2001 19th St., 2023 19th St., 2009 19th St., 2005
19th St. , 2133 21st St., 2401 21st St. , 2405 21st St., and 2135
21st St.; and
WHEREAS, s 1>~ ty days after said order was served, the
work had not been completed by the owners or persons in possesslon
of the affected properties, and the Superlntendent of Streets
caused the work to be done; and
\~HEREAS, the Super1ntendent of Streets gave the notice
required by Sectlon 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets did flle wlth the
Clty Councll of the Clty of Santa Monica his report of repalrs and
cost as requlred by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour flxed for hearing by
Resolutlon Numbe r 6674 (CCS)t the City Counc11 of the City of
Santa Monica heard and pa s sed upon the report of the
Superintendent of Streets together with all otljections and
protests as requlred by Sect10n 5618 of the Streets and Highways
Cod e ;
NOW, THEREFOREt THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the r e port 0 f the Superintendent of
Streets heretofore f11ed and atlove-described be and the same i s
hereby conflrmed.
SECTION 2. That all protests and objections of every
k 1 nd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and den1ed.
SECTION 3. That the cost of the repairs, as set forth
i n the report of the Superintendent of Streets, shall be assessed
aga1nst the properties therein descr1bed, which properties front
upon the sidewalk upon Wh1Ch the repairs were made.
SECTION 4. That if such assessment i s not pald withln
the tlme permitted by law, the same shall constitute a specl al

assessment against and lien on the propertles therein desc rl bed,
in the amount set forth 1n the rep 0 rt of the Superlntendent of
Streets, which 11en shall contlnue until the assessment and all

interest thereon 15 pald or unt11 ; t is discharged of record.

SECTION 5. That i f the asssessment i 5 not paid within
the time permitted by law, the Superintendent of Streets~ in
accordance with Sectlon 5628 of the Streets and Hlghways Code,
shall deliver a Notlce of Lien~ prepared in the manner required by
Sectlon 5626 of the Streets and Highways Code, to the County
Au d 1 tor who shall collect the assessment together with all other
taxes against the property.
SECTION 6. That the City Clerk shall certify to the
adoption of this resolution and thencefo rth and thereafter the
same shall be in full force and effect.
