R-10295Council Meeting: May 27, 2008 Santa Monica, California RESOLUTION NUMBER io295 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING THE MEMBERSHIP, TERMS, SCOPE AND RESPONSIBILITIES OF THE MEASURE V CITIZENS OVERSIGHT COMMITTEE WHEREAS, the people of the City of Santa Monica adopted a Clean Beaches and Ocean Parcel Tax in November 2006 by adding Section 7.64. of the Santa Monica Municipal Code; and WHEREAS, Section 7.64.080 of the Santa Monica Municipal Code authorizes the City Council to establish a Citizens Oversight Committee to audit the use of the Tax Proceeds,. and authorizes the City Council to determine the membership, scope and responsibilities of the Committee; and WHEREAS, the proceeds of the tax, together with any interest and penalties thereon, shall be used exclusively for the implementation of the Watershed Management Plan as described in Section 7.64.050 of the Santa Monica Municipal Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The Citizens Oversight Committee shall be comprised of five (5) residents of the City of Santa Monica who shall each be appointed by a majority vote of the City Council. Initially, two (2) of the members shall have a 1- year term, and the other three (3) members will have a 2-year term. After the initial appointments, the terms shall expire every 2 years. However, Committee members may be reappointed to additional two-year terms, without limitation; by a majority vote of the City Council. SECTION 2. The responsibilities of the Committee are solely advisory to the City Council and shall consist of: 1) review of proposed capital and operating expenditures from Measure V funds; 2) review of actual Measure V capital and operating expenditures; and 3) review of proposed Measure V capital projects to confirm consistency with the generally or specifically established water quality improvement goals of the program. SECTION 3. The Committee members shall set a schedule of meetings for the Committee that shall not be less than bi-annually. SECTION 4. The Director of Environmental and Public Works Management shall designate a staff liaison to the Committee, and the Committee with the assistance of the staff liaison shall prepare and submit an annual report to the City Council that generally describes the Committee's successful attainment of its oversight responsibilities. SECTION 5. The City Clerk, or her designee, shall serve as Secretary to the Committee. SECTION 6. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
