O2288City Council Meeting 4 -28-09 Santa Monica, California ORDINANCE NUMBER 22as (CCS) (City Council Series) AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS 9.04.08.18.020 AND 9.04.08.20.020 TO PERMIT PAWNBROKERS AS PERMITTED USES IN THE C3 DOWNTOWN COMMERCIAL AND C3-C DOWNTOWN OVERLAY DISTRICTS WHEREAS, under current Zoning Ordinance provisions, pawnbrokers may lawfully locate only in the BSC Bayside District; and WHEREAS, there is lack of suitable and available sites in the BSC district; and WHEREAS, the broader downtown area, which includes the C3 Downtown Commercial and C3-C Downtown Overlay districts, provides an appropriate location for pawnbrokers in addition to the BSC district area; and WHEREAS, permitting pawnbrokers in the C3 and C3-C districts is consistent with the general intent and purpose in the Zoning Ordinance and Land Use Element in that the uses in these districts are intended to provide a high concentration of activity with uses that serve a broad spectrum of people; and WHEREAS, in these challenging economic times, existing Zoning Ordinance provisions relating to pawnbrokers pose a current and immediate threat to the public health, safety and welfare, and that pending completion of review and revision of Zoning Ordinance amendments, it is necessary on an interim basis to modify certain zoning standards to allow pawnbrokers to locate in downtown business locations; 1 NOW, THEREFORE, THE COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. In addition to the uses set forth in Santa Monica Municipal Code Section 9.04.08.18.020, the following use shall be permitted in the C3 Downtown Commercial District: Pawnbrokers. SECTION 2. In addition to the uses set forth in Santa Monica Municipal Code Section 9.04.08.20.020, the following use shall be permitted in the C3-C Downtown Overlay District: Pawnbrokers. SECTION 3. This ordinance shall be of no further force and effect after sixty days from its adoption unless prior to that date, after a duly noticed public hearing, the City Council; by majority vote, extends this interim ordinance. SECTION 4. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 5. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage 2 of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective 30 days after its adoption.
