SUBJECT: Recommendation to Adopt a Resolution of Intention
to Vacate a Portion of Euclid Court and Set
a Public Hearing for April 10, 1990
Introductlon
This report requests that the City council adopt a Resolution of
Intention to vacate a portion of Euclid Court located between the
Santa Monica Freeway and Olympic Boulevard and set a public hearing
for April 10, 1990, to hear any protests regarding the proposed
vacation.
Background
Mr. Klaus Schoenberger, the applicant, has requested the vacation
of a portion of the dead end section of Euclid Court (the alley
between Euclid and 14th street) which abuts the Santa Monica
Freeway south of Olympic Boulevard, as fully described ln the
attached resolution and Drawing No. 4459. City use of this section
of the alley is currently for right of way access and utility
access for maIntenance of water and wastewater lines. Upon
vacation of the requested portion of the alley, the city would
release the property to the abutting property owners; typically,
the adjacent property owner owns the underlying fee title of that
portion of the alley from his property line to the centerline of

Mr. Schoenberger owns two parcels of land, one fronting Euclid and
one fronting 14th street. The parcels are bisected by the alley.
If the alley were vacated, the applicant would then own a
continuous piece of property from Euclid to 14th street.
The applicant intends to gate and roof the vacated section for
security and protection during storage and handling of his goods.
In consideration of the vacation of this alley sectionl the
applicant will relocate, per City requirements, the sewer line,
water line, and any other utilities that may require relocation.
These costs of relocation will be borne fully by the applicant.
The city would then have no need for this alley segment.
BUdqet/Financial Impact
There is no budget/financial impact resulting from this
recommendation.
Recommendation
It is recommended that the city Council adopt the attached
resolution to set a public hearing regarding the vacation of a
portion of EucTid Court for April 10, 1990.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA DECLARING ITS INTENTION TO ORDER
THE VACATION OF A PORTION OF EUCLID COURT BETWEEN
OLYMPIC BOULEVARD AND SANTA MONICA FREEWAY, IN THE
CITY OF SANTA MONICA, CALIFORNIA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. The City council of the City of Santa Monica
hereby declares its intention to order the vacation of that portion
of Euclid Court, 20 feet in width, as shown in Drawing No. 4459 on
file in the Office of the City Engineer, located between Olympic
Boulevard and the Santa Monica Freeway, shown as an alley on the
map of Towner Terrace Tract, in the City of Santa Monica, County
of Los Angeles, State of California, as per map recorded in Book
a, Page 25 of Maps, in the Office of the County Recorder of said
county, and bounded as follows:
On the Northeast by the southwesterly line of
Lot 126 of said tract; on the southeast by a
straight line between the southernmost corner
of Lot 126 and a point on the northeasterly
line of Lot 132 of said tract, sa~d point
being distant 5.00 feet southeasterly from the
easterly corner of Lot 131 of said tract; on
the southwest by the northeasterly line of Lot
131 of said tract: and on the Northwest by the
northeasterly prolongation of the
northwesterly line of said Lot 131, 20.00 feet
in length.

SECTION 2. The City Council of the city of Santa Monica, in
vacating the above mentioned portion of Eucl id Court, elects to
proceed under and in accordance with the provisions of the Public
streets, Highways and service Easements vacation Law, Streets and
Highways Code Section 8300 et seg.
SECTION 3. In consideration of the vacation of this alley,
the applicant will relocate, per City requirements, the sewer line,
water line, and any other utilities that may require relocation.
These costs will be borne by the applicant in addition to any
connection fees.
SECTION 3. The city Clerk is hereby directed to pUblish this
Resolution in the Evening outlook on two successive dates, the
first publication is to be made not less than fifteen days prior
to the date of the public hearing.
SECTION 4. The hour of 7:30 o'clock p.m. of the loth day of
April 1990, in the City of Santa Monica, California, be and the
same hereby is fixed as the time and place when and where all
persons interested in or objecting to the proposed vacation may
appear before the City council and offer evidence in relation
thereto.
SECTION 5. The Superintendent of Streets of the city of Santa
Monica hereby is directed to cause Notices of Street Vacation to
be posted as required by street and Highways Code Section 8323.

Acceptance and Recordation of an Easement
Introduction:
This report recommends that the City Council approve the attached
resolution authorizing acceptancce and recordation of an easement
on portions of First Court between Broadway and Colorado Avenue
and the adjacent property.
Background
CWD-Taiyo-Broadway-Ocean Associates (nCWD" ) requested the city to
vacate a portion of First Court located between Broadway and
Colorado Avenue, said portion being fully described in Resolution
No. 7585 (CCS) declaring the city's intention to vacate and
Drawing No. 4416 on file in the Office of the city Engineer. The
vacation was approved by Resolution No. 7608(CCS), adopted Aprll
26, 1988.
A condition for approval of the vacation is a grant of three (3)
easements for street and utility purposes allowing access to
First Court from Second Street and additional area for turning
movements in the alley. Exhibit "1" is a grant of two (2) of
these easements, as executed by CWD, owner of the easements and

adjacent property. The third easement, attached as Exhibit 11211,
is executed by Thomas and Sally Landau, owners of the easement
and adjacent property. For full particulars, reference is made

There is no budget/financial impact resulting from the
recommended action.
Recommendations
It is recommended that the city Council adopt the attached

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION l- In conjunction with development of real
property located in the city of Santa Monica ("City") and
recently vacated properties more accurately described below, the
city requires the property owners to grant easements in favor of
the City to accommodate public street and util i ty improvements
and to assure access to the publ ic utili~y improvements and to
prevent any hazards related to the development.
SECTION 2. In consideration of City vacation of a por-
tion of First Court located between Broadway and Colorado Avenue,
CWD-Taiyo-Broadway-Ocean Associates, a California general
partnership, as property owner, has executed a grant of two (2 )
easements attached as Exhibit Ill". Said easements are granted to
the City for street and utility purposes over portions of First
Court and an adjacent lot, as is fully described in Drawing No.
4416 on file in the Office of the City Engineer, and in Resolu-
tion Number 7585 (CCS) .

SECTION 3. Also in conslderation for the vacation of a

of easement, attached as Exhibit "2", executed by Thomas and Sal-
ly Landau to the City for turning movements. in the alley. Addi-
tional reference is made to Drawing No. 4416 and Resolution Num-
ber 7585 ( CCS) .
SECTION 4. The grant of such easements by the owners
of the subject properties is hereby approved and the City Manager
is authorized to accept such easements and record the grant deeds
with the Los Angeles County Recorder's office.
SECTION 5. The City Clerk shall certify to the adop-
tion of this Resolution, and thenceforth and thereafter the same
shall be in full force and effect.

GRANT OF EASEMENT
AND AGREEMENT
This Agreement made this 'IrA day of May, 1988,
by and between CWD-TAIYO BROADWAY-OCEAN ASSOCIATES, a California
general partnership (hereinafter "Grantor") and the CITY OF SANTA
MONICA, CALIFORNIA, a municipal corporation (hereinafter "Gran-
tee II ) , is made with reference to the following:
WHEREAS, Grantor is the fee owner of certain real property

Monica, California, and more particularly described as follows:
Lot C in Block 198 of the Town of Santa Monica, in the
Ci ty of Santa Monica, County of Los Angeles, State of
California, as per map recorded in Book 3 Pages 80 and
81, and in Book 39 Page 45, et seq. , of Miscellaneous
Records, in the Office of the County Recorder of said
County.
WHEREAS, the Servient Tenement is subject to a dedicated
public right-of-way over a portion of the Servient Tenement which
is commonly known as First Court; and

WHEREAS, on April 26, 1988, pursuant to ResolutJ..on No.

7608(CCS), Grantee has vacated a portion of FJ..rst Court as
described in said Resolution which has resulted in the that
portion of First Court reverting to Grantor who owns the
adjoining real property; and
WHEREAS, Grantee has vacated that portion of First Court
subject to adequate assurance that an alternative right of way
for a public alley and public utilities will be granted to
Grantee by Grantor; and
WHEREAS, Grantor desires to grant an easement to Grantee for
a right-of-way for a public alley and for all public utilities;
NOW THEREFORE, it is agreed as follows:
1. Grant of Easements. Grantor hereby grants to Grantee
easements as hereinafter described.
2. Nature of Easements. The easements granted herein are
easements in gross.
3. Uses of Easements. (a) The easement granted hereJ..n over
that portion of the Servient Tenement described in Exhl.bit "A"

attached hereto and incorporated herein by this reference, is a
right-of-way for a public alley and for all public utilities to
be used an maintained in a manner in which Grantee uses and
maintains other public alleys.
(b) The easement granted herein over that portion of
the Servient Tenement described in Exhibit "B" attached hereto
and incorporated herein by this reference, is a right-of-way for
a public alley for vehicular purposes but not for public

utilities, to be used an maintained in a manner in which Grantee

uses and maintains other public alleys.
4. Reservation of Rights. Grantor reserves the right to
use and occupy the subsurface which lies below that portion of
the easement described in Exhibit liB" attached hereto for a
subterranean parking garage provided that such use shall not
interfere with the use of the right-of-way for vehicular travel.
No public utilities shall be placed within the subsurface of the
right-af-way descr~bed in Exhibit ItBIt hereto.
5. Reversion. In the event that Grantee should at any t~me
abandon the use of the right-af-way, then all rights of use to
the underlying property shall revert to the Grantor, its
successors and assigns.
6. Entire Aqreement. This instrument contains the ent~re
agreement between the parties relating to the rights here~n
granted and the obligations herein assumed. Any oral representa-
tions or modifications concerning this instrument shall be of no
force and effect excepting a subsequent modification in writing,
signed by the party to be charged.
7. Attarneyts Fees. In the event of any controversy, cla:lm
or dispute relating to this instrument or the breach thereof, the
prevailing party shall be entitled to recover from the losing
party reasonable expenses, attorney's fees, and costs.
8. Binding Effect. This instrument shall bind and inure to
the benefit of the respective heirs, personal representatives,
and successors of the parties hereto.

WHEREAS, on April 26, 1988, pursuant to Resolut1.on No.

2608 (CCS), Grantee has vacated a portion of First Court; and
WHEREAS, Grantee has vacated that portion of First Court
subject to adequate assurance that an alternative right of way
for a public alley and public utilities will be granted to
Grantee; and
WHEREAS, Grantor desires to grant an easement to Grantee for
a right-of-way for a public alley.
NOW THEREFORE( it is agreed as follows:
1. Grant of Easement. Grantor hereby grants to Grantee
easement as hereinafter described.
2. Nature of Easement. The easement granted herein 15 an
easement in gross.
3. Uses of Easement. The easement granted here1.n 1.S a
right-of-way for a public alley for veh1.cular purposes but not
for public utilities, to be used an maintained in a manner 1.n
which Grantee uses and maintains other public alleys.
4. Location of Easement. The easement granted herein 1.S

5. Reservation of Rights. Grantor reserves the right to
use and occupy the subsurface which lies below the easement
granted herein for a subterranean parking garage provided that
such use shall not interfere with the use of the public right-of-

6. Reversion. In the event that Grantee should at any time

abandon the use of the right-of-way, then all rights of use to
the underlying property shall revert to the Grantor, its
successors and assigns.
7. Entire Agreement. This instrument contains the entlre
agreement between the parties relating to the rights herein
granted and the obligations herein assumed. Any oral representa-
tions or modifications concerning this instrument shall be of no
force and effect excepting a subsequent modification in writing,
signed by the party to be charged.
8. Attorney's Fees. In the event of any controversy, claim
or dispute relating to this instrument or the breach thereof, the
prevailing party shall be entitled to recover from the losing
party reasonable expenses, attorney's fees, and costs.
9. Binding Effect. This instrument shall bind and lnure to
the benefit of the respective heirs, personal representatives,
and successors of the parties hereto.

SUBJECT: Resolution Authorizing Execution of Grant of
Easement to Southern California Edison Company
Introduction
This report requests the adoption of the attached resolution
authorizing the City Manager to execute a Grant of Easement to
Southern California Edison Company for the construction and
maintenance of electrical transformer equipment located on city
property near the Southwest corner of Colorado Avenue and Seventh
Street.
Background
The recent additions to processing equipment within the tenant's
(Richard's surgical) operation necessitates the construction of a
new electrical transformer to provide the electrical service. At
the same time, the existing electrical service is being upgraded.
The easement will allow ingress and egress to Southern California
Edison's equipment.
Similar easements have been granted for the new Transportation
Facility, Ocean Park Library, and for the power upgrade for city
Hall.
BUdget/Financial Impact
There will be no budget or financial impact.

It is recommended that the city Council adopt the attached

OF SANTA MONICA AUTHORIZING EXECUTION OF A

APPURTENANT EQUIPMENT AT 612 COLORADO AVENUE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
WHEREAS, the Southern Callfornia ~dison Company
requires a Grant of Easement for construction and maintenance of
electrical transformer equipment; for the A~rport Control Tower
and
WF.~REAS, in order to provide the required transformer,
the use of pub1lc property is regulred; and
w~EREAS, the Southe~n California EdIson Company desires
that the City grant an easement for the use of the pUblic
property; and
h~EREAS, the city Counell finds that an easement is of
dlrect beneflt to the city of Santa Monlca.
NOW, THEREFORE, THE CITY COUNCIL OF THE C~TY OF Sk~TA
MONICA DOES RESOLVE AS =OLLOWS:
SECTION 1. The grant of easemer.t to Southern
Callfornla Edison Company is ap9roved and the CIty Manager is
