Second by Councilmember Katz. The motion was unanimously approved, Councilmember Zane absent. 6. CONSENT CALENDAR: Presented was the Consent Calendar, whereby all items are considered and approved in one motion unless removed from the calendar for discussion. Councilmember Katz moved to approve the Consent Calendar, including the amended minutes, with the exception of Item No.6-B. Second by Mayor Pro Tempore Genser. The motion was approved by the following vote: Council vote: Affirmative: councilmembers Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane Councilmember Katz moved to reconsider his motion on the Consent Calendar. The motion was approved by the I following vote: council vote: Affirmative: councilmembers Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane 6-A: MINUTES APPROVAL: The minutes of the City Council meetings of June 18 and June 25, 1991, were approved as amended. 6-C: EXPOSITION RIGHT-OF-WAY PRELIMINARY PLANNING STUDY: contract No. 5740(CCS) was approved, thereby authorizing the city Manager to negotiate and execute a contract with the Transportation Commission for Exposition Right-of-Way Preliminary Planning Study. END OF CONSENT CALENDAR 6-B: UNDERGROUND FUEL STORAGE TANKS: Presented was the recommendation to authorize the City Manager to negotiate and execute a contract with Lindmark Engineering for services associated with City underground fuel storage tanks. Member of the public Joy Fullmer expressed her concerns. Councilmember Katz moved to approve Contract No. 5739 (CCS) in the amount of $244,375 with Lindmark Engineering for services associated with I 2 July 16, 1991 I I I 11 city underground fuel storage tanks. Second by Mayor Pro Tempore Genser. The motion was approved by the following vote: council vote: Affirmative: Councilmembers Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane 8-A: LANDMARKS AND HISTORIC DISTRICTS: Presented was an ordinance for introducion and first reading by title only and waiving further reading thereof amending Chapter 6 of Article IX of the Santa Monica Municipal Code relating to Landmarks and Historic Districts. Council asked questions of staff. At 8:15 P.M., Mayor Abdo declared the public hearing open. Member of the public Joy Fullmer expressed her concerns. Member of the public Patricia O'Neill offered suggestions for possible changes. Member of the public Merritt Coleman spoke in support of the proposed ordinance. Mayor Abdo closed the public hearing at 8:25 P. M. Mayor Pro Tempore Genser moved to introduce the ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING CHAPTER 6 OF ARTICLE IX OF THE SANTA MONICA MUNICIPAL CODE RELATING TO LANDMARKS AND HISTORIC DISTRICTS," for first reading with the following changes: 1. with regard to language prepared by staff in Section 9606.1, substitute a period between subdivision (a) and subdivision (b), and eliminate the word "or" which is currently included, and add the word "one ofll in the first sentence of section 9606.1 so that it reads n...that it merits official recognition because it has one of the following characteristics."; 2. Substitute section 9615 which was handed out for the section in the earlier handout: 3. Add section 9605(g) to read as follows: "Participate in the environmental review procedures called for under this chapter or under the California Environmental Quality Act by providing such comments as the commission deems appropriate." Second by councilmember Olsen. Discussion was held. Councilmember Katz moved to amend the motion to include language under 9615(d) to add parkways to the portion addressing the repaving of existing front yard paving, concrete work, and walkways. The motion was accepted as friendly. Councilmember Katz moved to amend the motion to amend the second phrase of section 9603 to read "...or have demonstrated interest, knowledge, and practical or professional experience to the highest extent..., II as a base criteria for considering people for participation. The motion was accepted as friendly. Councilmember Holbrook moved to amend the motion to include a stipulation in Section 9603 for a California real estate licensee that said licensee be a practicing realtor. Motion died for lack of a Second. Councilmember Olsen moved to amend the motion to change the I anguage in Section 9603 which reads, " . . . all of whom shall be qualified electors of the city.1I to read "...all of whom shall be residents of the city." The motion was accepted as friendly. councilmember Olsen moved to amend his prior amendment to stipulate a minimum age of 18. The motion was accepted as friendly. Discussion was held. Council asked questions of staff. At 8: 56 P.M., Mayor Abdo declared the public hearing open. Members of the public Patricia Hoffman, David Geffner, Neil comess-Daniels, and perryne Anker spoke in support of the ordinance with amendments. Member of the public Joy Fullmer expressed her concerns. Member of the public Jerome Goldman spoke in support of the ordinance. Councilmember Olsen moved to hear a late chit. Second by Councilmember Katz. The motion was unanimously approved, Councilmember Zane absent. Member of the public Beloved Quail expressed his concerns. Mayor Abdo closed the public hearing at 9:30 P.M. Council asked questions of staff. Discussion was held. Mayor Pro Tempore Genser moved to approve the negative declaration and introduce for first reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3238U TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE U," as amended by changing Section 3238U(b) from Saturday to Friday, reading by title only and waiving further reading thereof. Second by Councilmember Olsen. Discussion was held. The motion was approved by the following vote: Council vote: Affirmative: councilmembers Genser, Holbrook, Olsen, Vazquez, Mayor Abdo I Negative: Councilmember Katz Absent: Councilmember Zane Councilmember Katz requested that the record reflect that he voted "no" on this item because he cannot support the negative declaration due to the negative impact this parking zone will have on the surrounding streets. At 9:39 P.M., Council adjourned reconvened at 10:07 P.M. with Councilmember Zane. for a short recess. all members present, Council except 8-C: PREFERENTIAL PARKING ZONE V: Presented was an ordinance for introduction and first reading adding Section 3238V to the Santa Monica Municipal Code to establish Preferential Parking Zone V on pine street and Maple street between Lincoln Boulevard and lOth street. At 10:09 P.M., Mayor Abdo declared the public hearing open. Member of the public Carmen Casillas spoke in support of the ordinance. Mayor Abdo closed the public hearing at 10: 12 P.M. The motion was approved by the following vote: council vote: Affirmative: councilmembers Genser, Holbrook, Olsen, Vazquez, Mayor Abdo Negative: Councilmember Katz Absent: Councilmember Zane Councilmember Katz requested that the record reflect that he voted "noll on this item because he cannot support the negative declaration due to the negative impact this parking zone will have on the surrounding streets and he believes in this instance that problems in this area can be solved with alternative measures. 8-0: PREFERENTIAL PARKING ZONE W: Presented was an ordinance for introduction and first reading adding section 3238W to the Santa Monica Municipal Code to establish Preferential parking Zone W on 29th street between Ocean Park Boulevard and Pearl Street. At 10:21 P.M., Mayor Abdo declared the public hearing open. There being no one wishing to speak, Mayor Abdo closed the public hearing. Mayor Pro Tempore Genser moved to approve the negative declaration and introduce for first reading an ordinance entitled: IlAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3238W TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE W," reading by title only and waiving further reading thereof. Second by councilmember Olsen. Mayor Pro Tempore Genser moved to approve the negative declaration and introduce for first reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3238X TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE X," reading by title only and 5 July 16, 1991 14 waiving further reading thereof. Mayor Pro Tempore Genser moved to establish a Task Force on the Environment and authorize the City Manager to appoint Robert Gottlieb, Mark Gold, Gero Leson, Miriam Koral, April Smith, Lisa Weil and David Phillips to the task force. Second by Councilmember Olsen. The motion was approved by the following vote: council vote: Affirmative: Councilmembers Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane I 10-A: SIDEWALKS/DRIVEWAYS/CURBS: Presented was the staff report recommending confirmation of assessments of costs to repair damaged sidewalks, driveways and curbs (SR-91-173). Councilmember Katz moved to adopt Resolution No. 8259(CCS) entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS (SR-91-173) ," reading by title only and waiving further reading thereof. Second by Councilmember Olsen. The motion was approved by the following vote: council vote: Affirmative: Counci1members Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane 10-B: STREET RESURFACING PROGRAM: Presented was the staff report acknowledging two protests and recommending establishment of an assessment district for gutter construction, street resurfacing, and repair of damaged sidewalks, driveways, and I curbs on various city streets in conjunction with the 1990-91 street resurfacing program. council asked questions of staff. Member of the public Joy Fullmer expressed her concerns. 6 July 16, 1991 I I I 15 Councilmember Katz moved to adopt Resolution No. 8260(CCS) entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDERING CONSTRUCTION OF CONCRETE GUTTERS, STREET RESURFACING AND REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS ON VARIOUS CITY OF SANTA MONICA STREETS, II reading by title only and waiving further reading thereof, and to coordinate timing of such construction with Montana merchants and Santa Monica College. Second by Councilmember Holbrook. The motion was approved by the following vote: Council vote: Affirmative: councilmembers Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane l2-A: MEMORANDUM OF UNDERSTANDING/SANTA MONICA POLICE OFFICERS' ASSOCIATION: The resolution authorizing the City Manager to execute a Memorandum of Understanding with the Santa Monica police Officers' Association was continued to the meeting of July 23, 1991. 14-A: APPOINTMENTS/BOARDS AND COMMISSIONS: Mayor Abdo opened the floor to nominations to fill three vacancies on the Arts commission. Mayor Pro Tempore Genser moved to appoint by acclamation Hiromi Katayama, Ying Chao Kuo, and Rosalyn Mesquita to the Arts Commission for terms ending June 30, 1995. The motion was unanimously approved, Councilmember Zane absent. Mayor Abdo opened the floor to nominations to fill two vacancies on the Comission on Older Americans. councilmember Vazquez moved to appoint by acclamation Vida Kaplan to the Commission on Older Americans for a term ending June 3D, 1995, and Garrett Spector-Leech for a term ending June 30, 1994. The motion was unanimously approved, Councilmember Zane absent. Mayor Abdo opened the floor to nominations to fill two vacancies on the Housing Commission. Councilmember Holbrook excused himself due to a conflict of interest. Mayor Pro Tempore Genser nominated Vera Tanner to the Housing Commission. Mayor Abdo nominated Franceye Smith to the Housing Commission. On a call for a vote, Franceye Smith was appointed. Mayor Pro Tempore Genser moved to appoint by acclamation Franceye Smith to the Housing Commission for a term ending June 30, 1993, Councilmembers Holbrook and Zane absent. Mayor Pro Tempore Genser moved to appoint by acclamation Vera Tanner to the Housing Commission for a term ending June 30, 1993. The motion was unanimously approved, Councilmembers Holbrook and Zane absent. Councilmember Holbrook returned to his seat on the dais. 14-B: SMOKE DETECTORS: Presented was the request of Councilmember Katz to discuss requiring the installation of hard wire smoke detectors in accordance with current codes, in all re-sales of residential units. Discussion was held. Counci1member Katz moved to direct staff to study the possibility of requiring the installation of hard wire smoke detectors on 7 July 16, 1991 16 re-sale of residential units, including costs, and return with a draft ordinance. Second by Mayor Pro Tempore Genser. Mayor Pro Tempore Genser moved to amend the motion to include direction I that this be prepared in conjunction with staff work on water heater changes on re-sale of residential units. The motion was accepted as friendly. Discussion was held. The motion was approved by the following vote: Council vote: Affirmative: Councilmembers Genser, Holbrook, Katz, Olsen, Vazquez, Mayor Abdo Absent: Councilmember Zane 15: PUBLIC INPUT: Member of the public Joy Fullmer addressed Council regarding police brutality and the news media. Member of the public One Over Humanity addressed Council regarding homelessness. Member of the public Art Casillas addressed Council regarding financing of new police officers and problems with drugs and gangs. CLOSED SESSION: councilmember Holbrook moved to approve a settlement of $20,000 in the case of Lecaros v. city of Santa Monica et al., Santa Monica Superior Court Case Number WEC 134 843 and a settlement of $25,000 in the case of Ramirez v. City of Santa Monica et al., Santa Monica Superior Court Case Number WEC 134 118. Second by Councilmember Vazquez.
