R-10306ATTACHMENT D2 RESOLUTION NO. lo3os (GCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REVISING THE WASTEWATER CAPITAL FACILITY FEE WHEREAS, the City Council may establish, amend, or revise from time to time by resolution the City's Wastewater Capital Facility Fee to be charged for any net increase in wastewater discharge pursuant to Section 7.04.460 of the Santa Monica Municipal Code; and WHEREAS, the City desires to amend-the Wastewater Capital Facility Fees that recover the cost of increased demand on the wastewater system; and WHEREAS, the City is required by the City of Los Angeles to collect and transmit Amalgamated System Sewerage Facilities Charges (LA ASSFC) per Contract 7473 (CCS) Section IIC for any net increase in wastewater discharge arising from new development, changes in land use, or increases in discharges from Industrial Dischargers within the City limits. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City's Wastewater Capital Facility Fee for net increase in wastewater discharge shall be as follows: Wastewater Capital Land Use Facility Fee Single Family Residential $2,239 Multi Family Residential 1 Bedroom Unit $1;168 2 Bedroom Unit $1,557 3 Bedroom Unit $1,947 Hotel/Motel $1,265/ unit Commercial $779/1,000 S.f. Laundromats $1,655/machine Restaurants Bar, Sit Down $292/seat Carry Out per $2,920/1,000 s.f. Storage $195/1,000 s.f. Industrial $779/1,000 s.f. For any other land use not listed above, the Wastewater Capital Facility Fee shall be based upon the rate of $9.73 per gallon per day times the Amalgamated System Sewage Generator Factors for the type of land use. Whenever a user of the sewer system changes from one land use to another'; the Wastewater Capital Facility Fee- shall be that of the new land use less that of the old land use. If the new land use has a lower fee than the old land use, no fee shall be imposed and no refund of any previously paid fee shall be granted. Whenever a user of the sewer system causes a significant increase of either the flow or strength of sewage discharged to the system, even though there may be no change in land use, an additional Wastewater Capital Facility Fee may be imposed. SECTION 2. The amount of the LA ASSFC charged to owners or developers of a property will be based on the City of Angeles' Annual Report of Wastewater Flow and Strength Loadings and the Amalgamated System Sewage Generator Factors. Funds collected from owners and developers will be transmitted to the City of Los Angeles on a bi-monthly basis. SECTION 3. Resolution 8304 CCS shall be repealed in its entirety. SECTION 4. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
