R-10322RESOLUTION NUMBER 10322 CCS (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING WASTEWATER RATES WHEREAS, the City Council may establish, amend or revise from time to time by resolution the rates and service charges to be charged for supplying wastewater service to any customer pursuant to Section 7.04.540 of the Santa Monica Municipal Code; WHEREAS, the City faces increased costs of providing wastewater service to its customers; WHEREAS, the City wishes to encourage water conservation by revising the wastewater rate structure; WHEREAS, the City, in accordance with Article XIII D Section 6 of the California Constitution, mailed a notice of proposed wastewater rate increases for a five-year period beginning August 1, 2008 through July 1, 2012. to the owner of record of each parcel in Santa Monica's service area and parcels in the City of Los Angeles who receive wastewater service from the City of Santa Monica. NOW, THEREFORE, THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: Section 1. As of August 1, 2008, or as soon thereafter practical, the fixed sewer charge shall be zero and the costs of service will be recovered through the commodity charge in order to encourage water conservation. Section 2. As of August 1, 2008, or as soon thereafter practical, the sewer discharge factors, to be applied to the metered water usage, are hereby established as follows: Single Famlily 51% Duplex 80% Triplex 85% Fourplex 90% Over Four Units. 95% Individually metered 95% Non-Residential 89% Landscape Meter 0% The Water Resources Manager shall have the authority to make adjustments in discharge factors for individual users where it is determined that the actual quantity of sewage discharge is substantially different from that established by the above list. Section 3. As of August 1, 2008; or as soon thereafter practical, the sewer commodity charges. are hereby established as follows: Sewage Strength Category Rate per HCF~ Residential: $2.94 Non-Residential General Commercial $2.68 Medium Low $2.79 Medium $3.22 Medium High $3.51 High $4.11 Churches $2.64 School, Institutional $2.64 Misc. Industrial $3.26 * HCF = 100 cubic feet Sewage strength values for individual users or various types of users may either be estimated or determined by laboratory analysis, at the direction of the Water Resources Manager. Where sewage strength values are estimated,. they 2 shall be consistent with the current City of Los Angeles Amalgamated System Sewage Generation Factors. No sewage strength .values for non-residential users shall be less than sewage strength values established for residential users. The City may revise sewage. strength values from time to time as deemed necessary to reflect current conditions. In the event any user believes that the sewage strength values established by the City for its sewage discharge are excessive, said user shall have the option of having its sewage sampled and analyzed at its own expense by a laboratory approved by the City. The manner, frequency, and duration of sampling and analysis shall be approved by the City to ensure that resultant sewage strength values are representative of all conditions of discharges. During the same time period when sewage is being analyzed, the user shall pay all sewer service charges based on previously established strength values. Ih the event analyses show actual strength values to be less than or greater than the previously established values, the City shall either refund or bill the user, per SMMC Section 7.12.112, for the difference in charges, as appropriate. Section 4. On August 1, 2008, or as soon thereafter practical, wastewater customers who do not receive water service from the City of Santa Monica will pay their equitable share of wastewater charges based on the typical average single family home using 36 HCF of water bi-monthly and the bi-monthly rate shall be hereby established as $53.98. Section 5. A low-.income allowance will be offered to residential wastewater customers with individual water meters who qualify for the City's 3 Utilities User Tax Exemption Program, the Southern California Gas Co. or the Southern California Edison low-income assistance programs. As of August 1, 2008, or as soon thereafter practical, the residential low-income sewage strength commodity charge is hereby established as follows: $1.42 per HCF Section 6. Maximum rate increases from July 1, 2009 through July 1, 2012 are hereby established as follows: July 1, 2009 18.0% July 1, 2010 15.0% July 1, 2011 9.0% July 1, 2012 4.0% Section 7. Commencing upon July 1, 2013 and on July 1 of each fiscal year thereafter, fees established by this resolution shall be administratively revised annually by a factor equal to the difference in the Los Angeles-Anaheim- Riverside Consumer Price Index for Wage Earners and Clerical Workers for the twelve (12) month period February through February of the prior fiscal year. Section 8. Resolution Number 9671 jCGS) is hereby repealed in its entirety Section 9. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
