SUBJECT:Professional Service Contract with Twinings Laboratories of Southern
California, Inc. for Material Testing and Inspection Services for the
Construction of the Santa Monica Public Safety Facility
Introduction
This report recommends that the City Council authorize the City Manager to negotiate
and execute a professional services contract with Twinings Laboratories of Southern
California, Inc., in an amount not to exceed $181,175, plus $34,700 in contingencies, for
material testing and inspection services for the construction of the Santa Monica Public
Safety Facility.
Background
On October 24, 2000, the City Council awarded a construction contract for the Public
Safety Facility. State and local laws require that independent testing and inspection
services be performed for the Public Safety Facility construction. These material
inspection and testing services provide an independent review of the construction
means and help ensure that potential problems with construction materials or
installations are immediately identified and corrected. The services include inspection
and testing of concrete, steel and masonry materials and methods used in the
construction of the project.

Discussion
Requests for proposals for material testing and inspection services were sent to six
firms on May 10, 1999. Five firms responded with proposals. On August 18, 1999 the
City contracted with United to perform material and inspection services. However, on
April 2, 2001, a letter of termination for contract non-performance was sent to United.
Labor issues related to United?s payment structure made it necessary to contract with a
firm that adhered to union scale pay rates for it?s on site personnel.
Staff recommends Twining Laboratories of Southern California, Inc., currently the best
firm from the original requests for proposals, to complete material testing and inspection
services. Twining Laboratories of Southern California, Inc. has demonstrated
experience with similar projects, a strong record of performance, favorable references,
and a fee that realistically addressed scope, difficulty and duration of work.

Contract $181,175
Contingency $ 34,700
Total Funds Required $215,875
Funds in the amount of $215,875 are available in account C01005801.589000, Police/
Fire/ Emergency Ops Facility.?

Recommendation
Staff recommends that the City Council:
1. Authorize the City Manager to negotiate and execute a professional services
contract with Twinings Laboratories of Southern California, Inc., in an amount not
to exceed $181,175 plus $34,700 in contingencies, for material testing and
inspection services for the construction of the Santa Monica Public Safety
Facility; and
2. Authorize the City Engineer to issue any necessary change orders to complete
additional work in conformance with the Administrative Instructions on change
orders.
