Introduct~on
ThIS report requests that the C1ty Councll hold a publlC hearlng for
tne assessment of costs to repalr damaged sidewalks, drlveways and
curbs on Robson AvenUe. It lS recommended that Council adopt the
attacned Resolutlon conflrffilng the assessment of costs.
Background
On June 25, 1985, the C1ty CouncIl set a publlC hearing for July 23,
1985, for the assessment of costs to repa1r damaged s1.dewalks,
drlveways and curbs on Robson Avenue ln the C1ty of Santa Monlca.
Letters were maIled 1n advance (July 12, 1985) to property owners
lnformlng them of the publlC hearlng In accordance wIth the legal
requlrements of Cnapter 22 of the Improvement Act of 1911.
Staff llIet wIth Mr. Charles Walker, a tenant on Robson Avenue who
I presented hImself as an attorney representIng one property owner and

all of the resldents on propert~es frontIng the repalred areas.

I Mr. Walker said the ma~n area of concern was that concrete pavement
has been removed from some parkway areas resultlng in lncreased
malntenance needs such as grass cuttIng and water~ng. It was also
Mr. Walker's opInIon that partlal removal of the pavement was
unattractlve. Staff offered to remove al'.l of the remaInIng pavement

from the parkways at no cost to the property owners. Mr. Walker
saId he would meet wIth the Interested partIes to reach a consen-
sus a~d ~wuld contact staff If necessary.
The C1ty staff removed damaged sIdewalk and parkway area concrete
and replaced only the sIdewalk, planting the parkways in confor-
mance w1th the past practice of at least 20 years whereby park-
ways in resIdential areas are requIred to be landscaped except
for entry walks and drIveways. In commercIal areas, parkways are
commonly paved. The subJect area IS a sIngle fam1ly resIdential
area. Only the paved parkways WhiCh were damaged were removed.
Budget/Financial Impact
ThIS assessment dIstrict will generate revenues to the CIty over
the next two years In the amount of $2,552.50 (Any unpaid as-
sessments WIll be placed on the 1986 property tax bill).
Recommendation
It IS recommended the City CounCIl:
1 . Open the publiC hearing;
2. Close the publiC hearing and aCknowledge any protests; and
3 . Adopt the attached Resolut1on confirming the assessments.

CHAPTER 22, SECTIONS 5600 TO 5630, OF THE srREETS AND HIGHWAYS
CODE OF THE STArE OF CALIFORNIA (8R-85-65)
Pursuant to tne provIsIons of DIvIslon 7, Chapter 22, See tlons
5600 of 5630, of the Streets and Hlghways Code of the State of
Cal1.fornla, the folloWIng work was caused to be done by the Street
SuperIntendent:
The removal and replacement of 75 square feet of drlveway at
$ 5 per square foot;
The removal and replacement of 12 lIneal feet of PC concrete
curb at ~lO per llneal foot;
The removal and replacement of 876 square feet of PC concrete
on sIdewalks at $4 per square foot; and
The removal of 763 l1.neal feet of PC concrete parkway at $2
per square foot.
The total cost of the above work was $5,105.00
The total proposed assesment for the above sIdewalk and curb
damage IS $2,552.50 or 50 percent of the total cost. The other 50
percent of the cost IS belng paId by the Clty as the above repaIrs
were caused by tree root damage.

WHEREAS, the Street SuperIntendent of the CIty of Santa
Mon1.ca, pursuant to Sectlon 5600 to 5630 of the Streets and H~ghways
Code, commenced proceed1.ngs to cause the repalr of damaged sidewalks,

WHEREAS, S1.xty days after sald order was served, the work had

to be done; and

required by Sectlon 5616 of the Streets and Highways Code; and

nature to the report of the Superlntendent of Streets be and the same
are hereby overruled and den1ed.
SECTION 3. That the cost of tne repaIrs, as set forth in the
report of the SuperIntendent of Streets, shall be assessed agaInst the
propertIes thereln descr1bed, whlch propertIes front upon tne sIdewalk
upon WhlCh the repalrs were made.
SEC1'ION 4. That If such assessment 1S not paid wlthln the
t1ffie permitted by law, the same shall constItute a speclal assessment
agaInst and llen on the propert1es thereIn descr1bed( 1n the amount

Dear Mayor:
As residents of Robson Avenue (we s t ) 1.n Santa Mon1.ea,
we.protest the way the C1.ty has dec1.ded to redo the parkway
in front of our homes. The roots of the trees l1.n1.ng our
street had grown to the p01.nt that they pushed up most of
the surround1.ng pavement. It was our understand1.ng that the
City had agreed to come 1.n, take out the concrete, cut and
remove the tree roots, then replace the cement. Instead,
the cons tractor has removed the parkway and the C1.ty 1.5
fill1.ng 1.t 1.n w1.th d1.rt. It 1.S grossly unfa1.r to make home-
owners pay for the C1.ty's neglectfulness. Had the trees been
pruned regularly, the roots would not have grown large enough
to cause r1.fts l.n the pavement, thus alleviat1.ng the need to
have the street repa1.red l.n the first place.
We do not want these ~neve~ tracts of d1.rt for walkways.
Ne1.ther do we want lawn planted there, becom1.ng a burden to
ma1.11ta1.n. We s1.mply want the parkway restored to 1.ts prev1.ous
state; namely, that of a paved s1.dewalk. We submlt thls letter
and pet1.t1.on of protest, and request that the concrete be
replaced as stated l.n the letter sent. (Copy attached.) Your "
prompt attent1.on to th1.s matter w1.ll be greatly appreclated.

You are hereby notified :hat you must:
Remove and replace 61 square feet of PC concrete sidewalk;
Remove and replace square feet of PC concrete sidewalk in the
.. driveway area;
Remove and replace square feet of PC concrete driveway apron;
Remove and replace t l I ineal feet of PC concrete curbing; and
Remove ~1 square eet of PC concrete in the parkway area ~
on the property Jocated at 1730 Robson {lot413 Slock
Trllct_ 9831 } as the sidewalk is in such a condition that it
~ay endanger persons using these facilities. The City's estimated cost for this work
is $ 546.00 .
In lieu of the Ciey doing this work, you may do the work yourself or use a private
contractor to do the work.
These reDair~ must be made in accordance with Santa Monica Standard Specification
No. 204 for Construction of Curbs, Sidewalks & Driveways and Plan No. 1J22. Copies
are available at the Santa Monica City Hall. Department of General Services.
If within four weeks after receipt of this notice you have not commenced and are not
preeeeding with diligence and without interruption to complete such repairs, tne City
wilt have no alternative but to undertake such repair work.
In the event the City makes the repairs. the cost will be assessed to you and may
become a lien on your property.
You wilt be receiving a packet of Infonnation further describing your rights and
responsibilities. This notice is given In accordance with the provisions of Sections
561' and 5614, Inclusive or the Streets and Highways Code of the State of California.
