A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO SUBMIT
AND EXECUTE AGREEMENTS AND ANY AMENDMENTS THERETO TO
IMPLEMENT THE ABOVEGROUND PETROLEUM STORAGE TANK ACT
GRANT PROGRAM
WHEREAS, the people of the State. of California have enacted the Aboveground
Petroleum Storage Tank Act which provides funds to city and county Certified Unified
Program Agencies (CUPA's) for implementing, enforcing, and administering the
Aboveground Storage Tank Program; and
WHEREAS, the California Environmental Protection Agency has been delegated
the responsibility for the administration of the program within the state including, setting
up necessary procedures governing application by city and county CUPA's under the
program; and
WHEREAS, the City Council authorized the City of Santa .Monica to become a
CUPA in 1997 in order to administer the consolidation .and coordination of six specific
hazardous material control programs including the Underground Storage Tank Program,
Aboveground Petroleum Storage Tank Program, the California Accidental Release
Prevention Program, Business Plan Program, Hazardous Materials Management

Plan/Hazardous Materials Inventory Statement Program, and the Hazardous Waste
Generator/Tiered Permitting Program.
WHEREAS, the City of Santa Monica CUPA will use. these grant funds made
available pursuant to California Health and Safety Code, Section 25270.11 and per the
grant agreement, (and any amendments) in conjunction with the California
Environmental Protection Agency to .implement, enforce, and administer the
Aboveground Petroleum Storage Tank Act Grant Program; and
WHEREAS, the City of Santa Monica CUPA desires to enter into an agreement
with the State of California for the implementation of an Aboveground Storage Tank Act
Grant Program,
NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. City of Santa Monica hereby authorizes the submittal of grant
applications to the California Environmental Protection Agency for grants .under the
Aboveground Petroleum Storage Act from January 1,-2008 through March 1;-2010.
SECTION 2: The City of Santa Monica authorizes the City Manager or designee,
to execute and amend all necessary applications, contracts, payment requests,
agreements, and amendments with the California Environmental .Protection. Agency
thereto for the purpose of securing grant funds to implement and carry out the purposes
specified in thhe grant application.

SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
