SUBJECT: Recommendation to Vacate Street Right-of-Way
Parcels Located Along Ocean Park Boulevard
Introduction
~
This report recommends that the City Council order vacation
of three excess street right-of-way parcels located along Ocean
Park Boulevard, to facilitate the sale of such surplus City
property.
Background
On April 11, 1989, the City Council adopted Resolution 7791
(CCS) authorizing the sale of three surplus City-owned
right-of-way parcels, (totaling approximately 8,542 square feet)
located along Ocean Park Boulevard as more particularly described
in said Resolution 7791 (CCS). (hereinafter the "subject
property") .
The subject property was originally acquired for
street-widening purposes and is no longer needed for such purpose
or any other public use.
On April 11, 1989, the City Council also adopted Resolution
No. 7790 (CCS) declaring its intent to vacate the subject

property and setting a public hearing on this matter for April

25, 1989 at 7:30 p.m. in the City Council Chambers.
Vacation can proceed in accordance with streets and
Highways Code Part 3, Sections 8300 et. seq. "Public Streets,
Highways, and Service Easements Vacation Law".
No public utility lines or appurtenant structures are
located on, above or beneath the subject property.
Such street vacation must be completed prior to
commencement of negotiations for the sale of the subject property
to the adjacent property owners.
Recommendation
Staff recommends that the City Council adopt the attached
resolution which will vacate these three excess right-of-way
parcels along Ocean Park Boulevard.

A RESOLUTION OF THE CITY COUNCIL
OF CITY OF SANTA MONICA ORDERING
THE VACATION OF EXCESS STREET RIGHT-OF-WAY
PAllCELS LOCATED ALONG OCEAN PARK BOULEVARD
WHEREAS, the city has determined that the property
described in Section 1 of this Resolution is no longer needed for
the purpose acquired and that said property is not needed for any
present or prospective public use~ and
WHEREAS, on April 11, 1989, t.he Cit.y Council adopt.ed
Resolution No. 7791 (CCS) authorizing sale of the three excess
right-of-way parcels of property described in Section 1 of this
Resolution (hereinafter the IIsubject propertyll) and;
WHEREAS, on April 11, 1989, the city council adopted
Resolution No. 7790 (CCS) declaring its intention to order
vacation of the subject property, and setting a public hearing
thereon for April 25, 1989;
WHEREAS, street vacation of the subj ect property must be
completed before sale of the property is completed;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The Ci ty Council of the City of Santa Monica
orders vacation of the three excess street right-of-way parcels
located along Ocean Park Boulevard between Sixth street and

. Fourth Court, as shown on city of Santa Monica General Services
Department, Engineering Division, Drawing 4431, on file at the
City of Santa Monica Engineering Division, and described as
follows:
Parcel 1. That portion of Lot 1, Block 3, Hill Crest
Tract, in the City of Santa Monica, County of Los Angeles,
state of California, as per map recorded in Book 6, Page
147 of Maps, in the Office of the County Recorder of said
Los Angeles County, described as follows:
The Point of Beginning being a point on the Southwesterly
line of said Lot 1, a distance of 13.30 feet, more or less,
in a Northwesterly direction from the Southernmost corner
of said Lot: thence North 39 degrees 54110" West along the
Southwesterly line of said Lot a distance of 102.96 feet,
more or less, to the Westerly corner of said Lot; thence
Northeasterly along the Northwesterly line of said Lot a
distance of 2.52 feet to a point, said point being in a
nontangent curve concave Northerly and having a radius of
270 feet, a radial line through said point and having a
bearing of North 42 degrees 14'02" East; thence Easterly
along said curve an arc distance of 127.32 feet to a point,
a radial line through said point having a bearing of North

recorded in Book 3, Page 92 of Maps, in the Office of the
County Recorder of said Los Angeles County, and described
as follows:
Beginning at the Southernmost corner of said lot; thence
proceeding Northwesterly along the Southwesterly line of
said lot a distance of 99.81 feet; thence N 54 degrees
19151" E a distance of 19.76 feet; thence S 84 degrees
18129" E a distance of 24.40 feet; thence S 43 degrees
16'48" E a distance of 80.09 feet; thence Southwesterly
along the Southeasterly line of said lot to said corner.
Said Parcel 2 has a total acreage of 3,564 square feet.
Parcel 3: That portion of Lot 18 of Block A, in the city of
Santa Monica, County of Los Angeles, state of California,
as shown on the Map of the Vawter's Fourth street Tract,
recorded in Book 3, page 92 of Maps, in the Office of the
County Recorder of said county, and described as follows:
Beginning at the Southernmost corner of said lot; thence
proceeding Northwesterly along the Southwesterly line of

recorded, the excess right-of-way parcels shall no longer
constitute portions of City of Santa Monica streets.
SECTION 3. This vacation is completed in accordance with
the provisions of the California streets and Highways Code, Part
3, sections 8300 et. seq., flPublic streets, Highways, and service
Easements Vacation Lawfl.
SECTION ... Pursuant to streets and Highways Code Section
8336, the City Clerk shall cause a copy of this Resolution to be
recorded in the office of the County Recorder of the County of
Los Angeles. Upon such recording, the vacation shall be
complete.
SECTION 5. The City Clerk shall certify the adoption of
this Resolution and, thenceforth and thereafter the same shall be
in full force and effect.
