(Redevelopment Agency) A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA DETERMINING THAT CERTAIN BUILDINGS, FACILITIES, STRUCTURES AND OTHER IMPROVEi~NTS ARE OF BENEFIT TO THE DOWNTOrlli REDEVELOPMENT PROJECT AREA. WHEREAS, the C~ty Councll on January 27, 1976, approved and adopted the offlclal Redevelopment Plan for the Downtown Redevelopment ProJect; and, WHEREAS, the area of the Clty of Santa Monlca included In said Redevelopment Plan is descrlbed as follo\,7s: "That certa~n parcel of land ~n the City of Santa Monica, County of Los Angeles, State of Californla, descrlbed as follows: That portlon of land bounded by the northeasterly Ilne of Fourth Street, elghty feet wlde; the southeasterly Ilne of Colorado Avenue (formerly known as Railroad Avenue), e~ghty feet wide; the southwesterly Ilne of Second Street, eighty feet wide; and the northwesterly lIne of Broadway (formerly known as Utah Avenue) , e~ghty feet wlde; as shown on amended map of Town of Santa Monica Tract, In the City of Santa Monlca, County of Los Angeles, State of Callfornla, as per map recorded In Book 39, -1- . . . Page 45 et seq. of Mlscellaneous Records In the Offlce of the County Recorder of sald County, II (hereln- after referred to as "ProJect Area"); and, WHEREAS, Sectlon 33445 of the Health and Safety Code of the State of Callfornla provides, inter alla. as follows: Sectlon 33445. Notwithstandlng the provlsions of Sectlon 33440, an agency may, wlth the consent of the legislatlve body, pay all or part of the value of the land for and the cost of the lnstallatlon and construction of any bUlld1ng, faclllty, structure, or other lmprovement Wh1Ch is publlCly owned elther wlth1n or without the proJect area, upon a determlnatlon by resolut1on of the agency and local leglslatlve body that such bU1ldlngs, facll1t1es, structures, or other 1mprovements are of beneflt to the proJect area regardless of whether such 1mprovement is w1thln another proJect area. or 1n the case of a proJect area 1h Wh1Ch substant1ally all of the land 1S publlCly owned that such lmprovement 1S of beneflt to an adjacent project area of the agency. Such deterrnlnation by the agency and the local leglslatlve -2- . . . CA RLK:SIS:cam _9-76 e body shall be flnal and conclusive as to the lssue of beneflt to the proJect area..."; and. rlliEREAS, a disposltlon and development agreement was entered lnto between the Agency and Santa Monlca Place ASSoclates on or about September 10. 1975, by the terms of WhlCh the Agency IS authorized to pay all or part of the value of land for and the cost of the lnstallatlon of parklng facllltles, parklng structures, and related publlC lmprovements to be located withln the ProJect Area; and WHEREAS, such parklng facl1ltles, parklng structues and related lmprovements are of benerlt to the ProJect Area because they satlsfy the othenvlse unaval1able parkIng and traffic needs and requlrements for the Project Area in accordance wlth sald Redevelopment Plan. NON. THEREFORE. THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA DOES RESOLVE AND DETERHTNE AS FOLLO\>lS~ SECTION 1. That sald parklng faclll tles, structures and related publlC improvements are of beneflt to the sald ProJect Area. SECTION 2. Pursuant to Section 33445 of the Health and Safety Code of the State of Callfornla, thlS determlnation of the Redevelopment Agency of the City of Santa Monlca shall be flnal and concluslve as to the lssue of beneflt to the ProJect Area.
