R-10356RESOLUTION NO. .10356 (ccs) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA .ADOPTING THE NEGATIVE DECLARATION FOR THE 2008-2014 HOUSING ELEMENT WHEREAS, a Notice of Availability of an Initial Study and Draft Negative Declaration for the City of Santa Monica 2008-2014 Housing Element was published in the Santa Monica Daily Press on July 18, 2008, in compliance with the California Environmental Quality Act (CEQA) and the City of Santa Monica CEQA Guidelines; and WHEREAS, staff mailed and e-mailed the Notice of Availability to interested parties on the City's mailing list; and WHEREAS, the Initial Study and Draft Negative Declaration were made available for public comment for 30 days which ended do August 18, 2008 and one comment was received and a response was provided; and WHEREAS, on October 1, 2008, the Planning Commission reviewed the Final Initial Study and Negative Declaration and recommended that the City Council adopt the Negative Declaration for the City of Santa Monica 2008-2014 Housing Element, NOW, THEREFORE, THE. CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council has reviewed and considered the Initial Study and Negative Declaration, together with .any comments received during the public review process, prior to acting on the project.. SECTION 2. The City Council finds, based on the whole record before it, including the Initial Study and Negative Declaration and any comments received, that there is no substantial evidence that the Project will have a significant effect on the environment, and that the Negative Declaration reflects the Citys independent judgment and analysis. Therefore, the City Council hereby approves the Negative Declaration. SECTION 3. Consistent with Public Resources Code Section 21081.6 (a) (2), the documents which constitute the record of proceedings for approving this project are located in the Planning and Community Development Department, 1685 Main Street, Room 212, Santa Monica, California. The custodian of these records is Elizabeth Bar-EI, AICP, Senior Planner in the Community and Strategic Planning Division of the Planning and Community Development Department. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
