assessment of costs to repaIr damaged sIdewalks, drIveways and curbs
at varIOUS areas WIthIn the CIty. It IS recommended that Councll
adopt the attached ResolutIor confIrmIng the assessment of costs.

lnformlPg them of the pUblic hearIng In accordance WIth the legal
reqUIrements of Chapter 22 of the Improvement Act of 1911.

ThIS assessmer:t dIstrIct WIll generate revenues to the CIty over the
r..ext two years In the amount of $1,939.50. Any unpaid assessments
WIll be placed on the 1987 property tax bIll.

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA CSR-86-86)
Pursuant to the provlslons of Dlv1slon 7, Chapter 22, Sectlons
5600 of 5630, of the Streets and Hlghways Code of the State of
Callfornla, the followlng work was caused to be done by the Street
Super1ntendent:
The removal and replacement of 728 square feet of sldewalk
at $4 per lineal foot;
The removal and replacement of 219 square feet of s1dewalk at
$ 3 per l1neal foot;
The removal and replacement of 15 square feet of drlveway at
$4 per square foot.
The removal of 25 square feet of PC concrete at $2 per 11r-eal
foot;
The total cost of the above work was $3,679.00.
The total proposed assessment for the above sldewalk and curb
damage 1S $1,839.50 or 50 percent of the total cost. The other 50
percet!t of the cost 1S belng pa1d by the C1ty as the above repalrs
were caused by tree root damage.
The removal and replacement of 25 square feet of sldewalk at
$4 per l1neal foot.
The total proposed assessmer>t for s1dewalks and curbs 1S
$100.00 or 100 percent of the total cost as the damage was not related
to tree roots.

the real property 1n front of whlch the work has been done, the

I own residentlal, rental property located at 1318 Broadway, Santa Monica
WhlCh is under rent control. Sldewalk repair ln front of the above pro-
perty. along Broadway. was performed by the City and the General Services
Department of Santa Mon~ca w1ll be billing me shortly for $328.50 if Re-
Solutlon No. 7260 1S passed.
On August 21. I called the Santa Monica Rent Control Office to see if
there are provisions for pass-through of this cost on to the three ten-
ants who 11ve on the above property. Per the Rent Control Office there
are no such provls1ons. but there are provls1ons for pass-through of street
lightlug lmprovements, Speclal School Dlstrict Tax Surcharge, etc.
I petition the Santa Monica C1ty Council to drop the proposed sidewalk
repalr cost agalust the above property or for the Clty Councll to lustruct
the Santa Xonica Rent Control Board to allow pass-through of the sldewalk
repalr cost on to each tenant (1/3 of total cost) at $9.12 per month for
one year wlthout havlng to go through the tremendous paperwork and hear-
lUg process. Wlthout pass-through of the above proposed sidewalk repa1r
cost, lt would be conflscatory. It would be easier for the Rent Control
Board and tenants if the repalr cost was dropped by the Clty Councll.

MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-86)
WHEREAS, the Street SuperIntendent of the CIty of Sar.ta
Monica, pursuant to Sect ion 5600 to 5630 of the Streets and HIghways
Code, commenced proceedIngs to cause the repair of damaged sldewalks,
driveways and curbs In the City of San t a Monica at 3117 5th Street,
910 10th Street, 2469 HIll Street, 1024 Centlnela Avenue, 1030
Centlnela Avenue, 960 10th Street, 1318 Broadway Avenue, 855 10th
Street, 841 10th Street, 1421 & 1423 5th Street, and 1417 6th Street,
all withIn the Clty of Santa MoniC'a.
WHEREAS, sixty days after saId order was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notIce
requIred by Section 5616 of the Streets apd HIghways Code; and
WHEREAS, the SuperIntendent of Streets dId file with the CIty
CouncIl of the City of Santa Monica hIS report of repairs and cost as
required by SectIon 5617 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fIxed for hearing by Resolutior.
Number 7260 (CCS), the CIty CouncIl of the City of Santa Monlca heard
and passed upon the report of the SuperIntendent of Streets together

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The report of the Superintendent of Streets
heretofore filed and above-descrIbed be and the same IS hereby
confIrmed.
SECTION 2. All protests and obJectIons of every kind and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denIed.
SECTION 3. The cost of the repa1rs, as set forth ir. the
report of the SuperIntendent of Streets, shall be assessed agaInst the
propertIes thereIn descrIbed, WhICh propertIes front upon the SIdewalk
upon which the repaIrs were made.
SECTION 4. If such assessmer.t is r,ot paId WIthin the tIme
permitted by law, the same shall constItute a speCIal assessmef't
against and lIen on the propertIes thereIn described, In the amount
set forth in the report of the SuperIntendent of Streets, WhICh lien
shall C'ontinue until the assessment and all Interest thereon IS paId
or until it IS dIscharged of record.
SECTION 5. If the assessment IS not paId WIthIn the tIme
permItted by 15\., , the Superintendent of Streets, In accordance WIth
SectIon 5628 of the Streets and Highways Code, shall delIver a Notice
of Lien, prepared in the manner required by Section 5626 of the

STREET SUPERINTENDENT'S REPORT
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-86-85)
Pursuant to the prOVISIons of DIVISIon 7, Chapter 22, SectIons
5600 of 5630, of the Streets and HIghways Code of the State of
CalIforrla, the f.ollowlng work was caused to be done by the Street
SuperIt!.tendent:
The removal and replacement of 1609 square feet of SIdewalk
at $4 per lHeal foot;
The removal and replacement of 59 square feet of driveway at
$5 per square foot.
The removal a~d replacement of 50 square feet .of curbing at
$10 per lIneal footi
The removal of 38 square feet of PC concrete at $2 per lIneal
footi
The total cost of the above work was $7,307.00.
The t0tal proposed assessment for the ab0ve SIdewalk apd curb
damage IS $3,653.50 or 50 percent of the total ('ost. The other 50
percent uf the cust 1S beu:g paId by the CIty as the above repa1rs
were caused by tree root damage.
The removal and replacement of 312.75 square feet of SIdewalk
at $4 per lU"jeal foot.
The removal ard replacement of 75 square feet of drIveway at
$5 per square foot.
The total proposed assessment for sldewalks and curbs J.S
$1,626.00 or 100 percent of the total cost as the damage was not
related to tree roots.

DOES RESOLVE AS FOLLOWS:
SECTION 1- The rep0rt of the SuperIntendent of Streets
heretofore filed and above-described be and the same is hereby
confIrmed.
SECTION 2. All protests ar.d obJectlOl"S of every kInd ard
nature to the report of the Superinterdert of Streets be and the same
are hereby overruled and denIed.
SECTIOH 3. The cost of the repaIrs, as set forth In the
report of the SuperIntendent of Streets, shall be assessed agaInst the
propertIes therelr described, WhICh propertIes front upon the sIdewalk
upor: WhICh the repairs were made.
SECTION 4. If such assessmer.t IS n0t paId wlthlr: the time
permitted by law, the same shall constitute a specIal assessmer:t

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7 ,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-86-84)
Pursuart to the provIsions of Division 7, Chapter 22, SectlOI"'S
5600 of 5630, of the Streets and HIghways Code of the State of
CalIfornia, the followIng work was caused to be done by the Street
SuperlnteI"'deI"'t:
The removal and replacemeI"'t of 606 square feet of sldewa'k
at $4 per lInear footi
The removal and replacement of 676 square feet of drIveway at
$5 per square foot.
The removal ar.d replacemeI"'t of 65 square feet of curbiI"'g at
$10 per llI"'eal foot;
The total cost of the above work was $6,454.00.
The total proposed assessment for the above s Idewa lk and curb
damage IS $3,227.00 or 50 percent of the total cost. The other 50
percept of the cost IS beIng paId by the CIty as the above repaIrs
were caused by tree root damage.
The removal and replacement of 190 lIneal feet of curbing at
$4 per llI"'eal foot.
The removal apd replacemert of 161 square feet of driveway at
$5 per square foot.
The removal and replacement of 14 square feet of curbing at
$10 per llneal footi
The total proposed assessmept for sldewalks apd curbs IS
$1,705.00 or 100 perceI"'t of the total cost as the damage was I"'ot
related to tree roots.

MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-84)
WHEREAS, the Street SuperIntendent of the CIty of Sarta
MarIca, pursuaf't to Section 5600 to 5630 of the Streets and HIghways
Code, commenced proceedIngs to cause the repaIr of damaged sIdewalks,
drIveways and curbs in the CIty of Santa MonIca at 2215 MarIne Street,
228 EuclId Street, 238 19th Street, 1625 Ashland Avenue, 434 14th
Street, 2504 32rd Street, 1002 Washinton Street, 404 21st Street, 1620
Ashlard Aver-ue, 1410 15th Street, ard 238 19th Street, all wIthIn the
CIty of Sapta MonIca.
WHEREAS, SIxty days after saId order was served, the work had
not beep completed by the owners or persons In possession of the
affected propertIes, ard the SuperIntendent of Streets caused the work
to be done; ard
jiHEREAS, the Superifltendent of Streets gave the notice
requIred by SectIor 5616 of the Streets afld Highways Codej and
WHEREAS, the SuperIntender.t of Streets dId fIle with the CIty
Coul"cll of the CIty of Sarta Morlca hIS report of repaIrs and cost as
requIred by Sectlor 5617 of the Streets and HIghways Code; aDd
Ti'lHEREAS, upon the day ard hour fIxed for hearIng by ResolutIon
Number 7239 eCCS), the CIty CounCIl of the CIty of Santa Monica heard
and passed uPQr the report of the Superintendept of Streets together

NOW, THEREfORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The report of the SuperIntendel"t of Streets
heretofore flied and above-descrIbed be aI"'d the same is hereby
confIrmed.
SECTION 2. All protests and ObjectIons of every kind and
nature to the report of the SuperiI"'teI"'dent of Streets be and the same
are hereby overruled and denied.
SECTION 3. The cost of the repairs, as set forth l.l"! the
report of the SuperInteI"'deI"'t of Streets, shall be assessed agaInst the
propertIes therein descrIbed, WhICh properties front upor the sidewalk
upon whIch the repaIrs were made.
SECTION J4 . If such assessment is not paid wIthiI"' the tIme
permitted by law, the same shall corstltute a speCIal assessmert
agaInst and lIen ot" the propertIes therein described, in the amount
set forth In the report of the Superintendent of Streets, which lIen
shall contInue untIl the assessrnert and all Interest thereon IS paid
or UI"'tIl It IS dIscharged of record.
SECTION 5. If the assessment IS not paId wIthl!' the tIme
permItted by law, the Superlrtendent of Streets, II" accordarce with
SectIon 5628 of the Streets apd HIghways Code, shall delIver a NotIce
of LIen, prepared In the manner requIred by SectIon 5626 of the

assessment together w1th all other taxes agaInst the property.
SECTION 6. The C1ty Clerk shall certIfy to the adoptIon of
