SR-506-003-07 (3) EPWM: CP: AA: DB:JCF:\DATA\SPFILES\SP1862\CC1862-3.doc Council Meeting: February 27, 2001 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Recommendation to Award a Contract for the Adelaide Drive Street Lighting and Circuit Conversion Project Introduction This report recommends that the City Council award a contract to Benergy, Inc., the best bidder, in the amount of $159,540 for construction of the Adelaide Drive Street Lighting and Circuit Conversion Project and approve $20,460 in contingency funds for this contract. Background During the fiscal year 1999-2000 budget process, the City Council appropriated funds under the Streetlight Retrofit Program to replace deteriorated series electrical circuits and streetlights on certain streets within the City with modern, reliable, multiple circuits th and streetlights. Staff identified Adelaide Drive between Ocean Avenue and 7 Street th and Adelaide Place east of 7 Street to receive the upgrades. Discussion A Notice Inviting Bids for the construction contract was published on December 8 and 10, 2000 in The Los Angeles Times, Our Times and the F. W. Dodge newsletter. 1 Ten contractors requested bid packages and the City Clerk's office received eight sealed bids, which were publicly opened and read aloud on January 17, 2001 by the Deputy City Clerk. The bid results were as follows: 1. Benergy, Inc. $159,540 2. LA Signal $165,490 3. National Electrical Contractor $168,000 4. CT&F, Inc. $178,803 5. Pima $180,800 6. Miramar Construction, Inc. $184,735 7. California Electric Services $185,500 8. Taft Electric $248,537 City Engineer's Estimate $175,000 Benergy, Inc. supplied the City with the names of previous projects of a similar nature built by their firm including construction of street lighting for the cities of Pomona, Garden Grove and Lomita. All contacts reported that the quality of their work was satisfactory and they performed this work in a timely and cost efficient manner. The California State Contractors' License Board verified Benergy's license is current, active and in good standing. Staff also contacted the Center for Contract Compliance and found Benergy, Inc. capable of handling labor compliance issues. Further, Benergy, Inc. has the ability to provide future maintenance, should the City require these 2 services. On January 20, 2001, the City received a bid protest from L.A. Signal stating that Benergy, Inc. failed to note receipt of Addendum #3 on the bid documents. Benergy, Inc. confirmed that Addendum # 3 was considered in the preparation of its bid and provided written acknowledgement of receipt. Staff consulted with the City Attorney?s office and determined that this is a minor irregularity and therefore recommends Benergy, Inc. as the best bidder. Recommendation Staff recommends that the City Council: 1. Award a contract to Benergy, Inc., the best bidder, in the amount of $159,540 for construction of the Adelaide Drive Street Light and Circuit Conversion Project and approve $20,460 in contingency funds; and 2. Authorize the City Engineer to issue any necessary change orders to complete 3 additional work in conformance with the Administrative Instructions on change orders and within budget authority.
