SUBJECT: Recommendation to Authorize city Manager to Negotiate
and Execute an Easement Agreement with OAB Corporation
INTRODUCTION
This report highlights the changes that have been made to I
Cugini outdoor dining plans and recommends that the city council
authorize the City Manager to negotiate and execute an Easement
Agreement with OAB corporation, doing business as I Cugini
Restaurant, at 1501 Ocean Avenue for its outdoor dining area
which extends into public right-of-way.
BACKGROUND
On November 28, 1989, staff requested City Council's approval of
an easement agreement for I Cugini Restaurant consistent with
findings it had made in adopting Resolution Number 7395 (March
24, 1987) for the Fennel outdoor dining area. At that meeting,
city council raised a number of questions regarding the design of
the barrier fronting Ocean Avenue and its proximity to the
street. The concerns included the height of the solid barrier
wall, the elevation of the outdoor dining patio above the
sidewalk, and the width of sidewalk clearance, particularly in
front of the bus stop bench and palm tree. I ,-&

DISCUSSION
The outdoor dining patio will extend 30 feet from the building in
which the restaurant will be located. Most of the outdoor dining
patio area will be located on private property. Only 8 feet of
patio width will be located on the public right-of-way. The
remaining 22 feet width will be on private property.
The original plans for the outdoor dining area indicated 12 1/2
feet clearance of concrete sidewalk from curb to the 3-foot wide
planter area at the sidewalk level, an elevated dining patio
floor 2 feet from the ground, and a 5-foot high brick masonry
wall (3 feet in height from the interior floor) topped with an
etched glass wind screen. The original design had received
approval by the Building and Safety Division, General Services
Department, and Architectural Review Board (June 1987). In
addition, the plans were more open in style and more conservative
in dimensions than three other outdoor dining areas previously
approved on Ocean Avenue.
The restaurant owner has modified his plans in order to address
these concerns. He has reduced the width of the planter area by
one foot to add another foot of concrete sidewalk, bringing the
sidewalk clearance to 13 1/2 feet (9 1/2 feet between bus bench
and planter). The restaurant owner has also eliminated the
opaque barrier wall at the outer edge of the dining patio. The
new barrier will consist of a glass windscreen and decorative
wrought iron railing extending to the floor of the dining patio
which is located 2 feet to 3 feet above the sidewalk level. The

new barrier will permit total visibility of the dining area and
patrons to pedestrian traffic. In addition, the owner is
removing a sidewalk curb cut which had been a former driveway to
the property.
Some aspects of the plans could not be modified. The floor
height of the dining patio remains 2 feet to 3 feet above the
sidewalk level at the same height as the elevated floor for the
entire building, which was raised to accommodate a subterranean
garage. The base of the dining patio will continue to be faced
with limestone as the rest of the building is. A lowered outdoor
dining floor at the public right-of-way line is neither feasible
nor safe due to insufficient area to install a handicap ramp. A
ledge at the lowered floor was considered a hazard by the General
Services Department. Further, the planter area was retained,
although narrowed, to continue to provide landscaping as required
by the ARB, and because pedestrian traffic flow can be easily
accommodated at this bus node and corner.
The proposed outdoor dining area for I Cugini Restaurant is
consistent with other outdoor dining areas approved by the City
Council along Ocean Avenue. However, staff has found that a more
systematic approach and clearer standards are needed and shall be
developed to channel requests for outdoor dining easements on
Ocean Avenue.
BUDGETARY/FISCAL IMPACT
The security deposit from OAB Corporation in the amount of
$2,000.00 has been deposited and recorded in the General Fund

balance sheet. The restaurant is expected to open for business
in September 1990. In FY 1990-91, rental income for
approximately ten months of operation is estimated at $7,345.13
(less income due to less square footage) . All revenue income
will be deposited in revenue account

RECOMMENDATION
staff respectfully recommends that the City Council authorize the
City Manager to negotiate and execute an Easement Agreement with
OAB Corporation for I Cugini Restaurant at 1501 Ocean Avenue for
its outdoor dining area.
