:hIS report requests the City CouncIL hold a publIC tearlng for the
assessment of costs to repair d aIr. ag ed sidewalks, drIveways and curbs
at VarIOUS areas WIthIn the CIty. It is recommended that CouncIl
adopt the attached ResolutIon conflr~ing tte assessment of costs.
Background
On March 26. 1985. the City Council set a publIC hear Ing for Apr 11 23, ~
1985, on the assessment of costs to repaIr damaged sidewalks,
driveways and curbs wittIn the City of SaYJ.ta MonIca. Letters were
maIled to eact property own e r in accordance wIth tte legal
reqLlIrerr.ents of Chapter 22 of the Irr.provement Act of 1911 Inforrr:lng
therr: of the public hearIng on April 12, 1985.

ThIS assessncent dIstrict will generate revenues to the CIty over the
next two years ln tte amount of $1791.00. (Any unpaid assessments
WIll be placed on tte 1986 property tax blll.)

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUC~IONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SEC:rONS 5600 TO 5630, OF THE STREE7S AND HIGHWAYS
CODE OF THE STAiE OF CALIFORNIA (SR-85-61)
Pursuant to the provls1ons of DIV1Slon 7, Chapter 22, Sect10ns
5600 of 5630, of the Streets and Hlghways Code of the State of
Californla, the following work was caused to be done by the Street
SuperIntendent:
The r emov a1 and rep1acerrent of 14 lineal feet of PC concrete
curb at $10 per lIneal foot; and
The rerrova1 and replacement of 343 square feet of PC concrete
on sldewalks at $4 per square foot; and
The relJ'.oval and replacement of 286 square feet of PC concrete
on driveways at $5 per square foot; and
The rerr.oval and replacement of 5 lineal feet of PC concrete
curb and gutter at $12 per Ilneal foot; and
The removal of 21.5 lIneal feet of PC concrete parkway at $2
per square foot.
The total cost of the above work was $3,002.00
The total proposed assesment for the above SIdewalk and curb
damage 1S $1,501.00 or 50 percent of the total cost. ':'he other 50
percent of the cost IS be1ng pa1d by the C1ty as the above repa1rs
were caused by tree root damage.
The removal and replaceItent of 11 Ilneal feet of curblng at
$10 per lineal foot; and
The removal and replacement of 36 square feet of drlveway at
$4 per square foot.
Tte total proposed assessment for sldewalks and curbs 18
$290.00 or 100 percent of the total cost as the damage was not related
to tree roots.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
KONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS '( SR-85-61)
WHEREAS, the Street Superintendent Of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged sidewalks,
driveways and curbs in the City of Santa Monica at 1519 Pacific, 1511
Pacific, 1515 Pacific, 465 22nd, 1512 Pacific, 1502 Pacific,1520
Pacific, 3231 Pearl, 718 Lincoln, and 3324 Pearl all within the City
of Santa Monica.
WHEREAS, sixty days after said order was served, the work had
not been completed by the owners or persons 1n possession of the
affected properties, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and Highways Codej and
WHEREAS, the Superintendent of Streets did file with the City
Council of the City of Santa Monica his report of repairs and cost a-
required by Section 5617 of the Streets and Highways Codej and
WHEREAS, upon the day and hour fixed for hearing by Resolutif
Number 6990 (CCS>, the City Counc1l of the City of Santa Monica hea
and passed upon the report of the Superintendent of Streets togeti
with all objeotions and protests as reClu1red by Section 5618 of
Streets and Highways Codej

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of Streets
heretofore flled~ and above-described be and the same is hereby
confirmed.
SECTION 2. That all protests and objections of every kind and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. That the cost of the repairs, as .set forth in the
report of the Superintendent of Streets, shall be assessed against the
properties therein described, which properties front upon the sidewalk
upon which the repairs were made.
SECTION 4. That if such assessment is not paid wlthin the
time permitted by law, the same shall constitute a special assessment
against and lien on the properties therein described, in the amount
set forth in the report of the Superintendent of Streets, which lien
shall continue until the assessment and all interest thereon 1s paid
or until it is discharged of record.
SECTION 5. That if the assessment is not paid within the time
permitted by law, the Superintendent of Streets, in accordance with
Section 5628 of the Streets and Highways Code, shall deliver a Notice
of Lien, prepared in the manner required by Section 5626 of the
Streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes against the property.

SECTION 6. That the City Clerk shall certify to the adoption
of this resolution and thenceforth and thereafter the same shall be in
full force and effect.
