SUBJECT: Ordinance Amending Santa Monica Municipal Code
Sections 3352 and 3352B to Prohibit Skateboarding
in certain Locations
At its meeting on April 22, 1986, the city council directed
the city Attorney to prepare an ordinance amending santa Monica
Municipal Code section 3352 to prohibit skateboarding on Library
property. In response to this direction, the accompanying
ordinance has been prepared and is presented for City Council
consideration.
The proposed ordinance amends Santa Monica Municipal Code
Section 3352 to include Library property within the current
prohibition of skateboarding. Currently, Municipal Code Section
3352 prohibits skateboarding on the Third street Mall and in
Palisades Park.
Some members of the city Council have also expressed
concern about skateboarding in certain public parking lots.
Accordingly, Santa Monica Municipal Code section 3352B has been
amended by adding public parking lots to the proscription.
Currently, Municipal Code section 3352B prohibits skateboarding
in public parking structures.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL
CODE SECTIONS 3352 AND 3352B TO PROHIBIT SKATEBOARDING
IN CERTAIN LOCATIONS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Santa Monica Municipal Code section 3352 is
amended to read as follows:
SECTION 3352. Skateboards.

operate, ride or propel himself or herself
by means of a skateboard over or upon any
portion of that area described in Section
3611 of this Code, commonly known as the
Santa Monica Pedestrian Mall, in or upon
the Palisades Park, a public park, or in
or upon Library property.
SECTION 2. Santa Monica Municipal Code Section 3352B is
amended to read as follows:
SECTION 3352B. Skateboards
Prohibited in PUblic parking Lots and
Structures. No person shall operate, ride

or propel himself or herself by means of a
skateboard over or upon any portion of any
public parking lot or structure located in
the City of Santa Monica, including, but
not limited to, those owned by the city of
santa Monica and the Parking Authority of
the City of Santa Monica.
SECTION 3. Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent with the provisions of
this ordinance, to the extent of such inconsistencies and no
further, is hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.
SECTION 4. If any section, subsection, sentence, clause,
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of the ordinance. The City Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The city Clerk shall
cause the same to be published once in the official newspaper

within 15 days after its adoption. The ordinance shall be
effective 30 days from its adoption.
