NO: 10319 (ccs) {City Council Series) A RESCLUTIflN OF THE CITY".COUNCIL OF THE CITY OE SANTA t~ONIGA AUTHORIZING WAIVER OF i3lDDlNG REQUIREMENTS FOR PUBLIC WORKS PROJECTS Pt1RSUANT TO MUNICIPAL CODE SECT]ON 2.24.071(d}(1),FOR THE CONSTRUCTION OF FACADE IMPROVEMENTS INCLUt?lNG PEDESTRIAN ORIENTED SPADES AND SOLAR PHOTCIVOLTAIC {PV) SYSTEMS AND INSTALLATION OF ATTENDANT PARKING IMPROVEMENTS AT PARKING STRllCTURES 7 AND 8 WHEREAS, the. Redevelopment .Agency. of the City of Santa Monica ("Agency") awns parking structures 7 and 8 and the City of Santa Monica ("City") is a lessee of parking strut#ures 7 and 8; and WHEREAS, as au#horized by Sectian 33400 of the Health and Safety Cade the Agency as the owner may maintain, manage, and repair those. structures; and, WHEREAS, the Agency wishes to :delegate to the City the Agency's authority to carry out the consfruction of fagade improvements including. pedesfrian oriented spaces and solar photovol#aic systems and installation of attendant parking improvements at Parking Structures 7 and, 8 (thee"Project") and. the City wishes to accept that delega#ion, pursuant to Sectian 33205 of the Flealth and Safety Code; and, WHEREAS, to ensure coordination between the Project and the Santa Monica Place. Remodel project;. which requires removal of a portion of Parking Structure 7, and to significantly maximize time and costs savings, the Citywishes to assign the.Macerich Company ("Macericn"} to carryo0t the Project; and; WHEREAS,. pursuant to Section 2,24A71 cf fhe Municipal Code, the Pro;ect would be considered a public works project with a contract involving .more than One-Hundred Thousand Doliats ($100,000:00}, and let #o the best bidder after natioe by publication.. in a newspaper of general circulation in the City of Santa Monica; and, WHEREAS, pursuant to Section 2.24,071(e){1) of the Municipal Cade, the City Council may be two-thirds affirmative vote of its membership, forego the bidding procedures otherwise required. by Seciion 2.24.0'71 of fhe Municipal Code if the City Council finds that fhe goods or services can be purohased more economically on the open market; and, WHEREAS, the City Council finds that by foregoing the bidding requirements, the Project will be more economical by significantly reducing its cost to the City, minimizing construction period disruptions, and shortening the time period that the public parking structures will be out of operation. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AND ORDER AS FOLLOWS SECTION 1. Pursuant to Municipal Code Sections 2.24.071(d)(1), the City Council hereby authorizes the City Manager to forego the bidding procedures otherwise required for the Project at Parking Structures 7 and 8.
