CJ 7""'-0 9' FROM: City Staff 5 (/ ,h -0 0 ~( - 0 1 SUBJECT: Recommendation to Approve a Resolution Authorizing Acceptance and Recordation of Utility Easements on Vacated Properties Introduction This report recommends that the City council approve the attached resolution authorizing acceptance and recordation of the following easements on privately owned properties. Said easements are being granted to the City in consideration for vacated City properties. Background A request for City vacation of a portion of Twenty Fourth Street between Santa Monica Boulevard and Santa Monica Place South was made by Mr. Oscar Katz, Trustee of the Oscar Katz's Trust, and approved by Resolution No. 7581(CCS) . In this resolution, the City requested the dedication of two (2) easements. Exhibit "1" is a grant of easement for utility purposes over the entire width and length of said vacation as fully described in Exhibit lilli, Resolution No. 7581(CCS), and Drawing No. 4403 on file in the Office of the City Engineer. Exhibit "2" is a grant of easement for street purposes over that portion of land as fully described in Exhibit "2", Resolution No. 758l(CCS), and Drawing No. 4403. Mr. Sam Stein made a request for vacation of a portion of pico Place North from Appian Way to 122 feet east of Appian Way which - 1 - b-F #tOO 9 1981 . . . , , . was approved by Resolution No. 7584(CCS) . As a condition to this vacation, the City requested a grant of easement for utility purposes as fully described in Exhibit "3", Resolution No. 7584(CCS) , and Drawing No. 4411 on file in the Office of the City Engineer. Mr. Stephen A. Greene made a request for vacation of a portion of Dewey street between Fourth Court and Fifth street which was approved by Resolution No. 7601(CCS) . In this resolution, the City requested a grant of easement for utility purposes over the southeasterly 11 feet of said vacation, as fully described in Exhibit "4", Resolution No. 7601(CCS) and Drawing No. 4413 on file in the Office of the City Engineer. Budget/Financial Impact There is no budget/financial impact resulting from the recommended action. Recommendations It is recommended that the City Council adopt the attached Resolution authorizing acceptance and recordation of four (4) easements over portions of Twenty Fourth street, pico Place North, and Dewey Street. (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE THE CITY OF SANTA MONICA AUTHORIZING ACCEPTANCE AND RECORDATION OF FOUR EASEMENTS FOR UTILITY OR STREET PURPOSES THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. In conjunction with the vacation of real properties located in the City of Santa Monica ("City") and more accurately described below, the City requires property owners to grant easements in favor of the City to accommodate public utility and street improvements and to assure access to these improvements and to prevent any hazards related to these developments. SECTION 2. Oscar Katz, as Trustee of the Oscar Katz's Trust and as owner of the subject property, has executed a grant of easement to the City for utility purposes over a portion of Twenty-Fourth street between Santa Monica Boulevard and Santa Monica Place South, as fully described in the attached Exhibit "1" and Drawing No. 4403 on file in the Office of the City Engineer. SECTION 3. Oscar Katz, as Trustee of the Oscar Katz's Trust and as owner of the subject property, has executed a grant of easement to the City for street purposes over a strip of land adjacent to Cloverfield Boulevard near Santa Monica Boulevard, as fully described in the attached Exhibit "2" and Drawing No. 4403 on file in the Office of the City Engineer. - 3 - . . . " SECTION 4. Sam Stein, as owner of the subject property, has executed a grant of easement to the city for utility purposes over a strip of land located 122 feet Northeasterly of Appian Way between pico Place North and pico Boulevard, as fully described in the attached Exhibit "3" and Drawing No. 4411 on file in the Office of the city Engineer. SECTION 5. Stephen A. Greene, as owner of the subject property, has executed a grant of easement to the City for utility purposes over a portion of Dewey Street between Fourth Court and Fifth Street, as fully described in the attached Exhibit "511 and Drawing No. 4413 on file in the Office of the City Engineer. SECTION 6. The grant of such easements by the owners of the subject properties is hereby approved and the City Manager is authorized to accept such easements and record the grant deeds with the Los Angeles County Recorder's Office.
