IntroductIon
'rhIS report requests the City Councl.l hold a publIC hearing for the
assessment of costs to repaIr damaged sIdewalks, drl.veways and curbs
at varIOUS areas w1thin the C1ty. It 1S recommended tnat CouncIl
adopt the attached Resolutlon conflrming the assessment of costs.
Background
On October 1, 1985, toe C1.ty CouncIl set a PUblIC hearlng for October
22, 191:35, on the assessment of costs to repal.r damaged sIdewalks,
driveways and curbs wIthIn tne CIty of Santa Monlea. Letters were
maIled ten days 1.n advance (October 11, 1985) to property owners
lnformlng them of the publlC hearlng in accordance wlth the legal
requ1rements of Chapter 22 of the Improvement Act of 1911.

ThIS assessment dIstrIct WIll generate revenues to the CIty over the
next two years ln the amount of ~3,421.60. (Any unpa1.d assessments
w1.11 be placed on the 1986 property tax blll.)

REPAIR OF DAMAGED SIDEYlALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCrrONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHwAYS
CODE OF THE S'rAT E OF CALI FORN IA (SR-85-72)
Pursuant to the provlslons of D1VISIon 7, Chapter: 22, Sectlons
5600 of 5630, of the Streets and Highways Code of the State of
Callforn1a, the followIng work was caused to be done by the Street
Super In tendent:
Tne removal and replacement of 9 lIneal feet of curbIng at
$12 per l~neal foot;
The removal and replacement of 749.80 square feet of sldewalk
at $4 per lIneal footi
rhe removal and replacement of 21 square feet of PC concrete
$2 per Ilneal footi
The removal of 132 square feet of s~dewalk at $3 per square
foot; and
The total cost of the above work was $3,545.20
The total proposed assesment for tne above sidewalk and curb
damage IS $1,772.60 or 50 percent of the total cost. The other 50
percent of the cost IS belng paId by the CIty as the above repairs
were caused by tree root damage.
The removal and replacement of 11 llneal feet of curbIng at
$10 per Ilneal foot;
The removal and replacement of 384.75 square feet of
sldewalKs at $4 per square foot.
Tne total proposed assessment for sldewalKs and curbs 15
1,649.00 or 100 percent of the total cost as the damage was not
related to tree roots.

the real property In front of wnIch the worK has been done, the

I object to paYing any part of the cost of the sidewalk rep~lr
in front of my residence.
Such charge is unfair for the following reasonsl
1. rhe sidewalk was damaged by the roots of a magnolia tree.
This tree was planted by the City in a five-foot wide park-
way. The City had to have known that this was not nearly
enough space for a tree with this root structure.

2. The was planted on property owned by the City which also
owns the sidewalk that was damaged.
J. I pay a plumber two or three times a year to keep my sewer
connection free of this tree's roots. This service has been
necessary for many years. The present cost is $35 per call.
The plumber informs me that the roots extend a.ll the way to
the sewer.
4. I have owned my residence in Santa Monica since 1956.
During that time the City has made similar repairs 'Without
charge to the property owner. I believe that I am entitled
to the same treatment.

MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEwALKS,
DRIVEWAYS AND CURBS (SR-BS-72)
WHEREAS, the Street Super1ntendent of the City of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged sidewalks,
dr1veways and curbs in the City of Santa Monica at I054-60 14th
Street, 2914 washington Avenue, 1109 20th Street, 2221 Montana Avenue,
1111 2nd Street, 2502 Arizona Avenue, 136 Esparta Way, 150 Esparta
Way, 2601-2615 Arizona Avenue, 2209 Montana Avenue, 1115 20th Street,
1121 20th Street, 1127 20th Street, 1424 Broadway, 1344 4th Street,
all wLthln the CIty of Santa Monica; and
WHEREAS, sixty days after said order was served, the work nad
not been completed by the owners or persons ln possessIon of the
affected propertles, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the SuperIntendent of Streets gave the notice
required by Section 5616 of the Streets and HIghways Code; and

WHEREAS, the Superlntendent of Streets did f11e wltn the CIty
CounCIl of the Clty of Santa Monlca hIS report of repalrs and cost as
requIred by Sectlon 5617 of the Streets and H1ghways Code; and
wHEREAS, upon the day and hour flxed for hearing by Resolutlon
Number 7095 (CCS) , the CIty CounCIl of the CIty of Santa Monica heard
and passed upon the report of the SuperIntendent of Streets together
wlth all Ob]ectlons and protests as requlred by Sect10n 5618 of the
Streets and Hlghways Code;

NOW, 'rHEREFORE, THE CITY COUclCIL OF THE ClrY OF SANl'A MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. rhe report of the Superintendent of Streets
heretofore flIed and above-described be and the same lS nereby
conflrmed.
SECTION 2. All protests and Ob]ectlons of every klnd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and den1ed.
SECI'ION 3. The cost of the repairs, as set forth in the
report of the SuperIntendent of Streets, snaIl be assessed aga1nst the
propertIes thereln descrlbed, WhlCh properties front upon the SIdewalk
upon which the repa1rs were made.
SECTION 4. If such assessment is not paid WIthIn the tIme
permitted by law, the same shall constItute a special assessment
agalnst and lIen on the proper t1E~S therein descrIbed, in the amount
set forth 1n the report of the SuperIntendent of Streets, WhiCh lIen
Shall contlnue untll tne assessment and all interest thereon 1S pal.d
or untll it is d1seharged of record.
- SECTION 5. If the assessment l.S not pa1d wlthl.n the tIme

permitted by law, the Superintendent of Streets, In accordance wlth
Section 5628 of the Streets and HIghways Code, shall deliver a Not1ce
of Llen, prepared in the manner reqUired by Section 5626 of the
Streets and Hlghways Code, to the County Aud1tor wno shall collect the
assessment together w1th a11 other taxes against the property.

SEC'fION 6. The Clty Clerk shall certify to the adoptlon of
this resolution and thenceforth and tnereafter the same shall be in
full force and effect.
