A RESflIUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA N1ONICA
CONSENTING TO THE USE OP AGENCY FUNDS FOR THE
CONSTRUCTION OF FACADE iMPROVEtvlENT5 INCLUDING
PEDESTRIAN ORIENTED SPACES AND SOLAR PHOTC)VOLTAIC {PV}
SYSTEMS, AND. INSTALLATION OF ATTENDANT PARKING
IMPROVEMENTS AT PARKING STRUCTURES SEVEN AND EIGHT
AND MAKING CERTAIN FINDINGS Pi1RSUANT TO HEALTH AND
SAFETY CODE SECTION 33445
WHEREAS,. the Redevelopment Agency of the City of Santa Monica {the'Agency"}
has prepared a Redevelopment Plan far the Santa Marica Earthquake Recovery
Redevelopmen#Projeat {the "Redevelopment Plan"} which would resultin the allocation of
taxes from the Santa Monica Earthquake Recovery Redevelopmen# Project Area (the
"Projeat Area"} to the Agency for the purposes of redevelopment; and
WHEREAS,. the in#ent pf the Redevelopment Plan is, in part, to provide for and
facilitate the repair,. restoration andlor#eplaoement of facilities damaged as a resultof a
disaster and to perform specific actions necessary to prevent ormitigate againstthe effects
of a disaster; and
WHEREAS, the Agencyowns Parking Structures Seven and Eign# and is authorized
by Section 33400. at the Heaikh and Safety Code to maintain, manage, and repair this.
structure; and;
WHEREAS, the Agency wishes to delegate to the: Cify ofi Santa Monica {the"City°}
the-Agency's authority to carry outthe construction of fiadade Impraveinents including:
pedestrian oriented spaces and solar photovoltaic {PVj panels, and installation of attendant
parking controls {the "Project"} and'tne City wishes to accept that delegation, pursuant to
Section 33205 of the Health and Safety Cade; and
WHEREAS, the Agency wishes to fund the: Project with funds from, the Santa
Monica Earthquake Recovery Redevelopment Project; and
WHEREAS, the City and Agency have prepared. a Cooperation Agreement to
provide a means of carrying out the Praject~ and
WHEREAS, Section 33445(a} of the }ealth and Safety Code. authorizes a
redevelopment agency, with the consent of the legislative body and. if the agency and the.
legislafive body make certain determinations specified in Section 33445, to pay ail ar part.
of the cost of construatian and installation of any publicly owned impro~iement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds and determines:
(1) that the Project is of benefit to the Project Area;
(2) that no reasonable means of financing the Project other than that set forth in the
Reimbursement Agreement is available to the community;
(3) that the payment of funds for the Project will assist the recovery from, and the
elimination of one or more of the conditions resulting from, the 1994 Northridge
Earthquake disaster;
(4) that the payment of funds for the Project will assist in elimination of one or more
blighting conditions inside the Project Area by assisting in the elimination of one or
more of the conditions resulting from the 1994 Northridge Earthquake disaster; and
(5) that the Project is consistent with the implementation plan adopted pursuant to Section
33490.
SECTION 2. The City Clerk shall certify the adoption .of this Resolution and
thenceforth and thereafter the same shall be in full force and effect.
