Introduct1.on
Thl.s report requests the Cl.ty Councl.l hold a public hearl.ng for the
assessment of costs to repaIr damaged sIdewalks, driveways and curbs
at varIOUS areas wlthln the CIty. It is recommended that Council
adopt the attached Resolutlon confIrmIng the assessment of costs.
Background
On January 14, 1986, the CIty CouncIl set a publlC hearIng for
February 11, 1986, on the assessment of costs to repair damaged
sIdewalks, drIveways and curbs wIthin the CIty of Santa MonIca.
Letters were maIled ten days in advance (January 31, 1986) to property
owners InformIng them of the publlC hearing In accordance wlth the
legal requirements of Chapter 22 of the Improvement Act of 1911.
Budget/FInancIal Im~act
Th~ assessment dIstrIct WIll generate revenues to the City over the
next two years In the amount of $3,992.50. (Any unpaId assessments
wIll be placed on the 1987 property tax bill.)

Pursuant to Streets and Highways Code Sectlon 5616, this letter is
notlflcatlon that the Clty Council, pursuant to Resolution No. 7142
adopted on January 14, 1986, has scheduled a hearlng to hear and pass
upon the report of the Super1ntendent of Streets of the cost of the
Sidewalk repair, in connection Wlth the above-described proJect,
together wIth any obJections and protests, If any, which may be raIsed
by any property owner liable to be assessed for the cost of such
s1dewalk repair and any other interested persons.

Upon confirmation of the report of the Superlntendent of Streets, as
provided for 1n Streets and H1ghways Code Sect10n 5618, the cost of
the sldewalk repa1r wlll be assessed aga1.nst your property, and you
will be notified of the manner of payment.
The C1ty w1ll provide financial assistance for low-to-moderate income
persons. If your 1ncome 15 less than $16,150 for a farn~ly of one
person, $18,450 for two persons, $20,750 for three persons or $23,050
for four persons, call Conrado Terrazas at 458-8701 for information on

OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 560 0 'ra 5630, OF THE STREETS AND HIGHriAYS
CODE OF THE STATE OF CALIFORNIA (SR-86-75)
Pursuant to the provlslons of Dlvislon 7, Chapter 22, Sections
5600 of 5630, of the Streets and Hlghways Code of tne State of
Callfornla, the following work was caused to be done by the Street
Superintendent:
The removal and replacement of 126 lInear feet of curbIng at
$10 per lineal foot;
The removal and replacement of 630 square feet of sldewalk at
$4 per square foot;
The removal and replacement of 841 square feet of PC concrete
on dr1veways at $5 per square foot.
The total cost of the above work was $7,985.00.
The total proposed assessment for the above sldewalk and curb
I damage 1S $3,992.50 or 50 percent of the total cost. The other 50
I percent of the cost being paid by the City the above repairs

WH2REAS, the Street 3Up2rlntendent of the CIty of Santa
MonIca, pursuant to Sectlon 5600 to 5630 of the Streets and HIghways
Code, commenced proceedIn3s to cause the repaIr of damaged sidewalks,
drIveways and curbs In the CIty of Santa MonIca at 2343 32nd St., 2341
32nd St. , 2344 32nd St., 2340 32nd St. , 2418 32nd St. , 2432 32nd St.,
2411 32nd St., 2401 32nd St., 2419 32nd St., 3129 Pearl St. , 2435 32nd
St. , 2404 32nd St. , 2508 32nd St. , 2423 32nd St. , 2648 32nd St. , and
2336 32nd St., all WIthIn the CIty of Santa MOD1ca.
WHEREAS, SIxty days after sa1d order was served, the work had
not been completed by the owners or persons 10 posseSSion of the
affected propertles, and the SuperIntendent of Streets caused the work
to be done; and
WHERBAS, the SuperIntendent of Streets gave the notice
requIred by Section 5616 of the Streets and Highways Code; and
WHEREAS, the SuperIntendent of Streets dId fIle WIth the CIty
Councll or t3e Clty of Santa Monlca hIS report of repaIrs and cost as
requlred by SectIon 5617 of the Streets and HIghways Code; and
WHEREAS, upon the day and hour f~xed for hearIng by ResolutIon
~Ju.llbe r 7142 (CCS) , the Cl.ty CouncIl of the CIty of San ta 1.1onlca heard
and passed upon the report of the Superintendent of Streets together
WIth all oOJectIons and protests as reqUIred by SectIon 5618 of the
Streets and HIghways Code;

SECTION l. The report of the Superlntendent of Streets
heretofore flIed and above-descrlbed be and the same 15 hereby
confl.rmed.
SECTION 2. All protests and Ob)ectlons of every klnd and
nature to the report of the Superlntendent of Streets be and the same
are hereby overruled and denl.ed.
SECTION 3. The cost of the repalrs, as set forth 1n the
report of the Super1ntendent of Streets, shall be assessed against the
propert1es tnereln described, which properties front upon the sldewalk
upon Wh1Ch the repa1rs were made.
SECTION 4. If such assessment 1S not pald wlthln the tune
perm1tt:.ed by law, the same shall const1tute a special assessment
aga1nst and llen on the propert1es there1n descrlbed, l.n the amount
set forth ln the report of the Superlntendent of Streets, WhlCh ll.en
snaIl contlnue unt1l the assessment and all lnterest thereon 15 pald
or unt1l 1t 13 d1scharged of record.
SECTION 5. If the assessment 1S not paid Wl.thln the tlme
peoutted by law, the Superlntendent of Streets, ln accordance with
S,,=ctlon 5623 of tne Streets and Hlghways Code, shall deliver a Notlce
of L:ten, prepared 1n the manner requlred by Sect10n 5626 of the
Streets and Hlghways Code, to the County Audltor who shall collect the
assessment together witn all other taxes against the property.
