O1112 '......lJ. .1'..l.JI\.; 00u ;U.L COUNCIL MTG. 12-l2-78 Santa Monica, California ORDINANCE NO. 1112(CCS) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA HONICA AMENDING SECTION 4122 AND REPEALING SECTION 4123 OF THE SANTA MONICA MUNICIPAL CODE, AUTHORIZING THE CITY COUNCIL TO ESTABLISH, BY RESOLUTION, FEES AND CHARGES FOR THE HANDLING OF ANIMALS AT THE ANIMAL CENTER. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 4122 of the- Santa Monica Municipal Code is amended to read as follows: Section 4122. ANIMAL CONTROL FEES. The City Council may, by resolution, establish fees and charges for services rendered in connection with the handling of animals at the Animal Control Center, including, but not limited to, fees and charges for the impounding, disposal, boarding, placement, and vaccination of animals. SECTION 2. Section 4123 of the Santa Monica Municipal Code is hereby repealed. SECTION 3. Any provisions of the Santa Monica Municipal Code, or appendices thereto inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this ordinance. SECTION 4. If any section, subsection, sentence, ~fi l'd...l\.; OJ OJ OJ ; a I: COUNCIL MTG. 12-12-78 Santa Monica, California clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of com- petent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (l5) days after its adoption. The ordinance shall become effective after thirty (30) days from its adoption.
