SUBJECT: Ordinance Requiring Vehicles to be Moved Within Time Limits
Introduction
This report recommends that the City Council introduce for first reading an Ordinance of
the City Council of the City of Santa Monica Requiring the Removal of Vehicles From
Time-Limited Parking Zones Within the Time-Limited Periods, And Amending the Santa
Monica Municipal Code.
Background
In order to improve access to parking spaces, the City of Santa Monica has established
time-limited parking zones along some streets and other places. Many of these zones are
within preferential parking districts. The purpose of the time limits is to provide greater
access to spaces for short-term parking by prohibiting long-term parking and increasing
turnover of each parking space. Some motorists attempt to comply with the time limits by
moving their vehicles short distances only.
Discussion
The proposed regulation requires that motorists move their cars 500 feet (at least one

block) in order to comply with time limits. Notice of the regulations will be posted on signs
on each block in which they are effective. The ordinance was prepared at the request of
Parking Enforcement, as a means of strengthening the effectiveness of parking
enforcement in areas with parking time limits.
Financial/Budget Impact
This ordinance is expected to have minimal impact on the City?s enforcement costs or
revenues.
Recommendation
It is respectfully recommended that the attached ordinance be introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA REQUIRING THE REMOVAL OF VEHICLES FROM TIME-
LIMITED PARKING ZONES, WITHIN THE POSTED TIME LIMITS, AND AMENDING
THE SANTA MONICA MUNICIPAL CODE
Whereas the purpose of time-limited parking is to provide greater access to spaces
for short-term parking by prohibiting long-term parking and increasing the turnover of each
space; and
Whereas motorists may attempt to circumvent these regulations by moving their
vehicles for short distances only; and
Whereas time limited parking can fulfill its purpose if motorists are required to move
vehicles parked in any time-limited space a minimum distance of 500 feet, prior to the
expiration of the time limit.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. The Santa Monica Municipal Code is amended by adding
Section 3.12.845:

Section 3.12.845:
(a) Any person who parks a vehicle on a public street or place where the City has
installed signs, notices or markings establishing parking time limits is required to remove

said vehicle prior to the expiration of the time limit and the vehicle shall not be parked
within 500 feet of its previous parking location on a public street or place in which time-limit
parking is in effect unless a minimum of twelve (12) hours has elapsed since the vehicle
was previously parked on the regulated public street or place.
(b) Any person violating this Section shall be guilty of an infraction, which shall be
punishable by a fine not exceeding Two Hundred Fifty Dollars ($250.00).
SECTION 2. Notice of these regulations shall be posted as directed by the City
Manager or his or her designee.
SECTION 3. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
effect the provisions of this Ordinance.
SECTION 4. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed
this Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. The City Clerk shall cause the same to be published once in the official

newspaper within 15 days after its adoption. This Ordinance shall become effective 30
days from its adoption.
