A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA TO SUPPORT THE LEGAL CHALLENGE TO THE
CONSTITUTIONALITY OF PROPOSITION 8
WHEREAS, the principle of equal protection under the law is one of the
foundations of Santa Monica, California, and United States government; and
WHEREAS, Proposition 8 on the November 4, 2008 California ballot denied
same-sex couples the protections of true. civil marriage; and
WHEREAS, this denial of marital status singles out same-sex couples for
unequal treatment; and
WHEREAS, access to the dignity and respect of legally-recognized civil marriage
should not be unfairly or unequally abridged; and
WHEREAS, on September 16, 2008, the City Council of the City of Santa Monica
voted unanimously, 7-0, to oppose Proposition 8; and
WHEREAS, on November 4, 2008, Santa Monica voters likewise opposed
Proposition 8, by approximately 78% to approximately 22%; and

WHEREAS, the City and County of San Francisco, the City of Los Angeles, the
County of Los Angeles, and others, have filed a legal challenge to the constitutionality of
Proposition 8;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City of Santa Monica expresses support -for the
aforementioned challenge to the constitutionality of Propositions 8, and reaffirms our
City's commitment to true equality for all Califorhians.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
