IntroductIon
ThIS report requests the CIty CouncIl repeal Resolutior No. 6952
ar.d set a publIC hearIng for February 26, 1985, to hear protests
regardlrg the work ard corflrm the assessmerts of the cost to
repair daMaged SIdewalks, drIveways ard curbs.
Backgrourd
On October 9, 1979, the CIty Cour.cIl approved a SIdewalk repaIr
prograM WhICh proVIded for property owner partIcIpatlor 11" the
cost o! repaIrirg damaged SIdewalks. Reslder.tIal property owner
partIcipatlor IS 50$ of the cost of the repaIrs If the damage IS
related to tree roots; the CIty pays the remalY:!lng 50% of the
cost of the repaIr. Property owners are assessed 100% of the
cost If the damage IS not related to tree roots and commercial
property owrers are assessed 100% of the cost regardless of the
cause of the damage.
CertaIn repaIr work has beer completed at the followlrg addresses
ar:d the property oW1"ers' share of the costs are now due: 1620
Broadway, 534 23rd Street, 513 14th Street, 1021 PIne Street, 128
Esparta Way, 2504-2512 11th, 827 20th Street, 823 20th Street,

be held pursuart to the provIsIons of Chapter 22, Sectlors 5600
to 5630, of the Streets and HIghways Code of the State of
Califorrla.
01'" Decer.lber 1 1 , 1984, the CIty CouncIl set a pUblIC hearIng for
Jaruary 8, 1985 for thIS sIdewalk assessment dIstrIct. However,
legal rot Ices for the hearIng were not sent out In accordal"ce
with Chapter 22 of the Improvemert Act of 1911. Therefore, It is
necessary to repeal ResolutIon Number 6952 and reset the publIC
hearirg for February 26, 1985.

The fll'anCIal aralysIs which wIll IndIcate total revel'ues to be
derIved from thIS assessmert dIstrIct over the next two years
wIll be presented to CIty CouncIL at the time of publIC hearIng.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA REPEALING RESOLUTION
NO. 6952 AND SETTING A HEARHJG DATE FOR
ANY PROTESTS OR OBJECTIONS TO THE REPORT
OF THE SUPERINTENDENT OF STREETS
REGARDING REPAIR OF SIDEWALKS, DRIVE\{A YS
AND CURBS (SR-85-59)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1- ResolutlO~ Number 6952 IS hereby repealed.
SECTION 2. That the Superlnterdert of Streets will flle
a report of repalr pursuant to Sectlon 5617 of the Streets and
Hlghways Code of the State of Califorrna, relatlng to the
corstructlor. of certalr ImprOVemeJ1ts to sldewalks ard driveways
at 1620 Broad'..say, 534 23rd, 513 14th Street. 1021 Plre Street,
128 Esparta 'Jay, 2504-2512 11th Street, 827 20th Street, 823 20th
Street, 1514 Haple Street and 1315 Haple Street, all wlthln the
Clty of Sarta Monlca.
SECTION 3. That pursuant to Sectlon 5600 et seq. of said
code, the Clty Courcll does hereby order and declare th at on the

SECTION 5. The Superlnterdent of Streets is hereby
dlrected to mall potlces, ln the marner ard form prescrlbed by
law, of the cost of repair apd of the adoption of thiS Resolutlor
to all persons oWPlng real property affected by the sidewalk
assessrner.t repalr program, whose names af'1d addresses appear or
the last equallzed assessmert roll for the Clty taxes or as krown
to the Clty Clerk.
SECTION 6. The Clty Clerk shall certlfy to the adoptiop
of thlS resolutlor ard therceforth ard thereafter the same shall
be If' full force and effect.
