Introductlon
This report requests the CIty Council hold a publIC hearIng for the
assessment of costs to repair damaged sIdewalks, drJ.veways and curbs
at var1.OUS areas W1.thIn the CIty. It IS recommended that CouncIl
adopt the attached ResolutIon confIrmIng the assessment of costs.
Background
On August 14, 1984, the CIty Council set a publiC hearIng for
September 11 , 1984, on the assessment of costs to repaIr damaged
sIdewalks, drIveways and curbs wIthIn the CIty of Santa MonIca.
Letters were mailed to each property owner In accordance wlth the
legal reqUIrements of Chapter 22 of the Improvement Act of 1911
lnforming them of the public hearIng on August 30, 1984.

ThIS assessment dIstrict wIll generate revenues to the City over the
next two years In the amount of $2,336.63. (Any unpaId assessments
wIll be placed on the 1985 property tax bIll.)

1- Open the publlC hearlng;
2. Close the publlC hearlng and aCknowledge any protests; and
3 . Adopt the attached Resolution conflrming the assessments.

STREET SUPERINTENDENT'S REPORT
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7 ,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA CSR-84-58)
Pursuant to the provisions of DiViSion 7, Chapter 22, Sections
5600 of 5630, of the Streets and Hl.ghways Code of the State of
Californ1a, the followlng work was caused to be done by the Street
Super1ntendent:
The removal and replacement of 90 square feet of PC concrete
on sldewalks at $3 per square footi and
The removal and replacement of 768 square feet of PC concrete
on sldewalks at $4 per square foot; and
The removal and replacement of 67 square feet of PC concrete
on dr1veways at $5 per square foot; and
The removal and replacement of 16 lineal feet of PC concrete
curb and gutter at $10 per llneal foot; and
The removal of 418.25 Ilneal feet of PC concrete parkway at $2
per square foot.
The total cost of the above work was $4,673.25
The total proposed assesment for the above sldewalk and curb
damage is $2,336.63 or 50 percent of the total cost. The other 50
percent of the cost 1S being pa1d by the City as the above repairs
were caused by tree root damage.

MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (sR-84-58)
WHEREAS, the Street Superlntendent of the Cl.ty of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and Hlghways
Code, commenced proceedlngs to cause the repair of damaged sldewalks,
driveways and curbs in the CIty of Santa Monica at 1604 San
Vlcente,1526 San Vlcente, 211 San Vlcente, 2617 Washlngton, 266 21st
Place, 229 San Vlcente, 404 San Vlcente, 225 San Vlcente, 621 San
Vlcente, 537 San Vlcente, 527 San Vlcente, 305 San Vlcente, 521 San
Vlcente, 630 San Vlcente, 326 San Vlcente, 416 San Vlcente, 515 San
Vlcente, and 511 San VIcente, all wIthIn the CIty of Santa MonIca.
'.1HEREAS, Slxty days after sald order '""as served, the Hark had
not been completed by the owners or persons 1n posseSSlon of the
affected propertIes, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
requlred by Section 5616 of the streets and HIghways Code; and
WHEREAS, the Superintendent of Streets dld fIle Wl th the CIty
Council of the Clty of Santa Monlca hiS report of repalrs and cost as
required by Sectlon 5617 of the Streets and HIghways Code; and
WHEREAS, upon the day and hour fixed for hearlng by Resolutlon
Number 6895 (CCS) , the CIty Councll of the CIty of Santa Monica heard
and passed upon the report of the Superlntendent of Streets together

wIth all ObjectIons and protests as requIred by SectIon 5618 of the
Streets and HIghways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of Streets
heretofore flIed and above-descrlbed be and the same IS hereby
confirmed.
SECTION 2. That all protests and ObjectIons of every kInd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. That the cost of the repaIrs, as set forth In the
report of the SuperIntendent of Streets, shall be assessed agaInst the
propertIes thereIn descrIbed, WhICh propertIes front upon the SIdewalk
upon WhICh the repaIrs were made.
SECTION 4. That if such assessment IS not paId withIn the
tIme permItted by laW', the same shall constitute a speCIal assessment
agaInst and lIen on the propertIes therein descrIbed, In the amount
set forth In the report of the SuperIntendent of Streets, WhICh lIen
shall contInue untIl the assessment and all Interest thereon is paId
or untIl It IS dISCharged of record.
SECTION 5. That If the assessment is not paId WIthIn the tIme
permItted by law, the SuperIntendent of Streets, In accordance WIth
Section 5628 of the Streets and HIghways Code, Shall delIver a NotIce
of LIen, prepared In the manner reqUIred by SectIon 5626 of the

assessment together wlth all other taxes against the property.
SECTION 6. That the City Clerk shall certify to the adoption
of thiS resolutlon and thenceforth and thereafter the same shall be in
