O725ORDINANCE N0, 725 (CITY COUNCIL SERIES) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING A PARKING AND BUSINESS IMPROVEMENT AREA TO PROVIDE FOR THE LEVY OF AN ADDITIONAL BUSINESS LICENSE TAX THEREIN FOR THE GENERAL PROMOTION OF RETAIL TRADE ACTIVITIES IN THE AREA WHEREAS, under and pursuant to the provisions of the Park- ing and Business Improvement Area Law of 1965 (Part 5 of Division 18, commencing with Section 36000, of the Streets and Highways Code, here- I inafter sometimes referred to as "said Law") this City Council on September 13, 1966 adopted Resolution No. 3496 (CCS) entitled "A Resolution of the City Council of the City of Santa Monica, California, r Declaring Its Intention to Establish a Parking and Business Improve- ment Area, to Provide for the Levy of an Additional Business License Tax Therein, and Fixing Time and Place of Hearing to Consider Es- tablishment of Such Area"; and WHEREAS, said Resolution No. 3496 (CCS) was duly published, and copies thereof were duly mailed and posted, all as provided by said Law; and WHEREAS, as specified in said Resolution No. 3496 (CCs) a hearing concerning the formation of said area was held before this City Council on October 2S, 1966, at the hour of 7:30 o'clock P.M. in the Council Chambers in the City Hall of the City of Santa Monica; ��xAiv�'►rr. and WHEREAS, at said hearing all written and oral protests made or filed were duly heard, evidence for and against the proposed action W. was received, a full, fair and complete hearing was granted and held, and this City Council is fully advised in the premises; and a. WHEREAS, at said hearing all protests, both written and oral, made or filed were duly overruled and denied and this City Council determined that there is no majority protest within the mean- :` ing of Section 36023 of the Streets and Highways Code. x„ 72, y'�R1 w NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN XS FOLLOWS rkin and business ^ECTION 1. That pursuant to said Law a Pa g improvement area has been and is hereby established, and a description of the boundaries of said area is as follows= the center "Bounded on the northeasterly side by line of !;eventh Street, the southeasterly side by the cen- ter line of the Santa Monica Freeway, the southwesterly side by the center line of Ocean Avenue, and the northwest- erly side by a line 200 feet northwesterly of the center line of ciilshire Boulevard." SECTION 2. That in addition to the general business license tax (sometimes called business license fee) an additional business license tax is hereby imposed upon merchants holding a retail lsaics tax permit and occupying premises in the area. That this City Council hereby finds and deter- mines that the public convenience and necessity require the establish- y ment of the area hereinbefore described. 1 SECTION 5. All protests, both written and oral, are over- ruled and denied and the City Council finds that there is no majority protest within the meaning of Section 36023 of the Streets and High- ways Code. SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen days after its adoption. This ordinance shall become effective after thirty days from its adoption. ADOPTED this 22nd day of November 1966.
