IntroductIon
Th1.s report requests the Clty CounCIl hold a public hearlng for the
assessment of costs to repalr damaged sidewalks, driveways and curbs
at var1.OUS areas w1.th1.n the City. It is recommended that Councll
adopt the attached Resolutlon confirming the assessment of costs.
Background
On June 11, 1985, the CIty CouncIl set a public hearing for July 9,
1985, on the assessment of costs to repair damaged Sidewalks,
drlveways and curbs wlthln the C1.ty of Santa M.onica. Letters were
mailed ten days In advance (June 28, 1985) to property owners
Inform1.ng them of the publIC hearIng In accordance with the legal

requlrements of Chapter 22 of the Improvement Act of 1911.
Budget/Flnanclal Impact
ThlS assessment dlstrlct WIll generate revenues to the Clty over the
next two years In the amount of $4,737.50. (Any unpaid assessments
wl11 be placed on the 1986 property tax blll.)

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORI'-1ED UNDER PROVISIONS OF DIVISION 7 ,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-85-66)
Pursuant to the provIsIons of D1VISI0n 7, Chapter 22, Sect lOPS
5600 of 5630 I of the Streets arid Highways Code of the State of
California, the fOlloWL''1g work was caused to be done by the Street
Superl'1tendent:
The removal and replacement of 14 lineal feet of PC cop crete
curb at $10 per lineal foot; and
The removal and replacemert of 490 square feet of PC concrete
on sidewalks at $4 per square foot; and
The removal and replacemert of 246 squ ar e feet of PC concrete
on driveways at $5 per square foot; and
The removal aDd replacemer.t of 6 llneal feet of PC concrete
curbs at $12 per llr.eal foot.
The total cost of the above work was $3,402.00
The tot al proposed assesment for the above Sidewalk and curb
d am age IS $1,701.00 or 50 percent of the total cost. The other 50
percent of the cost IS belrg paid by the City as the above repaIrs
were caused by tree root damage.
The removal aDd replacement of 50 lIneal feet of PC concrete
curb at $10 per lineal foot; and
The removal aDd replacement of 25 square feet of PC concrete
on Sidewalks at $4 per square foot; and
The removal aDd replacement of 482.5 square feet of PC
concrete on drIveways at $5 per square foot; and

The removal of 12 lineal feet of PC concrete curbs at $2 per
Ilneal foot.
The total proposed assessment for s~dewalks and curbs is
$3,036.50c or 100 percent of the total cost as tne damage was not
related to tree roots.

the real property In front of wnich the work has been done, the
proposed assessment agalnst each property, and a descrlptlon of the
work done 1n front of each property.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEwAYS AND CURBS {SR-85-66}
WHEREAS, the Street Superintendent of the C1ty of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and Highways
Code, commenced proceedIngs to cause the repa1r of damaged sidewalks,
driveways and curbs in the City of Santa Monica at 478 24th St., 256
24th St., 1205 Pine, 504 24th St., 1826 California, 604 24th St., 1811
California, 250 25th St., 209 25th St., 201 25th St., 715 24th St.,
and 1736 Franklln St.
WHEREAS, Slxty days after sa1d order was served, the work had
not been completed by the owners or persons 1n possess1on of the
affected propert1es, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the Superlntendent of Streets gave the notice
requlred by Sectlon 5616 of the Streets and Hlghways Code; and
,
WHEREAS, the Superlntendent of Streets dld fl1e wlth the City
Councll of the Clty of Santa Monlca hlS report of repa1rs and cos t as
requlred by Sectlon 5617 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fIxed for hearlng by Reso1ut1on
Number 7030 (CCS), the Clty Councl1 of the Clty of Santa Monlca heard
and passed upon the report of the Superlntendent of Streets together
with all Ob)ectlons and protests as requlred by SectIon 5618 of the
Streets and Highways Code;

NO~, 'fHEREFORE, 'rHE CIry COONCIL OF 'rriE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOwS:
SECTION l. The report of the Super1.ntendent of Streets
heretofore filed and above-descr1.bed be and the same is hereby
confirmed.
SECTION 2. All protests and Ob]ect1ons of every kind and
nature to the report of the Super1ntendent of Streets be and the same
are hereby overruled and denied.
seCTION 3. The cost of the repa1rs, as set forth in the
report of the Superintendent of Streets, shall be assessed agalnst the
propertles therein descr1.bed, WhlCh propertles front upon the sldewalk
upon WhlCh the repairs were made.
SECTIO~ 4. If such assessment lS not pald wIthin the tlme
permltted by law, the same shall constItute a spec1al assessment
aga1nst and llen on the propertIes therein descrlbed, 1n the amount
set forth in the report of the Super1ntendent of Streets, WhlCh llen
shall contlnue untll the assessment and all interest thereon is paid
or unt1l It 1S dlschar~d of record.
SECTION 5. If the assessment is not pald within the time
perm1tted by law, the Superlntendent of Streets, in accordance with
Section 5628 of the Streets and Hlghways Code, shall deliver a Notlce
of Lien, prepared ln the manner required by Section 5626 of the
Streets and Hlghways Code, to the County Auditor who shall collect the
assessment together wlth all other taxes agalnst the property.

SECTION 6. rhe CIty Clerk shall certify to the adoptl.on of
thlS resolutlon and thenceforth and thereafter the same shall be in
full force and effect.
