Background City staff complies with Chapter 22 of the Improvement Act of 1911 when assessing property owners for sidewalk repairs. The Ci ty is divided into 12 sectionst one of which is inspected each month. The Inspector notes any c r ac k s or substandard features in sidewalkst driveways~ curbs or parkways. A photograph is taken of that portion requiring repairs. The Inspector then prepares a packet of materials including the Notice to Repair which is sent to the property owner by certified ma il . The property owner is given the option of doing the corrective wo rk . If no action is taken by the owner, repairs are made by City forces or by a contractor hired by the City and assessment procedures are begun. A public hearing is set by Council and notices are mailed by first-class ma 11 informing property owners of the public hearing. The public hearing is then held by the City Council a t wh i c h t i m e all protests are heard. The Council then confirms the assessments and the property owners are billed. In the case of Mr. Sarrow, 1315-1317 Franklin, the staff has reviewed the case and because of technical problems with the notice, recommends no assessment to Mr. Sarrow. A lawn sprinkler pipe was broken during the repair of the sldewalk. This is a common occurrence in sidewalk repairs as many of the sprinkler systems are very old. The systems run adjacent to the sidewalk and when the form is put into place the pipe has to be moved 51 ightly. The crew repaired the line, but was not informed that the repair was not satisfactory and therefore did not return to make the necessary repairs. Recommendation It is reco~mended that City Council: 1 ) Hold the continued public hearing; 2 ) Close the public hearing and affirm Mr. Sarrow'5 protest; 3) Overrul e all other protests; and 4) Adopt the resolution confirming the assessments with the exception of 1315-1317 Franklin. (See Attachment A). Delivery was attempted May 29. 1981. and June 3, 1981. but the letter was unclaimed and returned to the City. Photographs of the area indicate that the repairs were indeed necessary. (See Attachment B. The actual photographs wil 1 be available at the Council meeting.) Guidelines established by the City Attorney's office state that displ acements of 1/4" or more must be repa1red. At the two addresses, Mr. Sarrow was cited to repair 100 square feet of sldewalk, 186 square feet of driveway, and 18 1 ineal feet of curbing. In actuality, to tal repairs of 295 square feet of sidewalk, 135 square feet of driveway and 20 1 i neal feet of curbing were requ1red. However, Mr. Sarrow was assessed only for those repairs cited in the original Notice to Repair 1n accordance with present po 1 icy. A 1 awn sprinkler pipe was broken during the repair of the sidewalk. This is a common occurrence in sidewalk repairs as many of the sprinkler systems are very old. The systems run adjacent to the sidewalk and when the form is put into place the pipe has to be moved slightly. Because of the age of the pipes, in some instances the pipe cannot withhold the slight pressure. Santa Monica I am a part owner o~ the captioned 12 unit apartment bui~ding~ where certain unnecessary repairs were recently made to the sidewalk by the city of Santa Monica. No notice of intended repair or inquiry was made by the city prior to commencing work. Had such notice been given we could have informed city personnal of the following: 1 . no trip hazard or other problem existed. there were no protruding roots or buckling of pavement 2. no request for repair had been made by the owners or any tenant 3.. There had been no history of accident or tripping 4. no repair or replacement was necessary When the city crew arrived one morning to begin work, the building manager, Mr. George Goldberg inquired what was to be done and for wbat purpose. He was told by the crew supervisor the work was for cosmetic reasons and the eity would bear the full cost. A letter from Mr. Goldberg is attached hereto regarding this matter. Much of the work involved replacement of the driveway and curb which was in perfect condition. In the process. the city crew broke one of our water lines which they inadequately repaired. Our plumber was needed a few days later to correct the faulty repair at a cost of $106.35 Now we are told ve must pay $1327.50 to the city for unneeded and unwanted repairs to the sidewalk and driveway. I protest the assessment in the strongest possible terms and respectfully request reimbursement of the $106.35 paid to correct damage done by the city crew. A copy of the invoice is attached. Background On October 9. 1979. the City Council approved a sidewalk: repair program which provided for property owner participation in the cost of repairing damaged sidewalks (Item 11~C). Property owner participation was set at 50% of the cost of the repairs; the City will pay the remaining 50% of the cost of the repair without regard to the reason for the damage. Certain repair work has been completed at the following addresses and the property ownersl share of the costs are now due: 1124 Marine. 1115 Marine, 1119 Marine, 1123 Marine, 1128 Marine. 1204 Marine, 1210 Marine, 1114 Marine and 1118 Marine. A public hearing must be held pursuant to provisions of Division 7, Chapter 22, Sections 5600 to 5630, of the Streets and Highways Code for the State of California. Background On October 9, 1979, the City Counc 11 approved a Sldewalk repair program wh i c h provided for property owner participation in the cost of repairing damaged sidewalks ( I t em 11- C ) . Property owner participation was set at 50% of the cost of the repairs; the City will pay the remaining 50% of the cost of the repair without regard to the reason for the damage. Certain repalr work has been completed at the following addresses and the prope rty ownersl share of the costs are now due: 1441 Harvard, 1437 Harvard, 856 Princeton, 2001 Navy, 2201 Navy, 2519 21st Street, 2509 21st Street, 2515 21st Street, 2101 Navy Street, 959 Princeton Street. A public hearing must be held pursuant to provisions of Division 7, Chapter 22, Sections 5600 to 5630, of the Streets and Highways Code fa r the State of California. Sections 5600 to 5630, of the Streets and Highways Code of the State of California. the following work was caused to be done by the Street Superintendent: The removal and replacement of 610 square feet of PC concrete on sidewalks at $3.00 per square foot; The removal and replacement of 3256 square feet of PC concrete on sidewalks at $4.00 per sQua re fo ot; The removal of and replacement of 222 square feet of PC on driveways at $5.00 per square foot; and The removal and replacement of 29 lineal feet of PC concrete on curbs at $10.00 per lineal fo ot. The total cost of the above work was $16,254.00. The to tal proposed assessment for sidewalks and curbs is $8.127.00 or 50 percent of the to ta 1 cas t. The other 50 percent of the cost is being paid by the City as the above repairs were caused by tree root damage. It is recommended that Council adopt the attached Resolution confirming the assessment of costs. Background On July 27, 1982, the City Counci1 set a public hearing for August 24, 1982, on the assessment of costs to repair damaged sidewalks, driveways and curbs within the City of Santa Monica. Letters were mailed to each property owner informing them of the public hearing on August 11, 1982. Recommendation It is recommended the City Council: 1. Open the Public Hearing; 2. Close the Public Hearing and acknowledge any protests; and 3. Adopt the Resolution confirming the assessments. The total cost of the above work was $2,898.00. The total proposed assessment for sidewalks and curbs is $1,449.00 or 50 percent of the total cost. The other 50 percent of the cost is being paid by the City as the above repairs were caused by tree root damage. The removal and replacement of 60 square feet of PC con c rete on sidewalks at $4.00 per square foot; and The removal of 360 square feet of PC concrete at $4.00 per square foot. RESOLUTION NO. 6541(CC5) - (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS (SR-82-30) WHEREAS, the Street Superintendent of the City of Santa Monica, pursuant to Section 5600 to 5630 of the Streets and Highways Code, commenced proceedings to cause the repair of damaged sidewalks, driveways and curbs in the Ci ty of Santa Monica; and WHEREAS, six ty days after said order was served, the work had not been completed by the owners or persons in possession of the affected properties, a nd the Superintendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets gave the notice required by Section 5616 of the Streets and Highways Code; and WHEREAS, the Superintendent of Streets did file with the Ci ty Council of the City of Santa Monica his report of repairs and .. cost as required by Section 5617 of the Streets and Highways Code; and WHEREAS, upon the day and hour fixed for heari ng by Resolution Number 6513 (CCS} , the Ci ty Council of the Ci ty of Santa Mo n i c a heard and passed upon the report of the Superintendent of Streets together wi th all ob-jections and protests as required by Section 5618 of the Streets and Highways Code; -- - - J - e e NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION , . The total cost of the above work was $2,839.50. Th e to tal proposed assessment for sidewalks and curbs is 51,419.75 or 50 percent of the total cost. The other 50 percent of the cost 1S being paid by the City as the above repairs were caused by tree root damage. The to tal proposed assessment for non-tree root related damage is $187.50 based on repairs of 62.5 square feet of PC concrete on sidewalks at $3.00 per square foot. The reasons for the sidewalk repair on Navy Street between 18th Street and 23rd Street is the trees that the city planted several years ago. They were not all planted correctly and therefore have raised not only the sidewalk in front of homes but the street as well. Is there no end to the dubious ways in wh~ch the city is trying to raise mon1es? There was a protest to this fee once before and the city did not charge the fees. Is this a "try once morell antic of the city council? I liked the way in which the mailing was done. Last time we received certified letters. TIns time it was on a "postcard type" mailing. Background On October 9. 1979, the City Council approved a sidewalk repair program which provided for property owner participation in the cost of repairing damaged sidewalks (Item Ii-C). Property owner participation was set at 50% of the cost of the repairs; the City will pay the remalning 50% of the cost of the repair without regard to the reason for the damage. Certain repair work has been completed at the following addresses and the property ownersl share of the costs are now due: 1044 Yale, 2339 28th St., 948 20th St., 924 Princeton St., 928 Princeton St., 2024 Navy St., 906 Princeton St., 1414 6th St. A public hearing must be held pursuant to provisions of Division 7, Chapter 22. Background On October 9 , 1979, th e City Council approved a sidewalk repair program wh i c h provlded for property owner participation in the cost of repairing damaged sidewalks (Item II-C). Property owner participation was set at 50% of the cost of the repairs; the City wi 11 pay the remaining 50% of the cost of the repair without regard to the reason for the damage. Certain repair work has been completed at the following addresses and the property owners. share of the costs are now due: 170 Pier Avenue, 433 Hill Street, 1802 Navy Street, 1812 Navy Street, 2112 Navy Street, 2411 Lincoln Blvd., 836 Princeton, 860 Princeton, 840 Princeton, 826 Princeton, 850 Prlnceton. A public hearing must be held pursuant to provisions of Division 7, Chapter 22, Sections 5600 to 5630, of the Streets and Highways Code for the State of California. It is recommended that Council adopt the attached Resolution confirming the assessment of costs. Background On April 13,1982, the City Council set a publiC hearing for May 11, 1982, on the assessment of costs to repair damaged sidewalks, driveways and curbs within the City of Santa Monica. Letters were mailed to each property owner informing them of the public hearing on April 29, 1982. Recommendation It is recommended the City Council: 1. Open the Public Hearing; 2. Close the Public Hearing and overrule any protests; and 3. Adopt the Resolution confirming the assessments. The total cost of the work was $2,185.00. The total proposed assessment for sidewalks is $1,092.50 or 50 percent of the total cost. The other 50 percent of the cost is being paid by the City. CA 90405 .. . . e ? - ----- RESOLUTION NO.64.83(CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING REPAIRS TO DAt~AGE 0 SIDEWALKS, DRIVEWAYS AND CURBS (SR-82-261 WHEREAS, the Street Superintendent of the City of Santa r~ 0 n i c a , pursuant to Section 5600 to 5630 of the Streets and Highways Code, commenced proceedings to cause the repair of damaged sidewalks, driveways and curbs in the Ci ty of Santa T40 n i c a; and WHEREAS, six ty days after said order was served, the work had not been completed by the owners or persons in possession of the affected properties, and the Superintendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets gave the notice required by Section 5616 of the Streets and Highways Code; and WHEREAS, the Superintendent of Streets did file with the City Co un c i1 of the City of Santa Monica his report of repairs and cost as required by Section 5617 of the Streets and Highways Code; and WHEREAS, upon the day and hour fixed for hearing by Resolution Number 6467 (CCS), the Ci ty Council of the Ci ty of Santa Monica heard and passed upon the report of the Superintendent of Streets together with all obj ecti ons and protests as required by Section 5618 of the Streets and Highways Code; ~~ I e -' NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS fOLLOWS: SECTION 1. That the report of the Superintendent of Streets heretofore filed and above-described be and the same is hereby confirmed. SECTION 2. That all protests and objections of every kind and nature to the report of the Superintendent of Streets be and the same are hereby overruled and denied. SECTION 3. That the cost of the repairs, as set forth in the report of the Superintendent of Streets, shall be assessed against the properties therein described, which properties front upon the sldewalk upon which the repairs were made. SECTION 4. That if such assessment is not paid within the time permitted by law, the same shall constitute a special assessment against and lien on the properties therein described, in the amount set forth in the report of the Superintendent of Streets, which lien shall conti nue until the assessment and all interest thereon is paid or until it is discharged of record. SECTION 5. That if the asssessment is not paid within the time perm i tted by law, the Superintendent of Streets, in accordance with Section 5628 of the Streets and Highways Code, shall deliver a Notice of Lien, prepared in the manner required by Section 5626 of the Streets and Highways Code, to the County Au d i to r who shall collect the assessment together with all other taxes against the property. ~ - , I e -' SECTION 6.
