SR-506-003-07 EPWM:CC:AA:SG f:\data\spfiles\SP1797\cc1797.doc City Council Meeting: June 13, 2000 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Recommendation to Accept Petitions for Installation of Street Lights and Set a Public Hearing on September 12, 2000 Introduction This report recommends that the City Council accept petitions submitted by residents and set a public hearing in accordance with Proposition 218 for the formation of a street light assessment district on the following streets: District Ozone Avenue - from Lincoln Boulevard to Frederick Street A District Dewey Street - from 17th Street to 23rd Street B District Robson Street - from 17th Street to Dewey Street C District Marine Street - from Lincoln Boulevard to 17th Street D District Strand Street - from 5th Street to 6th Street E District Frederick Street - from Marine Street to Dewey Street F Background In accordance with the Improvement Act of 1911, Proposition 218, and Santa Monica Municipal Code 7.04.860, whenever 60 percent of the occupants of the residential units in any area petition the City Council to institute proceedings for residential street lighting, the City Council shall institute proceedings to provide residential street lighting to the area. 1 Successful petitions (those with greater than 60 percent support) have been received from residents on these streets: District Ozone Avenue - from Lincoln Boulevard to Frederick Street A District Dewey Street - from 17th Street to 23rd Street B District Robson Street - from 17th Street to Dewey Street C District Marine Street - from Lincoln Boulevard to 17th Street D District Strand Street - from 5th Street to 6th Street E District Frederick Street - from Marine Street to Dewey Street F In accordance with Proposition 218, notice of the proposed assessment and ballots for the street lighting improvements will be sent to the owners of record of those properties benefiting from the street light installation. The public hearing will be set in accordance with all legal requirements. At the public hearing, the City Council will consider all objections or protests, if any, to the proposed establishment of the assessment districts and the levy of the assessments for the street lighting improvements. Any interested person will be given the opportunity to present written or oral testimony at the public hearing. At the conclusion of the public hearing the City Council will tabulate the assessment ballots to determine whether the assessments will be levied. Discussion On August 9, 2000, a public meeting will be held at 7:00 p.m. at the Main Library Auditorium to discuss the type, location, and approximate cost of the streetlight. 2 The public hearing on the proposed assessment is scheduled for September 12, 2000. Notices of the City?s intent to form an assessment district and hold a public hearing will be mailed to owners/occupants forty-five (45) days in advance of the public hearing in accordance to State law. In addition to the notice, record owners will be sent a ballot with which they will be able to vote for or against the assessment. A list of properties and the assessment map will be available to the City Council at the time of the public hearing. Owners may return their ballots by mail or deliver them to the City Clerk prior to the close of the public hearing. At the hearing the City Council will hear all objections and protests, if any, to the proposed assessment. At the conclusion of the public hearing, the assessment ballots submitted and not withdrawn, in support of or in opposition to the proposed assessment will be tabulated. No assessment will be imposed if there is a majority protest. A majority protest exists if, upon the conclusion of the hearing, ballots submitted in opposition to the assessment exceed the ballots submitted in favor of the assessment. Tabulation of the assessment ballots will be weighted according to the proportional financial obligation of the affected property. Budget/Financial Impact The total estimated cost for this project is $610,000 which includes labor and incidental costs such as staff time for engineering surveys, public notifications, advertisements, 3 construction management, inspections, and construction costs. The estimated breakdown of costs is as follows: Estimated property owner assessments $ 218,000 Estimated City contributions $ 392,000 Total project estimate $ 610,000 If the majority of the voters support the proposed assessment, funds in the amount of $392,000 are currently available in account number CO1072400.589000 for the City?s portion of the project. The remaining costs for the project will be paid through property owner assessments and held in Trust Account No. 80.201181 Recommendations Staff recommends that the City Council: 1.
