SUBJECT: ResolutIon SettIng a Public HearIng for January
8 t 1985, on the Assessment of Costs to RepaIr
Damaged SIdewalks, DrIveways, and Curbs on
Various Streets (SR-85-59)
IntroductIon
ThIS report requests the CIty CouncIl set a publIC hearIng for
January 8, 1985. to hear protests regarding the work and confIrm
the assessments of the cost to repair damaged sIdewalks,
drIveways and curbs.
Background
On October 9, 1979, the CIty CouncIl approved a sIdewalk repair
program WhICh provIded for property owner partIcIpatIon in the
cost of repaIring damaged sIdewalks. ResIdential property owner
particIpation IS 50% of the cost of the repairs If the damage is
related to tree root s; the City pays the remainIng 50% of the
cost of the repaIr. Property owners are assessed 100$ of the
cost if the damage IS not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the
cause of the damage.
CertaIn repaIr work has been completed at the followIng addresses
and the property owners' share of the costs are now due: 1620
Broadway, 534 23rd Street, 513 14th Street, 1021 Pine Streett 128
Esparta Way, 2504-2512 11th, 827 20th Street, 823 20th Street,
1514 Maple Street and 1315 Maple Street. A public hearing must
be held pursuant to the provISIons of Chapter 22, SectIons 5600

Budget/FInancIal Impact
The financial analysis which wIll indicate total revenues to be
derIved from thIS assessment dIstrIct over the next two years
wIl! be presented to CIty CounCI! at the tIme of publIC hearIng.
Recommendation
It IS recommended the City Councl! adopt the attached ResolutIon
settIng a publIC hearIng for January 8, 1985, on the assessment
of costs of the subJect sldewalk repaIrs.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ~10NICA SETTING A HEARING
DATE FOR ANY PROTESTS OR OBJECTIOfIS TO
THE RE~ORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIR OF SIDEWALKS,
DRIVEWAYS AND CURBS (SR-85-59)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets will file
a report of repaIr pursuant to Section 5617 of the Streets and
HIghways Code of the State of CalIfornIa, relatIng to the
construction of certaIn Improvements to sIdewalks and drIveways
at 1620 Broadway, 534 23rd, 513 14th Street, 1021 PIne Street.

SECTION 2. That pursuant to Section 5600 et seq. of saId
code, the CIty CouncIl does hereby order and declare that on the
8th day of January, 1985, at 7:30 P.M., In the CouncIl Chambers
of the City Hall , it will hear and pas s upon the re port by the
Superintendent of Streets of the cost of repaIr. together wIth
any ObjectIons or protests, If any, WhICh may be raIsed by any
property owner liable to be assessed for the cost of such repaIr
and any other Interested persons.

SECTION 3. That all protests or objections must be in
writlng and flIed wIth the CIty Clerk on or before the time set
for hearlng of protests and obJectlons.
SECTIOn 4. The Superlntendent of Streets IS hereby

dIrected to mall notices, in the manner and form prescrIbed by
law, of the cost of repaIr and of the adoption of thlS Resolution
to all persons ownIng real property affected by the SIdewalk
assessment repair program, whose names and addresses appear on
the last equalized assessment roll for the City taxes or as known
to the Clty Clerk.
SECTIO~ 5. The City Clerk shall certify to the adoption
of thIS resolutJon and thenceforth and thereafter the same shall
be i:1 full forc~ and effect.
