July 12, 1983 on the Assessment of Costs
to Repalr Damaged Side\'/alks, Drlveways,

Introduction
ThlS report requests the City Councll set a publlC hean ng for
July 12, 1983, to hear protests regardlng the work and conflrm the
assessments of the cost to repalr damaged sldewal ks, dnveways and
cu rb s .
Background
On October 9, 1979, the C,ty Councll approved a sldewalk repalr
program WhlCh provlded fo r property owner particlpation ln the
cost of repalring damaged sldewalks. Property owner partlcipation
1 s 50% of the cost of the repalrs if the damage 1 s related to tree
root s ; the Clty pays the remalning 50% of the cost of the repalr.
Property owners are assessed 100% of the cost If the damage lS not
related to tree roots.
Certaln repair work has been completed at the following addresses
and the property owners I share of the costs are now due: 2120 Oak,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A HEARING DATE FOR ANY
PROTESTS OR OBJECTIONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIR OF
SI DUJALKS t DRIVEWAYS AND CURBS. (SR-83-48)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the Superlntendent of Streets wlll fil e
a report of repair pursuant to Section 5617 of the Streets and
Hlghways Code of the State of Cal1fornlat relating to the
construction of certaln improvements to sidewalks and driveways at

St . t 1701 Oak, 18 0 1 Oa k , 2102 Pearlt 2028 Pea rl t 2402 21st St. t

21st.t all within the Vlty of Santa Monica. A publlC hearlng must
be held pursuant to provisions all within the C1 ty of Santa
Monica.
SECTION 2. That pursuant to Sectlon 5600 et seq. of
sald cadet the City Councll does hereby order and declare that on
the 12th day of JulYt 1983. at 7:30 P.M., ln the Council Chambers
of the Clty Ha 1 1 t it will hear and pass upon the report by the
Superlntendent of Streets of the cost of repairt together with any

objectlons or protestst if any t WhlCh may be raised by any
property owner liable to be assessed for the cost of such repair
and any other interested persons.

SECTION 3. That all protests or objectlons must be i n
writlng and fl1ed wlth the Clty Clerk on or before the time set
for hearing of protests and objections.
SECTION 4. The Superintendent of Streets is hereby
dlrected to ma il notices. in the manner and form prescribed by
law, of the cost of repair and of the adoption of this resolution
to all persons owning real property affected by the sidewalk
assessment repalr program. whose names and addresses appear on the
last equalized assessment roll for the- City taxes or as known to
the Clty Clerk.
SECTION 5. The Clty Clerk shall certlfy to the adoptlon
of this resolution and thenceforth and thereafter the same shall
be in fu 11 force and effect.
