A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER
TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE
MANAGEMENT TEAM ASSOCIATES
WHEREAS, the City administration and representatives of the Management
Team Associates have met and conferred under the terms of Ordinance No. 801 (CCS)
and have reached agreement on wages, hours and other terms and conditions of
employment, with the a summary of the changes to the agreement set forth in the
Attachment to this Resolution; and
WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) of the City of Santa
Monica requires preparation of a written Memorandum of Understanding between the
administration and employees if an agreement can be reached; and
WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) further provides that
any such Memorandum of Understanding shall not be binding unless and until presented to
the governing body for determination; and
WHEREAS, the purpose of the Memorandum of Understanding is to promote
and provide harmonious relations, cooperation, and understanding between the City and
the Management Team Associates;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Santa Monica does hereby approve
and authorize the City Manager to execute the Memorandum of Understanding ratified by
the Management Team Associates.
Section 2. The City Clerk shall certify to the adoption of this Resolution,
which includes an Attachment setting forth a summary of the changes to the agreement,
and thenceforth and thereafter the same shall be in full force and effect.

SUMMARY OF CHANGES TO MEMORANDUM OF UNDERSTANDING
Term of Agreement:
2 years (FY2007-08 through FY2008-09)
Salaries:
FY2007-08: 3.1 % general salary increase based on CPI
FY2008-09: general salary increase based on CPI; 2% minimum; 4% maximum
"Me Too" Provision re: General Salarv Increase:
MTA will receive the same general salary increase in the event another City bargaining unit
receives a general salary increase in excess of the salary increase provided by the MTA
MOU. The exception would be equity adjustments granted to a specific job classification,
which would include salary increases granted to Motor Coach Operators, which is the only
job classification represented by the United Transportation Union (UTU).
Cashable MOU (Personal Leave) Dav:
One (1) day accrued at the beginning of each fiscal year, starting as of FY2007-08
The employee has the option of taking the day off with pay or cashing it out at the end of the
fiscal year.
Non-Cashable MOU (personal leave) Davs:
Two (2) additional non-Cashable days, for a total of four (4) days, accrued at the beginning
of each fiscal year, starting as of FY2007-2008. The days, if not used, are forfeited at the
end of the fiscal year.
Performance Evaluation Appeal Procedure:
With the changes to the Civil Service rules and regulations, a more streamlined performance
evaluation appeal procedure is being added to the MOU to replace the performance appeal
procedure that had previously been included in the Civil Service rules and regulations.
Pay for Serving in a Higher Job Classification:
In the prior MOU, an MTA employee only received pay for serving in a higher job
classification on an "acting" basis if he/she served in that capacity for a minimum of twenty
(20) consecutive work days. The contract has been changed to provide "acting" pay if the
MTA employee serves in that capacity for a minimum of fourteen (14) calendar days, which
is two (2) work weeks. This provides MTA parity with the administrative and professional
employees whom they supervise.
Signing Bonus:
A signing bonus program will be in effect for hard to fill positions, as determined by the City.
The City shall have the right to change the status of a position that has been designated as
a hard to fill position to one that no longer qualifies for that designation.
Under this program, new hires for the designated positions will be entitled to receive a
signing bonus upon being hired by the City. The signing bonus will be equal to ten percent
(10%) of the employee's annual base salary. The recipient of the signing bonus shall be
required to commit to at least twelve (12) months of service with the City following the date
on which the bonus is paid. In the event the recipient of the bonus should separate from the
City within less than twelve (12) months following receipt of the bonus, he/she shall be
required to reimburse the City for the full amount of the bonus.
Bereavement Leave:
Clarification language was incorporated into the contract to clearly state that a maximum of
forty (40) hours of bereavement leave would be granted in the event a family member, with
the family members being specified in the MOU, passed away. The former contract stated
that the employee would be granted up to five (5) work days, which could equate to more
than forty (40) hours depending on the employee's work schedule. Specifying forty (40)
hours, rather than five (5) work days, provides the same benefit to all City employees.
Automatic Roll-over of MOU:
In the event neither the City nor MTA wish to reopen the MOU when it is set to expire, the
contract, with the cost of living formula (CPI; 2% minimum; 4% maximum), rolls over for
anotherfiscal year.
