SUBJECT: Recommendation to Hold a Public Hearing on the
Intention to Abate Weeds and Rubbish and to Award
an Abatement Contract
Introduction
staff requests that the City Council hold a public hearing
regarding the City's intent to abate weeds and rubbish and to
award a contract to Apple Services, Inc. in the amount of $23,150
to complete work in this year's abatement program.
Background
January 26, 1988, the city council adopted Resolution Number 7546
declaring weeds and rubbish accumulating on certain City lots a
public nuisance, identifying lots to be included in this year's
weed and rubbish abatement program, and setting a public hearing
for March 22, 1988, at which time protests regarding the planned
program would be heard.
The list of lots requiring clearing
which was presented at the January 26th Council Meeting is
attached.
Following this meeting lots were posted for weed
and/or rubbish abatement. At the March 8, 1988 Council meeting,
the March 22, 1988 Council meeting was rescheduled for March 29,
1988.
The lots subsequently were reposted fallowing this
decision.

The City of Santa Monica's annual weed abatement program operates
in accordance with the California Government Code Chapter 13,
Sections 29500 to 39588, Title 4.
The awarded contract will
cover costs of cleaning those lots not cleaned by property owners
following posting as well as abatement costs for lots which later
develop weed and/or rubbish accumulations.
An administrative
charge of $25 per lot covers costs such as inspection, supplies,
and clerical time. The city is reimbursed for both contractual
and administrative program costs incurred on private property
through property assessments.
A Notice Inviting Bids was published February 12, 13 and 15, 1988
in the Evening Outlook. Bid proposals were prepared and mailed
to four contractors. One bid was received and opened publicly on
March 7, 1988, at 3:00 p.m. by the Acting City Clerk. The bid
was as follows:
Apple Services, Inc.
(dba Apple's Tractor service)
$23,150
This contractor was awarded last year's weed and rubbish
abatement contract and completed required work satisfactorily.
The contractor also qualifies as a women and minority business
enterprise.
BUdget/Financial Impact
Appropriated funds are available at Maintenance Management
account number 01-500-481-000-642
in the maximum amount of
$37,425. Revenues received as reimbursement of City costs will

accrue in FY 198B-B9 since property assessments will be included
in the December 19BB and April 1989 tax bills.
Recommendations
It is recommended that the city council:
1. Open the public hearing;
2. Close the public hearing;
3. Acknowledge protests and award the weed and rubbish abatement
contract to Apple's Services, Inc. in the amount of $23,150:
4. Authorize the city Engineer to negotiate and authorize and
necessary change orders to complete additional work in
accordance with the City's Administrative Instructions.
