R-10260RESOLUTION NO. 10260 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE PUBLIC ATTORNEYS' LEGAL SUPPORT STAFF UNION WHEREAS, the City administration and representatives of the Public Attorneys' Legal Support Staff Union have met and conferred under the terms of Ordinance No. 801 (CCS) and have reached agreement on wages, hours and other terms and conditions of employment, with the a summary of the changes to the agreement set forth in the Attachment to this Resolution; and WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) of the City of Santa Monica requires preparation of a written Memorandum of Understanding between the administration and employees if an agreement can be reached; and WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) further provides that any such Memorandum of Understanding shall not be binding unless and until presented to the governing body for determination; and WHEREAS, the purpose of the Memorandum of Understanding is to promote and provide harmonious relations, cooperation, and understanding between the City and the Public Attorneys' Legal Support Staff Union; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Santa Monica does hereby approve and authorize the City Manager to execute the Memorandum of Understanding ratified by the Public Attorneys' Legal Support Staff Union. Section 2. The City Clerk shall certify to the adoption of this Resolution, which includes an Attachment setting forth a summary of the changes to the agreement, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: !U MA SHA J ES MO d'RIE City orne (PALSSU.Resolution.2007--2070 MOU) City Council Meeting: November 27, 2007 Agenda Item: 1-G ATTACHMENT: Resolution Authorizing the City Manager to Execute a Memorandum of Understanding with the Public Attorneys' Legal Support Staff Union (PALSSU) SUMMARY OF CHANGES TO MEMORANDUM OF UNDERSTANDING Term of Agreement: 3 years (FY2007-08 through FY2009-2010) Salaries: FY2007-08: 3.1 % general salary increase based on CPI 4% equity adjustment for all job classifications represented by PALSSU except the Receptionist, Investigator and new Legal Secretary I job classifications The "cash value" of the current cashable MOU (personal leave) days, of which there are five (5), will be rolled into the base salary ranges of each job classification represented by PALSSU, with cashable MOU days no longer being provided to PALSSU The current Legal Secretary will be titled Legal Secretary II, with a new job classification of Legal Secretary I being added. The salary of Legal Secretary I will be based on surveys of comparable public sector agencies. Top step of the salary range for Legal Secretary I for FY2007-08 will be $4,455.00 per month, which is 29% less than the top step salary established for Legal Secretary II after the above-listed salary changes have been implemented. As Legal Secretary II's retire or separate from the City for other reasons, the City Attorney will now have the option of hiring Legal Secretary I's at a lower rate of pay. Advancement from Legal Secretary I to Legal Secretary II will be considered a promotion, with the promotion being at the discretion of the City Attorney. FY2008-09: general salary increase based on CPI; 2% minimum; 4% maximum FY2009-10: general salary increase based on CPI; 2% minimum; 4% maximum MOU (Unclassified Leave) Days: FY2007-2008: The current cashable MOU (personal leave) days will be deleted and replaced with four (4) non-cashable leave days which must be used by the end of the fiscal year or be forfeited. Classification & Compensation Studv: A classification and compensation study will be conducted for all of the positions represented by PALSSU. The study will result in positions being classified correctly, with the appropriate rate of pay for each classification being established. Current incumbents will not be impacted unless a reclassification to a higher-level position with a higher rate of pay is warranted. For those positions that should be classified at a lower level, with a lower rate of pay, those changes will be made through attrition. When the current incumbent of one of those positions separates from City employment, the replacement will be hired into the appropriate job classification and at the appropriate rate of pay. Pay for Serving in a Higher Job Classification: The hourly rate of pay for serving in a higher job classification on a temporary basis due to the absence of the permanent incumbent will be increased from $0.75/hour to $1.25/hour. This change will give PALSSU parity with other City bargaining units that are paid $1.25/hour for the temporary acting assignments. Performance Bonus: The current performance bonus plan, which is just based on the overall performance rating received by the employee, will be replaced with an annual performance bonus plan under which covered employees will be eligible for a performance bonus of 0% to 10% based on specific criteria (to be spelled out in the MOU), such as hours worked, workload, work difficulty, etc. Tuition Reimbursement: Tuition reimbursement will be increased from $1,500 per fiscal year to $2,000 per fiscal year, which will give PALSSU parity with the City's other non-sworn bargaining units. Automatic Roll-over of MOU: 2 In the event neither the City nor PALSSU wish to reopen the MOU when it is set to expire, the contract, with the cost of living formula (CPI; 2% minimum; 4% maximum), rolls over for another fiscal year. 3 Adopted and approved this 27th day of November, 2007.
