ThIS report requests the C1ty Council hold a publIC hearIng for the
assessment of costs to repaIr damaged sldewalks, dr1veways and curbs
at varlOUS areas wlthln the City. It IS recommended that Council
adopt the attached Resolutlon confIrm1ng the assessment of costs.

On January 28, 1986, the CIty Councl.l set a publIC hearlng for
February 25, 1986, on the assessment of costs to repaIr damaged
sldewalks, drlveways and curbs WIthin the Clty of Santa MonIca.
Letters were malled ten days 1n advance (February 14, 1986) to
property owners informlng them of the publlC hearlng 1n accordance
w1.th the legal requlrements of Chapter 22 of the Improvement Act of
1911.
Budget/F1.nanc~al ,Impact
Th1.s assessment distrIct WIll generate revenues to the City over the
next two years In the amount of $3,300.00. (Any unpaid assessments
wlII be placed on the 1987 property tax b~ll.)

REPAIR OF DAMAGED SIDEWALKS, DRI VE~iAYS , CURBS AND/OR REMOVAL
OF OBS'rRUC'rIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAP'fER 22, SECTIONS 560 0 '1'0 563 0 , OF THE STREETS AND riIGHWAYS
CODE OF 'fHE STATE OF CALIFORNIA (SR-86-76)
Pursuant to the provislons of D1V1S1on 7, Chapter 22, Sect10ns
5600 of 5630, of the Streets and Hlghways Code of the State of
Cal1forn1a, the follow1ng work was caused to be done by the Street
Superlntendent:
The removal and replacement of 70 l1near feet of curb1ng at
$10 per I1near foot;
The removal and replacement of 735 square feet of sidewalk at
$4 per square foot;
The removal and replacement of 495 square feet of PC concrete
on driveways at $5 per square foot.
The removal of 2 square feet of concrete at $2 per square
foot.
The total cost of the above work was $6,241.00.
The total proposed assessment for the above sidewalk and curb
damage IS $3,120.50 or 50 percent of the total cost. The other 50
percent of the cost 1S be1ng pald by the Clty as the above repaIrs
were caused by tree root damage.
The removal and replacement of 12 llnear feet of PC concrete
curb at $10 per Ilneal foot; and
The removal of 29.75 square feet of concrete at $2 per square
foot.
The total proposed assessment for sidewalks and curbs 1S
$179.50 or 100 percent of the total cost as tne damage was not related
to tree roots.

the real property 1n front of Wh1Ch the work has been done, the
proposed assessment~,nst each property, a'a descriptlon of the

MONICA CONFIRMING rHE REPORT OF THE SOPERINrENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEdALKS,
DRIVEWAYS AND CURBS (SR-86-76)
WHEREAS, the Street Superintendent of the CIty of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and HIghways
Code, commenced proceedIngs to cause the repa1r of damaged sldewalks,
drlveways and curbs in the CIty of Santa Monica at 2522 32nd St., 2516
32nd St., 2629 32nd St., 2632 32nd St., 2667 32nd St., 2637 32 nd St.,
2528 32nd St., 2316 32nd St., 2324 32nd St., 2313 32nd St., 2320 32nd
St. , 2307 32no St., 2269 32nd St. , 2332 33nd St., 2329 32nd St., and
2333 32nd Street, all w1thlO tne CIty of Santa Monlca.
WHEREAS, Slxty days after sald order was served, the work had
not been completed by tne owners or persons 1n possesslon of the
affected propertles, and the Superlntendent of Streets caused the work
to be done; and
WHEREAS, the 3uperl.ntendent of Streets gave the notlce
requlred by Sectlon 5616 of the Streets and HIghways Code; and

Councl.1 of the CIty of Santa Monlca hl.s report of repaIrs and cost as
required by Section 5617 of the Streets and Hl.ghways COde; and

DOES RESOLVE AS FOLLOwS:
SEc'r ION l. The report of the SuperIntendent of Streets
heretofore flIed and above-descrIbed be and the same IS hereby
confIrmed.
SECTION 2. All protests and obJectIons of every kind and
nature to the report of the Superl.ntendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. The cost of the repaIrs, as set forth In the
report of the SuperIntendent of Streets, shall be assessed against the
properties thereIn descrIbed, WhICh propertles front upon the sldewalk
upon WhICh the repaIrs were made.
SECTION 4. If such assessment IS not paId WIthIn the tIme
permItted by law, the same shall constitute a specIal assessment
agaInst and lIen on the propertIes thereIn descrIbed, In the amount
set forth in the report of tne SuperIntendent of Streets, Wh1Ch lIen
shall contInue unt1l the assessment and all lnterest thereon 1S paId
or untIl It 15 dlscnarged of record.
SECrION 5. If the assessment is not paId WIthIn the tl.me
permItted by law, the SuperIntendent of Streets, In accordance with
SectIon 5628 of the Streets and HIghways Code, shall deliver a NotIce
of L1en, prepared 1n the manner required by SectIon 5626 of the
Streets and HIghways Code, to the County Aud1tor who shall collect the
assessment together w1th all other taxes agaInst the property.
