SUBJECT: Hold Public Hearing to Vacate a Portion of Euclid Court
Introduction
This report requests that the City Council hold a public hearing
to vacate a portion of Euclid Court located between the Santa
Monica Freeway and Olympic Boulevard, acknowledge any protests, and
adopt the attached resolution ordering the vacation.
Background
On March 13, 1990, the city council, in accordance w1th the
provisions of the Streets and Highways Code section 8300 et.seq.,
passed Resolution No. 7989 ( CCS) , setting a public hearing for
April 10, 1990, to vacate a portion of Euclid Court. The property
in question is a portion of the dead end section of Euclid Court
(the alley between Euclid and 14th street) which abuts the Santa
Monica Freeway south of Olympic Boulevard, as fully described in
the attached resolution and Drawing No. 4459. The request to
vacate the alley was made by Mr. Klaus Schoenberger who owns the
property abutting either side of the alley.
City use of this section of the alley 1S currently for right of way
access and utility access for maintenance of water and wastewater
lines. In consideration of the vacation of this alley section,

the applicant will relocate, per city requirements, the sewer line,
water line, and any other utilities that may require relocation.
These costs of relocation will be borne fully by the applicant.
The City would then have no need for this alley segment. It is the
policy of the city to vacate such property upon request by an
abutting property owner when the City has no essential need for the
property.
BUdget/Financial Impact
There is no budget/financial impact resulting from this
recommendation.
Recommendation
It is recommended that the city Council:
l. Open the public hearing;
2. Close the public hearing; and
3. Acknowledge protests, if any, and adopt the attached
resolution ordering the vacation.

At a regular meeting held on March 13, 1990, the city council of
the city of Santa Monica adopted Resolution No. 7989 (CCS) which
proposes the vacation of a portion of Euclid Court between the
Santa Monica Freeway and Olympic Boulevard.
The City Council will hear and pass upon objections or protests to
the vacation, if any, by the property owner or other interested
party at the following date, time and place:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE VACATION OF A
PORTION OF EUCLID COURT BETWEEN THE SANTA MONICA
FREEWAY AND OLYMPIC BOULEVARD IN THE CITY OF
SANTA MONICA, CALIFORNIA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the city of Santa Monica,
having heard the evidence offered in relation to the proposed
vacation of that portion of Euclid Court, as shown in Drawing No.
4459 on file in the Office of the city Engineer, located between
Olympic Boulevard and the Santa Monica Freeway, shown as an alley
on the map of Towner Terrace Tract, in the city of Santa Monica,
County of Los Angeles, State of California, as per map recorded in
Book 8, Page 25 of Maps, in the Office of the County Recorder of
said county, and bounded as follows:
On the Northeast by the southwesterly line of
Lot 126 of said tract; on the southeast by a
straight line between the southernmost corner
of Lot 126 and a point on the northeasterly
line of Lot 132 of said tract, said point
being dlstant 5.00 feet southeasterly from the
easterly corner of Lot 131 of said tract; on
the southwest by the northeasterly line of Lot
131 of said tract; and on the Northwest by the
northeasterly prolongation of the north-
westerly line of said Lot 131, 20.00 feet in
length,
hereby finds from all of the evidence submitted that the portion
of the alley described above and proposed to be vacated by
. .
y Resolution No. 7989 (CCS) is unnecessary for present or prospective
street purposes and the vacation is consistent with the General
Plan of the City of Santa Monica.
SECTION 2. In consideration of the vacation of this alley,
the applicant will relocate, per City requirements, the sewer line,
water line, and any other utilities that may require relocation.
These costs will be borne by the applicant in addition to any
connection fees.
SECTION 3. The portion of Euclid Court as herein described
is hereby vacated.
SECTION 4. Pursuant to Streets and Highways Code section
8325, the City Clerk shall also cause a copy of this Resolution to
be recorded in the office of the County Recorder of the County of
Los Angeles. Upon such recordings, the vacation shall be complete.
SECTION 5. The City Clerk shall certify the adoption of this
Resolution, and thenceforth and thereafter the same shall be in
full force and effect.
