'rhlS report requests the C1ty CouncIl set a publlC hear~ng for
September 23, 1986, to hear protests regardlng the work and
conf1rrn the assessments of the cost to repa1.r damaged s1.dewalks,
drlveways and curbs.
Background
On October 9, 1979, the City Counell approved a sldewalk repaIr
program wn!.ch prO'ill.ded for property owner partlC1.patl.on 1n the
cost of repa U lng damaged. sldewalks. Resl.dentlal property owner
partl.Cipatlon 1S 50% of the cost of the repal.rs 1f the damage is
related to tree roots; the Clty pays the remaln1ng 50% of the
cost of the repaIr. Property owners are assessed 100% of the
cost 1f the damage is not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the

cause of tne damage.

The fInanclal analYSIS, WhlCn wIll IndIcate total revenues to be
derlved from th~s assessment d~strlct over the next two years,
wIll be presented to City CounCil at the tlme of publIC hearing.
Recommendatlon
It 15 recommended the CI ty CounCIl adopt the attached ResolutIon

CITY OF SANTA MONICA SETTIt'JG A HEARING
DATE FOR ANY PRo'rESTS OR OBJECTIONS TO
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIR OF SIDEWALKS,
DRIVEwAYS AND CURBS (SR-86-88)
THE CITY COUNCIL OF THE Cl'rY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION l. The Superintendent of Streets wIll fIle a
report of repalr pursuant to Section 5617 of the Streets and
Highways Code of the State of Ca1lforn~a, relatl.ng to the
constructIon of certaln Improvements to SIdewalks and drIveways
at 2107 MaIn Street, 824 Maple Street, 1008 t-iaple Street, 818
Maple Street, 1015 Chelsea Street, 1305 2nd Street, 210 25th
Street, 339 10th Street, 918 PrInceton Street, 2118 Navy Street,
636 20tn Street, 533 22nd Street, 2211 Marl.ne Street, 443 12th
Street, 2020 MarIne Street, 15.14 5th Street, and 3201 Pearl
Street, all WIthIn the CIty of Santa MonIca.
SECTION 2. Pursuant to Section 5600 et seq. of saId
code, the C1ty Council does hereby order and declare that on the
23rd day of September, 1986, at 7:30 P.M., In the Counc1.l
Chambers of the City Hall, l.t WIll hear and pass upon the report
by tbe Superintendent of Streets of the cost of repair, together
with any obJectIons or protests, if any, which may be raised by
any property owner 1iaole to be assessed for the cost of such
repalr and any other interested persons.

SECTION 3. All protests or obJectlons must be In wrltlng

hearing of protests and obJectlons.
SECTION 4. The Superintendent of Streets is hereby
dlrected to mall notlces, In the manner and form prescrlbed by
law, of the cost of repalr and of the adoption of thIS Resolutlon
to all persons ownlng real property affected by the sidewalk
assessment repalr program, whose names and addresses appear on
the last equalized assessment roll for the Clty taxes or as known
to the Clty Clerk.
SECTION 5. The Clty Clerk shall certlfy to the adoptIng
of thIS ResolutIon, and thenceforth and thereafter the same shall
be In full force and effect.
