IntroductIon
ThIS report requests that the City Council hold a publle hearIng for
the assessment of costs to repaIr damaged sldewal ks , drIveways and
curbs 'at var IOUS locat1.ons In tne CIty. It IS recommended that
Councll adopt the attached ResolutIon confIrmIng the assessment of
costs.
Background
On June 25, 1985, the CIty Council set a publIC hearIng for July 23,
1985, for the assessment of costs to repaIr damaged SIdewalks,
drIveways and curbs at varIOUS locatIons wIthIn the Clty of Santa
MonIca. Letters were mailed 1n advance (July 12, 1985) to property
owners Informlng them of the publIC hearlng In accordance WIth the
1 eg a 1 reqUIrements of Chapter 22 of the Improvement Act of 1911.
Budset/Flnanc~al Impact
ThIS assessment dIstrIct WIll generate revenues to the CIty over the
next two years in tne amount of $1,888.00. (Any unpaId assessments
WIll be placed on the 1986 property tax bIll.)

CODE OF THE STATE OF CALIFORNIA (5R-85-67)
Pursuant to the provlslons of D1v1slon 7, Cnapter 22, Seetlons
5600 of 5630, of the Streets and Hlghways Code of the State of
Call.fornla, toe f0110wlng work was caused to be done by the Street
Super1ntendent:
The removal and replacement of 629 square feet of sl.dewalk at
$4 per square footi
The removal and replacement of 14 llneal feet of PC concrete
curb at $10 per llneal foot; and
The removal and replacement of 224 square feet of PC concrete
on drlveways at $5 per square foot.
The total cost of the above work was $3,776.00
I'he total proposed asseSffient for the above Sldewalk and curb
damage 1S $1,88d.OO or 50 percent of the to tal cost. The other 50
percent of the cost 15 beIng pald by the Clty as the above repa1rs
we~by~amage.

MONICA CONFIRMING THE REPORT OF rHE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEwALKS,
DRIVEWAYS AND CURBS (SR-85-67)
WHEREAS, the Street Superintendent of the C~ty of Santa
Monica, pursuant to Section 5600 to 5630 of tne Streets and H~ghways
Cod e , commenced proceed~ngs to cause the repair of damaged s~dewa1ks,
drlveways and curbs in the C1ty of Santa Mon~ca at 1012 2nd St., 305
Palisades Avenue, 1419 10th St., 1701 Californ~a Ave., 1730 Callfornla
Ave. , 1025 Pine St., 2323 La Mesa Dr., 1029 2nd St., 1531 GeorgIna
Ave. , and 2603 22nd St., all w~th~n the C~ty of Santa Monica; and
WHEREAS, s~xty days after sa~d order was served, the work had
not been completed by the owners or persons In possesslon of the
affected propert~es, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the Super~ntendent of Streets gave tne not~ee
requIred by Seetlon 5616 of the Streets and Highways Code; and
WHBREAS, the t of Streets dId f~le w~th the C~ty
Superlntendent

DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. rhat the report of the Superintendent of Streets
heretofore f~led and above-descr~bed be and the same 15 hereby
confIrmed.
SEC'rION 2. That all protests and obJectIons of every kInd and
nature to the report of the SuperIntendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. That the cost of the repaIrs, as set forth In the
report of the SuperIntendent of Streets, shall be assessed against the
propertIes thereIn descrIbed, WhICh properties front upon the sidewalk
upon WhICh the repalrs were made.
SEC'!' ION 4. That If such assessment is not paId wIthIn the
tIme permItted by law, toe same shall constItute a specIal assessment
agaInst and lien on the propertIes therein descrIbed, In the amount
set forth In the report of the Superintendent of Streets, which lien
shall contInue untIl the assessment and all Interest thereon IS pa~d
or untIl It IS diSCharged of record.

SECTION 5. That If the assessment IS not paId WithIn the time
permitted by law, the SuperIntendent of Streets, In accordance WIth
Sect~on 5628 of the Streets and HIghways Code, shall delIver a Notice

of LIen, prepared in the manner reqUIred by Section 5626 of the
Streets and Highways Code, to the County AudItor who shall collect the
assessment together with all other taxes agaInst the property.
