A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
DESIGNATING THE DEPARTMENT OF PUBLIC HEALTH OF THE
COUNTY OF LOS ANGELES AS THE LOCAL ENFORCEMENT
AGENCY PURSUANT TO THE CALIFORNIA INTEGRATED
WASTE MANAGEMENT ACT OF 1989
WHEREAS, the California Public Resources Code Section 43202
provides that there may be designated in each county an enforcement agency
to carry out the provisions of the California Integrated Waste Management Act
of 1989, commencing with Section 40000 of the Public Resources Code
Division 30, as it may be amended from time to time; and
WHEREAS, pursuant to the Public Resources Code Section 43203(a),
the City Council of the City of Santa Monica may designate a local
enforcement agency to carry out provisions of the Act in the City of Santa
Monica; and
WHEREAS, the Department of Public Health of the County of Los
Angeles, possesses the required technical expertise, staff resources, budget
resources, and training to carry out the enforcement program mandated by the
Act;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. .Pursuant to Public Resources Code 43203(a), the
Department of Public Health of the County of Los Angeles is designated as the
Local Enforcement Agency to carry out the provisions of the Act of 1989 in the
City of Santa Monica.
SECTION 2. The City Clerk shall certify to the adoption of this
Resolution, and thenceforth and thereafter the same shall be in full force and
effect.
