The City Council of the City of Santa Monica met in regular session at the above named time and place. The pledge of allegiance was given after which Lt. Craig Fanning, Salvation Army gave the invocation. PRESENT; Councilmen: Nathaniel Trives, Seymour A. Cohen, Fred M. Judson, John W. McCloskey, Christine E. Reed, Donna 0. Swink Pieter van den Steenhoven ABSENT; Councilmen: None ALSO PRESENT; James D. Williams, City Manager Richard L. Knickerbocker, City Attorney E. Douglas McAteer, City Engineer K. 0. Grubb, City Clerk • The minutes of the meeting held October 28th were approved as mailed. Mayor Nathaniel Trives presented thirty year service pins to Toivo E. ~Iarjanen, Paul G. Wohlers and Morris E. Jacobs and twenty year pins to Alfred M. Velez and Joseph E. Syposs and complimented them for their faithfulness and dedication. Reverend Judson commented on resolutions (sponsored by the League) affecting cities that were adopted at the League of California Cities meeting recently held in San Francisco. Reverend Judson moved as follows: Reimburse the revolving cash fund demands of Recreation and Parks $44.49, City Attorney $99.65, Library $32.79, Administrative Services $70.07 and Transportation $92.95. Ratify the Subagreements with the County of Los Angeles extending the CETA II and CETA VI programs. The motion was seconded by Mrs. Reed and carried by the following vote: AYES; Councilmen: Cohen, Judson, McCloskey, Reed, Swink van den Steenhoven, Trives NOES: Councilmen: None ABSENT: Councilmen: None CETA II Contract No. 2153-A (CCS) CETA VI Contract No. 2159-B(CCS) lJ The public hearing was opened to adopt the noise element of the Master Plan of the City. The noise element report dated September, 1975 and accompanying staff report dated October 22 were reviewed. Terry Levy and John Hult spoke after which Mrs. Reed moved to close the hearing. The motion was seconded by Mrs. Swink and carried unanimously. Mr. van den Steenhoven moved to adopt a resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING A NOISE ELEMENT OF THE ~1ASTER PLAN FOR THE CITY OF SANTA MONICA". The motion was seconded by Reverend Judson. Gordon Bricken (OLsen Laboratories, Inc. - that conducted the study) commented on queries regarding the mention in the element (Page 53) that the Santa Monica (Cloverfield) Airport was designated a "problem airport" by State regulations but presently has been removed from that category after which Mrs. Reed moved to amend the motion and instruct the staff to rewrite appropriately (or include in a footnote) the fact that as of the adoption of the element the Santa Monica Airport has been removed from the "problem airport" classification. The motion was seconded by Mr. Cohen and carried unanimously. The motion as amended and adopting the resolution was carried by the following vote: AYES: Councilmen: Cohen, Judson, McCloskey, Reed, Swink van den Steenhoven, Trives NOES: Councilmen: None ABSENT: Councilmen: None Resolution No. 4692 (CCS) CETA II & IV programs Contracts 2153A& 21598 CCS Resolution 4692 Noise Element of Master Plan 33 The public hearing was opened to consider the Seismic Safety Element of the Master Plan. The staff report dated November 10 and the accompanying Seismic Safety Element, dated October 1975, were reviewed. Resolution 4693 Attorney Marvin Levin, John Loos and Ernest Ryavec spoke. Seismic Element of Letters from the Southern California Edison Company and John Loos and the Master Plan one item from a local newspaper were received for file. As no others wished to speak, Mrs. Reed moved to close the hearing. The motion was seconded by Mr. van den Steenhoven and carried unanimously, Mr. van den Steenhoven moved to adopt the resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING A SEISMIC ELEMENT OF THE MASTER PLAN FOR THE CITY OF SANTA MONICA" and further that the contributions made by the public be considered by the staff for future amendments to the element or be included in this document as is deemed necessary. Attorney Marvin Levin and Mrs. Pat Schneider spoke after which Mr. Cohen moved to waive further reading introduce and adopt the ordinance. Numerous persons spoke, after which P1r. McCloskey moved to authorize the City Attorney to prepare an ordinance in conformity with the Belle Terre decision (U.S. Supreme Court) and add any clarification needed to enforce the ordinance. The motion was seconded by Reverend Judson. Mr. van den Steenhoven moved to amend the motion and adopt the Be11e Terre ordinance with the provision that as many as two unrelated persons in the household be allowed in order to accommodate foster children's programs, uncompensated home care activities or uncompensated student placement programs relying on individual home environments as part of their criteria. The motion was seconded by N1r. Trives and carried with Council members Cohen, Judson, Reed, Swink, van den Steenhoven and Trives voting "AYE". The motion as amended was carried with Council members Cohen, Judson, McCloskey, Swink, van den Steenhoven and Trives voting "AYE". At 10:15 P.M. a five minute recess was taken after which the meeting reconvened with all council members in attendance. Limitation on number & relation- ship of persons occupying single dwelling The Planning Commission's and staff's recommendations, dated Automatic Lot October 20 and 31 respectively regarding automatic lot splitting in the Splitting - Palisades Tract and the division of RI properties was discussed. Palisades Tract Mrs. Reed moved that an ordinance be drafted amending Sections 9106A and 9145A7 to eliminate automatic lot splitting in the Palisades Tract and preclude RI lot division by variance of less than 6,000 square feet. The motion was seconded by Mr. van den Steenhoven and carried with Council members Cohen, Judson, Reed, Swink, van den Steenhoven and Trives voting "AYE". At 11.00 P.M. Mr. McCloskey moved to adjourn until 3:00 P.M. November 13, in the Council Chambers.
