Introductlon
This rep 0 rt requests the Clty Council hold a public hearing fo r
the assessment of costs to repa1r damaged sldewalks, drlveways and
curbs at various areas within the Clty. It is recommended that
Council adopt the attached Resolution confirming the assessment of
costs.
Background
On May 24, 1983. the C 1 ty Councll set a publlC hearlng for June
14, 1983, on the assessment of costs to repair damaged sidewalks,
"
drlveways and curbs wlthln the City of Santa Monlca. Letters were
mal1ed to each property owner 1 n accordance with the 1 egal
requl rements of Chapter 22 of the Improvement Act of 1911
lnforming them of the publlC hearlng on June 2, 1983.
Recommendation
It 1 S recommended the City Council:
1. Open the pUblic hearing;
2. Close the public hearing and acknowledge any protests; and
3. Adopt the Resolutlon conflrming the assessments.

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS~
AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630~ OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-83-47)
Pursuant to the provislons of Dlvislon 7 ~ Chapter 22,
Sectlons 5600 to 5630, of the Streets and Hlghways Code of the
State of California, the followlng work was caused to be done by
the Street Superlntendent:
The removal and replacement of 1637 square
feet of PC concrete on sldewalks at $3 per
square foot;
The removal and replacement of 904 square feet
of PC concrete on sidewalks at $4 per sq ua re
foot;
The removal and replacement of 254.5 square
feet of PC concrete on driveways at $4 pe r
square foot;
The removal of 75 square feet of PC concrete
at $2 per square foot;
The removal and replacement of 22 llneal feet
of curb at $2 per square foot; and
The removal of 10.5 square feet of PC concrete
at $1.50 per square foot.
The total cost of the above work was $7,218.75.
The total proposed assessment for the above sldewalk and
curb damage 1 s $3,609.38 or 50 percent of the total cost. The
other 50 percent of the cost 1 S belng pa 1 d by the City as the
above repalrs were caused by tree root damage.

plates in front of ~y house were only lifted up, but not broken,
it would heve been e~sier and che8~er to just cut these plates
out, renove the roots vnderneqth and reinstall the same plates.
Te make a three day job out of this seoms ridiculous.
I am a retired senior citizen with a low ~1xed income, but
I am not looking for financial assist9Dce, but refuse to pay
8~T part of this. I an hereby asking you to recop-sider and pay
yourself now and In the future for this kind of a damage for
wh2ch only you yoursel: - the city - is responsible.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-47)
WHEREAS, the Street Superintendent of the City of Santa
Monlca, pursuant to Section 5600 to 5630 of the Streets and
Hi ghways Cod e , commenced proceedings to cause the repair of
damaged sidewalks, driveways and curbs in the City of Santa Monica
at 2125 21st St., 2315 21st St., 2141 21st St., 2201 21st St.,
2247 21st St., 2341 21st St., 2345 21st St., 2411 21st St., 2425
21st St., 2421 21st St., 2435 21st St., 2428 21st St., 2445 21st
St. , 2422 21st St., 2432 21st St., 1428 25th St., 1424 25th St.,
2452 21st St., 2451 21st St. and 2503 21st St.; and
WHEREASt sixty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent o~ Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did fl1e with the
City Council of the City of Santa Monica his report of repairs and
cost as required by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour flxed for heanng by
Resolution Number 6678 (CCS), the City Council of the City of
Santa Monica heard and passed upon the report of the
Superintendent of Streets together with all obJ ect ions and
protests as required by Sectlon 5618 of the Streets and Hlghways
Code;
NOW, THEREFOR E, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1 . That the report of the Superintendent of
St reets heretofore filed and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and object10ns of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repa i rs, as set forth
in the report of the Superintendent of Streets, shall be assessed
against the properties therein described, which properties front
upon the sidewalk upon which the repairs were made.
SECTION 4. That if such assessment is not paid within
the time permltted by law, the same shall constitute a special
assessment against and lien on the properties therein described,
In the amount set fo rt h 1 n the report of the Superintendent of
Streets, which lien shall contlnue until the assessment and all
interest thereon is paid or untl1 it is discharged of record.

SECTION 5. That if the asssessment is not pald within
the time permitted by law, the Superintendent of Streets, in
accordance with Section 5628 of the Streets and Highways Code,
shall deliver a Notice of Lien, prepared in the manner requlred by
Section 5626 of the St reet s and Highways Code, to the County
Auditor who shall collect the assessment together with all ot he r
taxes against the property.
SECTION 6. That the City Clerk shall certlfy to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
