SUBJECT: ResolutIon SettIng a PublIC HearIng for July 23, 1985,
on the Assessment of Costs to RepaIr Damaged
SIdewalks, DrIveways, and Curbs on VarIOUS Streets

IntroductIon
ThlS report requests the CIty CouncIl set a publIC hearIng for
July 23, 1985, to hear protests regardIng the worK and confIrm
the assessments of the cost to repalr damaged SIdewalks,
drIveways and curbs.
Back9round
On October 9, 1979, the CIty CouncIl approved a sldewalk repaIr
program whlcn prOVIded for property owner partIcIpatIon In the
cost of repairIng damaged SIdewalks. ResIdentIal property owner
partICIpatIon IS 50% of the cost of the repaIrs If the damage IS
related to tree roots; the Clty pays the cemalnIng 50% of the
cost of the repaIr. Property owners are assessed 100% of the
cost If the damage IS not related to tree roots and commerCIal
property owners are assessed 100% of the eost regardless of the
cause of the damage.
CertaIn repaIr work has been completed at the followIng addresses
and the property owners. share of the eosts IS now due for the
folloWIng propertIes: 1531 GeorgIna, 1029 2nd, 1012 2nd, 305
Palisades, 2603 22.nd, 2323 La Mesa, 1419 10th, 1701 CalIfornIa,
1730 CalIfornIa, and 1U25 PIne. A publIC hearIng must be held

It 15 recommended the CIty Councll adopt the attached Resolutlon
settlng a pub11C nearlng for July 23, 1985, on the assessment of
costs of the SUbJect sldewalk repaIrs.

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOwS:
SECTION l. 1'nat the Superintendent of Streets wIll
f~le a report of repaIr pursuant to SectIon 5617 of the Streets
and Hlgh\vays Code of the State of CalIfornIa, relating to the
constructIon of certa~n Improvements to sIdewalks and drlveviays
at 1531 GeorgIna, 1029 2nd, 1012 2nd, 3u5 Pallsades, 2603 22nd,
2323 La Hesa, 1419 10th, 1701 Callforn~a, 1730 CalIfornIa, and
lU25 Plne, all WIthIn tne CIty of Santa MonIca.
SECTION 2. That pursuant t~ SectIon 5600 et seq. of sala
code, the CIty CounCIL does hereby order and declare that on the
23th day of July, 1985, at 7:30 P.l1., In the CouncIL Chambers of
tne C~ty Hall, It wlll hear and pass upon the report by tne
Superlntendent of Streets of the cost of repalr, together wlth
any obJectIons or protests, If any, whl.ch may be raIsed by any
property owner l~able to be assessed for the cost of SUCh repaIr
and any other Interested persons.
SECTION 3. That all protests or obJect~ons must be In
wrItIng and flIed wIth the CIty Clerk on or before the tlIDe set
for hearl.ng of protests and ObJectIons.

d~rected to ma~l not~ces, ~n tne manner and form prescrlbed by
law, of the cost of repair and of the adoptlon of thlS Resolut~on
to all persons ownlng real property affected by the sidewalk
assessment repa~r proS/ram, wnose names and addresses appear on
the last equallzed assessment roll for the C1ty taxes or as known
to the CIty ClerK.
SECTION 5. The City Clerk shall certlfy to the adoptlng
of thlS Resolut10n and thenceforth and thereafter the same shall
be 1n full force and effec t.
SEc'rION 6. Tne CIty Clerk shall certify to the adoption
of thiS Resolut10n and thenceforth and thereafter the same shall
