A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
D At-1 AGE 0 SIDEWALKS, DRIVEl~AYS AND CURBS
(SR-83-48)
WHEREAS, the Street Superintendent of the City of Santa
Monlca, pursuant to Section 5600 to 5630 of the Streets and
Hlghways Code, commenced proceedings to cause the repair of
damaged sldewalks, drlveways and curbs in the City of Santa Monica
at 2102 Oak, 2116 Oak, 2108 Oak, 225 22nd St., 2330 21st St., 1701
Oak, 1801 Oak, 2102 Pearl, 2028 Pea rl , 2402 21st St., 2101 Pearl,
2427 21st St., 2334 21st St., 2338 21st, 2344 21st St., 2416 21st
St. , 2506 21st St., 2512 21st St. and 2442 21st St.; and
WHEREAS, Slxty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected propertIes, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notlce
requlred by Section 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets dld file wlth the
Ci ty Counei 1 of the City of Santa Monlca hlS report of repairs and
cost as requlred by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour fixed for hearing by
Resolution Number 6690 (CCS)~ the City Councl1 of the City of
Santa Monlca heard and passed upon the report of the
Superl ntendent of Streets together with all objectlons and
protests as required by Section 5618 of the Streets and Highways
Code;
NOH, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. That the report of the Superintendent of
Streets heretofore filed and above-descrlbed be and the same 1 s
hereby conf1rmed.
SECTION 2. That all protests and objections of every
k1nd and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repa 1 rs, as set forth
In the report of the Superintendent of Streets, s ha 11 be assessed
against the propertles there1n descrlbed, WhlCh propert1es front
upon the sidewalk upon Wh1Ch the repairs were made.
SECTION 4. That 1f such assessment 1 s not paid with1n
the time perm1tted by 1 a w, the same shall constitute a special
assessment agalnst and 1 i en on the properties therein described,
1 n the amount set forth ln the report of the Superintendent of
Streets, Wh1Ch 11 en shall contlnue unt1l the assessment and all
1nterest thereon 1 s pa ; d or unt1l it is discharged of record.

SECTION 5. That if the asssessment i s not pald wlthin
the tlme perrnltted by law, the Superintendent of Streets, i n
accordance with Sectlon 5628 of the Streets and Hlghways Code,
shall deliver a Notlce of Llen, prepared ln the manner requlred by
Sectlon 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together wlth all ot he r
taxes agalnst the property.
SECTION 6. That the City Clerk shall certify to the
adoptlon of thlS resolutlon and thenceforth and thereafter the
same shall be i n fu 11 force and effect.
