Background On November 28, 1978. Council declared 1ts intention to order the vacation of Wilshire Place North from 20th St. to 20th Court, and set the date of January 9. 1979, for a publ1C hearing. The vacation of this alley and the construction of a new alley parallel and northerly of it. together with certain dedications. facil1tate a project by the Ernest Auerback Co. which cons1sts of a major office building and parking structure. The subject alley is proposed to be vacated \~ith the stipulation that: (1) in the event that at some unforeseen time in the future the property northeasterly of the alley is separated in common ownership, the subject alley shall be rededIcated; and (2) that such vacation is dependent on the dedicatlon of certain oroperties; and (3) that the developer shall construct a new Wilshire Place North between 20th St. and 20th Court, all as shown in the attached Drawing No. 4206; and (4) that the Ernest Auerbach Co. shall make all arrange- ments with and pay all costs to utility companies for rerout1ng or modification of their facilities, if requ1red. That the City Council of the City of Santa Monica hereby declares its intention to order the vacation of all of that portlon of W1lshire Place North between Twentieth Street and Twentieth Court as shown on the map of Green Acres Block 7 as recorded in Map Book 9, Page 126. in the City of Santa Monica, County of Los Angeles, State of California. For further particulars as to the proposed vacation, reference is made to Map No. 4206, dated November 28, 1978, now on file in the office of the City Clerk 1n the City Hall. Santa Monica, California. SECTION 2. The City Council of the City of Santa Monica, in vacating sa1d portion of Wilshire Place North hereby intends to make said ~ vacation conditional on the relocation of all sanitary sewers, water mains, and other utilities now located w1thin said alley. SECTION 3. The City Council of the City of Santa Monica further stipulates that the vacating of said portion of Wilshire Place North is dependent on the dedication of property and the construction of a new f"i 1 sh ire Pl ace North as i nd i ca ted on said Nap No. 4206. SECTION 4. The City Council of the C1ty of Santa Monica, in vacating the above mentioned portion of Wilshire Place North elects to proceed under and in accordance \'iith the provislons of the "Street Vacat10n Act of 1941," be1ng DivislOn 9. Part 3 of the Streets and High\'lays Code of the State of Californla. . . . SECTION 5. It therefore is ordered that sald port1ons of said alley be and the same hereby are vacated, and said easement be and the same hereby is abandoned; but at such time that the property on either side of the alley is separated from common ownership with the property on the other side of the alley, this alley shall become a public way. SECTION 4. The City Clerk shall certlfy to the adoption of this resolution and the same shall be in full force and effect on and after January 9. 1978. Ba,ckground By attached letter dated September 4, 1979, the Southern Cal1fornia Ed1son Co. has requested a determination by the City Engineer as to the feaslbility of the C1ty vacating the subject street. Th1S request is for the purpose of proYlding additional parklng for an office building to be constructed on the south-westerly side of Twenty-Second Street. The Edison Co. already has an offlce building and yard area on the northeasterly slde of Twenty-Second Street and the Company owns all of the property on both sides of the street portion requested for vacatlon. The total right-of-way width is to be reta1ned as a storm water dra1nage to the two catch basins in the portion to be vacated. A deposit of $1,000 will be required to flnance the Clty'S cost for the en9ineerlng for this vacation. It is proposed to vacate the subject street as shown on the attached copy of Draw1ng No. 4241. .. This request was consldered by the Planning Commission on November 5, 1979. BACKGROUND The Southern Callfornla Ed1son Company has requested that the above described one block long dead-end street be vacated. The purpose of the requested vacation is to faCll1tate a new building which Edlson 1S plannlng to build on the west side of 22nd Street and to allow park1ng perpendlcular to the curb at thlS location. On December 11th, the Clty Council requested that the staff report on January 8, 1980 regarding the parklng sltuatlon In the area surrounding the street Wh1Ch has been requested to be vacated. The Staff d1d conduct a survey on December 12 at 8:30 A.M. and found no vacant on street parking spaces in a two block area surroundlng the site. The number of on-street parking spaces in the portion requested to be vacated is 11. The staff conclusion lS that there is a shortage of on-street as well as off street parklng ava1lable ln the general area. It has been determlned that these improvements were paid for by the developers of the land. Northwesterly Introduction This report requests that the City Council hold a public hearing and recommends that the C1ty Council order the vacation of First Court from Arizona Avenue to 200 ft. northwesterly thereof. Background On July 10, 1979~ the City Councl1 adopted Resolution No. 5335 (CeS), declaring its intention to order the vacation of First Court from Arizona Ave. to 200 ft. northwesterly thereof~ and set the date of August 14~ 1979 for a pUblic hearing. The vacatlon of this portion of First Court and the construction of a new a11ey to Second St., together with certain dedications~ will facilitate the con- struction of a major office building between Ocean Avenue and Second St. by Teleklew Productions, Inc. The subject alley 1S being recommended for vacation contingent upon certa1n eonditions being complled with to the satisfaction of the City Engineer. These conditions are: 1. Certain property be dedicated for a new alley connecting First Court to Second Street. 2. Construction of a new alley connecting Flrst Court to Second Street. 18 3. Legal descriptions necessary for the vacation and relocation, together with alley plans are now being prepared by the developer. The building proJect includes subterranean parking areas, the roof of which will be approximately one foot below portions of the new alley. The buil di ng will also encroach above the new proposed alley and adjacent property. A 20 foot height clearance will be provided over the alley. Attached is a copy of Drawing No. 4246 showing the alley portion to be vacated and the dedications. Also included is a sketch marked Exhibit nAil showing the proposed building encroachments above and below the alley and easement. Recommendation It 15 recommended that the City Council: 1. Conduct a public hearlng as set by Resolution No. 5335(CCS); 2. Accept for filing the attached Drawing No. 4246; and 3. Adopt the attached Resolution ordering the vacation of the subject alley. The City Council of the City of Santa Monica, in vacating said portion of said First Court, hereby intends to make said vacation conditional on the reloeation of a water main, power and telephone lines, a gas line, abandoning and constructing alley approaches, relocating a san1tary sewer, constructing an alley and other appurtenant work. That the hour of 7:30 p.m. of the 14th day of August, 1979, in the Council Chamber in the City Hall, Santa Monica, California, be and the same hereby is fixed as the time and place when and where all persons interested in or objectlng to the proposed vacation and abandonment may appear before the City Couneil and offer evidence in relat10n thereto. That the Street Superintendent of the City of Santa Monica hereby is directed to cause Notices of Street Vacation to be posted as required by the Street Vacation Act of 1941, being Division 9, Part 3 of the Streets and Highways Code, and the City Council hereby elects to proceed under the provisions of said act. THE CITY COUNCIL OF THE CITY OF SANTA rIDNICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the C1ty of Santa Monica having heard the evidence offered in relation to the proposed vacation of that portion of the alley known as First Court, 20 feet wide, from Arizona Avenue to 200 feet northwesterly, as shown on amended map of Town of Santa Monica recorded in Book 39, pages 45 et seq. of Miscellaneous Records, in the office of the Recorder of Los Angeles County, hereby finds from all of the evidence submitted that the portion of the court above referred to and proposed to be vacated by Resolution No. 5335 (City Council Series) is unnecessary for present or prospective street purposes. Mayor and City Council FROM: City Staff SUBJECT: Vacation of First Court from Arizona Avenue to 200 feet Northwesterly Thereof Introduction This report is request1ng the City Council to adopt a Resolution of Intention for the vacation of a port1on of an alley known as First Court between Arizona Avenue and 200 feet northwesterly thereof, and setting a date for a public hearing for the proposed vacation on August 14, 1979. Background By letter dated August 21, 1978~ Mr. Ted R. Lennon requested a determination by the C1ty Engineer as to the feasibil1ty of the City vacating the subject a 11 ey. Letter and Sketch are attached. This request was for the purpose of constructing an office building, known as Arizona Plaza, across the alley proposed to be vacated. Since that t1me, the developers have recelved the appropriate approval by the Planning Comm1ssion, the City Counc1l, and a permit from the South Coast Regional Commission. Mr. Ted R. Lennon has contacted the abutting property owner, F1rst Presbyterian Church, and received approval for the proposed alley vacation. There are util1ty relocation costs that will be financed by the developer. The existing alley and relocated alley are shown on the attached drawing. In order to accomplish the relocation, we are requesting vacation of the alley in those areas where it will be covered by our proposed building. We further request that the City accept dedication of the relocated alley from the point of vacation to the exit on Second Street. The dedication for the portion of the alley to be beneath the proposed building should be limited to a height of approximately 20 feet, the underside of the office building above. We also request that the vacation and dedication allow for relocation of the existing utility improvements within the alley. BACKGROUND At its March 251 1986 meeting, the City council adopted Resolution Number 7182 (CCS) , declaring its intention to order the vacation of that portion of 28th street described in an accompanying legal description and depicted on Ci ty Drawing No. 4321- A public hearing was set forth April 22, 1986 . concern long such proposed vacation and notice thereof was duly published. In conjunction with the construction of Clover Park during 1978 to 1979, 28th Street was extended southward from Ocean Park Boulevard for approximately 750 feet. Plans were also prepared 1-A - 1 - APR2 2 1986 for a further exte!ll!n of 28th street cont~ng westward along the southern border of Clover Park. Although this western extension was never completed, the Official Tract Map (recorded on August 15, 1978) depicts such westward extension as an existing portion of 28th street. currently, only a curb and gutter exist. In order to correct the Tract Map it is necessary to officially vacate this portion of 28th street to properly reflect the non-existence of such portion as an extension of 28th street, and a public access route. Vacation of this portion of 28th street would permit development of the Airport perimeter road and would allow the extension of Clover Park. Easements would be reserved over part of the vacated street for public access to the park and maintenance of pUblic utilities. Another portion of the vacated street would be reserved for use as the Airport perimeter road, and a third portion of such vacated street would comprise part of an athletic field for the Clover Park extension. In order for the vacation to be complete, the City Clerk must have a copy of the accompanying resolution recorded in the office of the County Recorder of Los Angeles. TO: Mayor and City Council FROM: City Staff SUBJECT: vacation of an Undeveloped Portion of 28th street Adjacent to the Santa Monica Airport and within Extended Boundary of Clover Park INTRODUCTION This staff Report requests that the city Council adopt a resolution declaring its intention to vacate a portion of 28th street adjacent to the Airport and within the recently extended . Clover Park and set a pUblic hearing on the proposed vacation for April 22, 1986. BACKGROUND In conjunction with the construction of Clover Park during 1978 to 1979, 28th street was extended southward from Ocean Park Boulevard for approximately 750 feet. Plans were also prepared for a further extension of 28th street continuing westward along the southern border of Clover Park. Although this western extension was never completed, the Official Tract Map (recorded on August 15, 1978) depicts such westward extension as an existing portion of 28th street. Currently, only a curb and . gutter exist. In order to correct the Tract Map it is necessary ~b "-E. - 1 - MaR 2 5 198fi ~ '" ~ e tit to officially vacate this portion of 28th street to properly e reflect the non-existence of such portion as an extension of 28th street, and a public access route. vacation of this portion of 28th street would permit development of the Airport perimeter road and would allow the extension of Clover Park. An easement would be reserved over part of the vacated street for public access to the park. Another portion of the vacated street would be reserved for use as the Airport perimeter road, and a third portion of such vacated street would comprise part of an athletic field for the Clover Park extension. In order for the proposed vacation to proceed, the Council must declare its intent to vacate this portion of 28th street. . It is also necessary for the City Council to set a public hearing on this matter for April 22, 1986. BUDGET/FINANCIAL IMPACT There is no budget/financial impact from this action. Background Recently staff was contacted by the property owner of 242l Washington as to the feasibility of the city vacating a portion of an alley known as Washington Place North. The purpose of this request is to facilitate the expansion of an existing garage. This particular alley is only 5 feet in width and is of no use to the City for street purposes nor are there any existing utility easements or any future need for easements in this alley. vacation of this alley will result in minor savings to the City because the City will no longer need to maintain this property. It is customary for the City to accommodate requests like this in situations where there is a dead-end alley of no use or benefit 1-5 SEP 2 3 ljtti -~ e e to the City and when the vacation will reduce City expenditures and raise revenues through additional property taxes. On August 26, 1986, the City Council set a public hearing for September 23, 1986. Adjacent property owners were notified of the pUblic hearing and the area was posted on September 8, 1986, as set forth in section 8322 of the streets and Highways Code. Two letters of support from adjacent property owners are attached. The letter from the property owner of 948 25th street, however, supports the vacation only if Ms. David is required to remove the vine growing on this area. staff will make this a condition of the execution of the vacation if approved by the City Council. BUdget/Financial Impact There is only a minor (less than $lOO per year) cost savings to the city resulting from reduced maintenance costs. Recommendation It is recommended that Council: l. Open the public hearing; 2. Close the public hearing and acknowledge any protests; 3. Approve the removal of the vine growing in the area to be vacated by the property owner of 2421 Washington before execution of vacation; and 4. Background Recently staff has beep cor.tacted by the property owper of 2421 Wash~ngton as to the feaSIbIlIty of the CIty vacating a portIon of an alley known as Washir.gton Place North. The purpose of thIS request IS to faCIlItate the expapsIon of an eXIstIng garage. ThIS partIcular alley 1S only 5 feet 1n w1dth and IS of no use to the C1ty for street purposes nor are there any existing utIlIty easements or any future r.eed for easements in this alley. VacatIon of thIS alley will result In mInor saVIngs to the CIty because the CIty WIll no longer need to maIntaIn thIS property. Background Mr. Stephen A. Greene, owner of the property adjacent to the proposed vacation area, has requested that the City vacate a portion of Dewey street located between Fourth Court and Fifth street. The proposed vacation area is indicated on the attached Drawing No. 4413 on file in the Office of the City Engineer. This segment of street consists of an unpaved overgrown hillside used exclusively for sewer and water line easements. The area is fenced on three of four sides, wi th a common fence between the Southeasterly line of said area and the Northwesterly line of the adjacent portion of land, said portion being a vacant segment of alley in the city of Los Angeles, fenced on four sides. Neither portion of Dewey Street in the City of Santa Monica and the city of Los Angeles is a vehicular or pedestrian right-of-way. Mr. Greene, who owns all of the real property adjoining the alley segment, has stated that the additional space resulting from this vacation will be used for landscaping. -(-'8 APK 12 1988 e e since City sewer and water lines exist in a portion of the area to be vacated, Mr. Greene will grant the city an easement for access as well as maintenance of these utilities. On March 8, 1988, the City Council set a public hearing for April l2, 1988 to vacate a portion of Dewey street. The vacation will result in the benefits of absolving the City of any liability by relinquishing legal control of this area and improving the aesthetic quality of the City. Budget/Financial Impact There is no bUdget/financial impact resulting from this recommendation. Recommendations It is recommended that the City Council: 1- Open the public hearing; 2. Close the public hearing; and 3. Acknowledge protests and adopt the attached resolution ordering the vacation.
