A RESOLUTION dF THE REDEVE~dPMENT AGENCY
Of THE CITY OF SANTA MONICA
CONSENTING TO THE USE dF AGENCY FUNDS fOR THE
CONSTRUCTION Of fA~ADE IMPROVEMENTS INCLUDING
PEDESTRIAN ORIENTED SPADES AND SOLAR PHOTOVOLTAIC {PV)
SYSTEMS, AND INSTALLAT{t)N OF ATTENDANT PARKING
IMPROVEMENTS AT PARKING STRUCTURES SEVEN AND E1GHT
AND MAKING CERTAIN FINDINGS PURSUANT TO HEALTH ANf3
SAFETY CODE SECTION 33445
WHEREAS, the Redevelopment Agencyof the Ciiyof Santa Monica.{the "Agency"}
has prepared a Redevelopment Plan for the Santa Monica Earthquake Recovery
Redevelopment Project {the"Redevelopment Plan")which would result in the allocation of
taxes from the Santa Monica Earthquake Recovery Redevelopment Project Area (the
°Project Area"} to the Agency #or the purposes of redevelopmen#; and.
U1IHEREAS, the intent of the Redevelopment Plan. is, in part, to provide for and
facilitate the repair,. resforatiori andlor replacement of facilities damaged as a result of a
disaster and to perform specific actions tjecessary to prevent or mitigate against the effects
of a disaster, aad
WHEREAS, the Agency owns Parking Structures Seven and Eigh# and is authorized
by Section 33400 of the Health and, Safety Code to maintain, manage, arjd repair this
structure;: and,
WHEREAS, the Agency wishes to delegate to the City of Santa Monica (the „City;,),
the Agency's authority to carry out the constnaction of facade improvements including
pedestrian oriented spaces and solarphotovoltaio {PV) panels, and insta8atitn of attendant
parking controls {the "Project°) and the City wishes to accept that delegation, pursuant to
Section 33205 of the Health and Safety Cade; and
WHEREAS, the Agency wishes to fund the Project-with funds from. the San#a
Monica Earthquake Recovery Redevelcipmenf Project; and
WHEREAS, the City and Agency have prepared a Cooperation Agreement to
provide a means of carrying ou# ttie Project; and
WHEREAS, Section 33445{a)' of the Health and Safety Code authorizes a
redevelopment agency, with the. consent of the legislative body and if the agencyand the
legislative body make certain determinations specified in Section 33445, to pay all orpart
of the cost of construction and instaifation of any publicly owned. improvement:
NOW, THEREFORE, THE REDEVELOPMENTAGENCY OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The Agency hereby finds and determines:.
(1) that the Project is of benefit to the Project Area;
(2) that no reasonable means of financing the Project other than that set forth in the
Reimbursement Agreement is available to the community;
(3) that the payment of funds for the Project will assist the recovery from, and the
elimination of one or more of the conditions resulting from, the 1994 Northridge
Earthquake disaster;
(4) that the payment of funds for the Project will assist in elimination of one or more
blighting conditions inside the Project Area by assisting in the elimination of one or
more of the conditions resulting from the 1994 Northridge Earthquake disaster; and
(5) that the Project is consistent with the implementation plan adopted pursuant to Section
33490.
SECTION 2. The Secretary of the Agency shall certify the adoption of this
Resolution and thenceforth and thereafter the same shall be in full force and effect.
